Notice of the Ministry of Land and Resources on Further Regulating the Approval and Registration of Exploration of Mineral Resources 

国土资源部关于进一步规范矿产资源勘查审批登记管理的通知

(No. 14 [2017] of the Ministry of Land and Resources) (国土资规[2017]14号)

The competent land and resources departments of all provinces, autonomous regions, and municipalities directly under the Central Government: 各省、自治区、直辖市国土资源主管部门:
For the purposes of fully implementing the spirit of the 19th CPC National Congress, deeply studying and carrying out the Xi Jinping Thought on Socialism with Chinese Characteristics for the New Era, conscientiously executing the requirements of the CPC Central Committee and the State Council regarding the building of ecological civilization and the reform of "simplification of administrative procedures, delegation of powers, combination of decentralization and control, and optimization of services", deepening the reform of the mineral right administration system, ensuring the sound and orderly development of the mineral resource exploration market, and protecting the lawful interests and rights of the holders of mineral rights, the administration of approval and registration of exploration of mineral resources shall be further regulated according to the Mineral Resources Law of the People's Republic of China, the Administrative License Law of the People's Republic of China, the Regulation on the Administration of Registration of Exploration Blocks of Mineral Resources, and other laws and regulations, based on the actual circumstances of administration of mineral rights. The relevant matters are hereby announced as follows. 为全面贯彻落实党的十九大精神,深入学习贯彻习近平新时代中国特色社会主义思想,认真落实党中央、国务院关于生态文明建设和“简政放权、放管结合、优化服务”改革要求,深化矿业权管理制度改革,保障矿产资源勘查市场健康有序发展,保护矿业权人合法权益,依据《中华人民共和国矿产资源法》《中华人民共和国行政许可法》《矿产资源勘查区块登记管理办法》等法律法规规定,结合矿业权管理工作实际,进一步规范矿产资源勘查审批登记管理。现将有关事项通知如下。
I. Regulating the access to exploration of mineral resources   一、规范矿产资源勘查准入
1. Creation of prospecting rights must conform to the policy requirements with respect to environmental protection, mineral resource plans, and national industry policies, etc. (一)设立探矿权必须符合生态环境保护、矿产资源规划及国家产业政策等政策要求。
2. Holders of prospecting rights in non-oil and gas shall, in principle, be the public institutions with the status of a legal person, either for-profit or non-profit. Holders of prospecting rights in oil and gas (including petroleum, natural gas, shale gas, coal-bed methane, and natural gas hydrate, and hereinafter the same) shall, in principle, be for-profit legal persons. (二)非油气探矿权人原则上应当为营利法人或者非营利法人中的事业单位法人。油气(包含石油、天然气、页岩气、煤层气、天然气水合物,下同)探矿权人原则上应当是营利法人。
3. The financial ability of an applicant for a prospecting right must be commensurate with the type of the mineral for exploration, the exploration area and the exploration phase under the application and evidenced by the provided proof of funds (or annual project plan in the case of a large-sized state-owned petroleum enterprise), and may not be less than the investment required for the first exploration year arranged in the plan for implementation for the exploration project under application. In the case of an exploration project solely funded by the local or central public finance, the project task statements and the official reply on budget shall be submitted. (三)探矿权申请人的资金能力必须与申请的勘查矿种、勘查面积和勘查工作阶段相适应,以提供的银行资金证明(国有大型石油企业年度项目计划)为依据,不得低于申请项目勘查实施方案安排的第一勘查年度资金投入额。中央或者地方财政全额出资勘查项目提交项目任务书及预算批复。
4. For an application for the creation or renewal of a prospecting right, modification of the type of mineral for exploration (including increase, hereinafter the same), or consolidation of prospecting rights, or splitting or modification of the exploration scope, the compilation of an exploration implementation plan shall be required. (四)申请探矿权新立、延续、变更勘查矿种(含增列,下同),以及探矿权合并、分立变更勘查范围,需编制勘查实施方案。
