The housing and urban-rural development departments (construction commissions), finance departments (bureaus), and land and resources departments (bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government; the Construction Bureau, Finance Bureau, and Land and Resources Department of Xinjiang Production and Construction Corps; the Shanghai Head Office and all branches, operations offices, and central sub-branches in capital cities of provinces (autonomous regions) and sub-provincial cities of the People's Bank of China ("PBC"); the housing provident fund management committees and housing provident fund management centers of municipalities directly under the Central Government and Xinjiang Production and Construction Corps: 各省、自治区、直辖市住房城乡建设厅(建委)、财政厅(局)、国土资源厅(局),新疆生产建设兵团建设局、财务局、国土资源局,中国人民银行上海总部、各分行、营业管理部、省会(首府)城市中心支行、副省级城市中心支行,直辖市、新疆生产建设兵团住房公积金管理委员会、住房公积金管理中心:
In 2014, the Ministry of Housing and Urban-Rural Development, the Ministry of Finance, and the PBC issued the Notice on the Development of Personal Housing Loans Using the Housing Provident Fund (No. 148 [2014], Ministry of Housing and Urban-Rural Development), explicitly requiring that real estate development enterprises not deny contributing employees' home purchases using housing provident fund loans, and certain satisfactory effects have been produced. Nevertheless, some real estate development enterprises still deny home buyers' use of housing provident fund loans, directly or in disguise, causing complaints from contributing employees. For the purposes of safeguarding the lawful rights and interests of employees contributing to the housing provident fund, allowing the housing provident fund to effectively play its role, regulating the order of the real estate market, and cleaning up the real estate market environment, you are hereby notified of the relevant matters as follows: 2014年,住房城乡建设部、财政部、中国人民银行印发《关于发展住房公积金个人住房贷款业务的通知》(建金[2014]148号),明确要求房地产开发企业不得拒绝缴存职工使用住房公积金贷款购房,取得了一定成效。但部分房地产开发企业仍然拒绝或变相拒绝购房人使用住房公积金贷款,引发缴存职工不满。为维护住房公积金缴存职工合法权益,有效发挥住房公积金制度作用,规范房地产市场秩序,净化房地产市场环境,现就有关事项通知如下:
I. Shortened loan approval periods: Housing provident fund management centers and authorized banks shall standardize their business processes of such loans and cut the red tape to shorten the approval period. Approval work shall be completed within ten working days of acceptance of a loan application. If a loan is granted, the authorized bank shall, upon notice, handle loan formalities; otherwise, reasons for rejection shall be explained.   一、压缩贷款审批时限。住房公积金管理中心和受托银行要规范贷款业务流程,减少审批环节,压缩审批时限。自受理贷款申请之日起10个工作日内完成审批工作。准予贷款的,通知受托银行办理贷款手续;不准予贷款的,应当说明理由。
II. Strict evaluation of the entrusted loan business: Housing provident fund management centers and authorized banks shall explicitly agree upon their division of duties and transaction periods in the agreements on entrusted loans. Authorized banks shall, according to the agreements, accept applications for housing provident fund loans from contributing employees and handle relevant entrusted loan formalities in a timely manner. Housing provident fund management centers shall strengthen the evaluation of authorized banks, and reduce the payment of loan service charges to banks which fail to perform as agreed in the entrusted loan agreements; and if the circumstances are serious, may suspend or cancel their qualifications for transacting housing provident fund business.

   二、严格委贷业务考核。住房公积金管理中心和受托银行应在委托贷款协议中明确约定职责分工和办理时限。受托银行要按照协议约定,及时受理职工住房公积金贷款申请和办理相关委托贷款手续。住房公积金管理中心要加强对受托银行的考核,对不履行委贷协议约定事项的,应扣减贷款手续费;情节严重的,可暂停或取消住房公积金业务办理资格。
