| Article 1 For the purposes of regulating the discussion and consultation over major interest adjustments involved in legislation, improving the mechanism of communication and contact between the legislature and the public, maximizing the positive role of social resources in the legislative work, and profoundly advancing scientific, democratic, and lawful legislation, these Rules are developed according to the relevant provisions of the Legislation Law and based on legislative practices. | | 第一条 为了规范立法中涉及的重大利益调整论证咨询工作，健全立法机关与社会公众的沟通联系机制，充分发挥社会力量在立法工作中的积极作用，深入推进科学立法、民主立法、依法立法，根据立法法的有关规定，结合立法工作实际，制定本规范。 |
| Article 2 For the purposes of these Rules, "discussion and consultation over major interest adjustments" means that the deputies to the National People's Congress (“NPC”), representatives of relevant state agencies, representatives of military authorities and military personnel and their families, representatives of people's groups, experts and scholars, representatives of low-level workers and the masses, and representatives of industry associations, among others, are invited under the prescribed procedures for the thematic discussion and consultation over the creation, change, and other adjustments of major relationships of rights and obligations or relationships of interest or stake involved in legislation. | | 第二条 本规范所称重大利益调整论证咨询，是指按照规定的程序，邀请全国人大代表、有关国家机关代表、军事机关和军人军属代表、人民团体代表、专家学者、基层工作者和群众代表、行业协会代表等，对立法中涉及的重大权利义务关系、利益利害关系的设定、变动等调整问题，进行专题论证和咨询的活动。 |
| Article 3 Where the following major interest adjustments are involved in the course of drafting, deliberating, and amending a bill, discussion and consultation shall be conducted to extensively and deeply hear the comments and recommendations from all relevant parties: | | 第三条 在法律草案起草和审议修改过程中，涉及下列重大利益调整事项的，应当进行论证咨询，广泛深入听取有关方面的意见和建议： |
| (1) Involving any major adjustment of the relationships of rights and obligations among natural persons, legal persons, and unincorporated organizations. | | （一）涉及自然人、法人和非法人组织间权利义务关系重大调整的； |
| (2) Involving any focal or difficult issue that attracts wide public attention or any prominent conflict encountered in economic and social development. | | （二）涉及社会公众普遍关注的热点难点问题和经济社会发展遇到的突出矛盾的； |
| (3) Involving any major interest adjustment between groups with different interest appeals. | | （三）涉及有不同利益诉求群体之间的重大利益调整的； |
| (4) Involving any derogation of rights or addition of obligations of citizens, legal persons, and unincorporated organizations which has a significant public impact. | | （四）涉及减损公民、法人和非法人组织权利或者增加其义务，对社会公众有重要影响的； |
| (5) Other major interest adjustments requiring thematic discussion and consultation. | | （五）需要进行专题论证咨询的其他重大利益调整事项。 |
Article 4 Where any major interest adjustments are involved in the course of drafting a bill, the department or entity leading the drafting task shall organize the specific discussion and consultation work.
