All the special committees of the National People's Congress ("NPC") and all the working commissions under the Standing Committee of the NPC: 全国人大各专门委员会、全国人大常委会各工作委员会:
The Working Rules for the Introduction of Third-Party Assessments of Material Legislative Matters in Significant Controversy, as deliberated and adopted at the first meeting of the 19th Central Leading Group for Comprehensively Deepening Reform, are hereby issued to you for your conscientious implementation. 《关于争议较大的重要立法事项引入第三方评估的工作规范》已经十九届中央全面深化改革领导小组第一次会议审议通过,现予印发,请认真贯彻执行。

Working Rules for the Introduction of Third-Party Assessments of Material Legislative Matters in Significant Controversy 关于争议较大的重要立法事项引入第三方评估的工作规范
Article 1 For the purposes of profoundly advancing scientific, democratic, and lawful legislation, maximizing the positive role of social resources in the legislative work, and solving and processing in a timely and proper manner the material legislative matters in significant controversy in the course of legislation, these Rules are developed based on legislative practices.   第一条 为了深入推进科学立法、民主立法、依法立法,充分发挥社会力量在立法工作中的积极作用,及时妥善解决和处理立法中争议较大的重要立法事项,结合立法工作实际,制定本规范。
Article 2 For the purposes of these Rules, "third-party assessments" means that institutions other than interested parties (hereinafter referred to as the "third parties") conduct special research and comprehensive assessments of material legislative matters in significant controversy by scientific, systematic, and standard assessment approaches and submit assessment reports to provide references for legislative decision making.   第二条 本规范所称第三方评估,是指由利益利害关系方以外的机构(以下简称第三方),运用科学、系统、规范的评估方法,对有较大争议的重要立法事项进行专项研究和综合评估,并提交评估报告,为立法决策提供参考的活动。
Article 3 Where there is any significant controversy between the relevant parties in the following material legislative matters for bills already on the agenda of sessions of the Standing Committee of the NPC, third-party assessments may be introduced:   第三条 列入全国人大常委会会议议程的法律草案,有关方面在下列重要立法事项上有较大争议的,可以引入第三方评估:
(1) The scope of regulation of a bill. (一)法律草案的调整范围;
(2) The necessity and feasibility of the major regimes and important rules in a bill. (二)法律草案提出的主要制度和重要规范的必要性、可行性;
(3) Any major adjustments of the relationships of rights and obligations among natural persons, legal persons, and unincorporated organizations by a bill. (三)法律草案对自然人、法人和非法人组织权利义务关系的重大调整;
(4) Definitions of important legal concepts. (四)重要法律概念的含义;
(5) Other material issues in a bill. (五)法律草案中的其他重要问题。
Article 4 To commission a third party to conduct an assessment, the Legislative Affairs Commission under the Standing Committee of the NPC shall, as needed in work, propose the subject matter of assessment, and after soliciting opinions of the relevant special committees and working commissions, report to the leader of the Standing Committee of the NPC for approval.   第四条 委托第三方开展评估,由全国人大常委会法制工作委员会根据工作需要,提出拟评估事项,经征求有关专门委员会、工作委员会的意见后,报请全国人大常委会领导批准。
The Legislative Affairs Commission shall undertake the specific work on third-party assessments as the client of third-party assessments. 法制工作委员会承担开展第三方评估的具体工作,并作为第三方评估工作的委托方。
Article 5 A third party may be commissioned to conduct an assessment by designation, bidding, or any other means.   第五条 委托第三方开展评估,可以采用定向委托、招标等方式进行委托。
The selection of a third party shall be open and transparent, and a commission agreement shall be entered into with the commissioned third party, providing for the specific matters commissioned and requirements.