An exploration implementation plan shall conform to the rules, specifications and standards for a geological survey, and the planned prospecting investment may not be less than the minimum investment legally required. An applicant for a prospecting right may, as required, compile an exploration implementation plan by itself or authorize the relevant body to do it, and no registry body may appoint any particular intermediary agency to provide the service. The requirements for reviewing exploration implementation plans shall be governed by the relevant provisions. 勘查实施方案应当符合地质勘查规程、规范和标准,计划勘查资金投入不得低于法定最低勘查投入要求。探矿权申请人可按要求自行编制或者委托有关机构编制勘查实施方案,登记管理机关不得指定特定中介机构提供服务。勘查实施方案编制审查要求按有关规定执行。
II. Improving the administration of the approval of creation, renewal and retaining of prospecting rights   二、完善探矿权新立、延续、保留审批管理
5. The scope of a new prospecting right under application with respect to which the exploration is solely funded by local or central public finance may not be less than one block as the basic unit. (五)中央或者地方财政全额出资勘查的新立探矿权申请范围不得小于1个基本单位区块。
6. The scope of exploration under the application for a new prospecting right may not overlap the vertical projection of the scope of an existing mineral right, expect under the following circumstances: (六)新立探矿权的申请勘查范围不得与已设矿业权垂直投影范围重叠,下列情形除外:
(1) The scope under the application overlaps with the scope of an existing mineral right, and the applicant is the same entity as the holder of the existing mineral right. 1.申请范围与已设矿业权范围重叠,申请人与已设矿业权人为同一主体的;
(2) With respect to oil or gas and non-oil or gas, the scope under the application overlaps with that of an existing prospecting right (other than the prospecting right in coal-bed methane or coal), and the applicant submits to the registry body a commitment of not affecting the rights and interests of the holder of the existing prospecting right; and the scope under the application overlaps with the scope of an existing mining right (other than mining right in the category of small-scale sand, stone and soil quarrying), and the applicant and the holder of the existing mining right have entered into an agreement on non-impact and protection of rights and interests. 2.油气与非油气之间,申请范围与已设探矿权(煤层气与煤炭探矿权除外)范围重叠,申请人向登记管理机关提交不影响已设探矿权人权益承诺的;申请范围与已设采矿权(小型露采砂石土类采矿权除外)范围重叠,申请人与已设采矿权人签订了互不影响和权益保护协议的;
The scope under the application for adding coal-bed methane to an existing prospecting right in oil or gas overlaps with that of an existing mineral right in coal, and the applicant and the holder of the existing mineral right in coal have entered into an agreement on non-impact and protection of rights and interests. 已设油气探矿权增列煤层气申请范围与已设煤炭矿业权重叠,申请人与已设煤炭矿业权人签订了互不影响和权益保护协议的;
The scope of a new prospecting right in oil or gas under the application overlaps with a mining right in the category of small-scale sand, stone and soil quarrying, and the applicant submits to the registry body a commitment of not affecting the rights and interests of the holder of the existing mining right. 新立油气探矿权申请范围与已设小型露采砂石土类采矿权重叠,申请人向登记管理机关提交不影响已设采矿权人权益承诺的;
(3) The scope under the application with respect to a leachable sandstone-type uranium deposit overlaps with that of an existing mineral right in coal, and the applicant and the holder of the existing mineral right in coal have entered into an agreement on non-impact and protection of rights and interests. 3.可地浸砂岩型铀矿申请范围与已设煤炭矿业权范围重叠,申请人与已设煤炭矿业权人签订了互不影响和权益保护协议的。
An agreement on non-impact and protection of rights and interests shall be without prejudice to the national interests or the lawful rights and interests of any third party. Where a commitment has been made, the applicant for a prospecting right in non-oil or gas shall undertake not to affect the exploration and mining under an existing mineral right so as to ensure the work safety and protect the lawful rights and interests of the other party; and the applicant for a prospecting right in oil or gas shall undertake to reasonably avoid an existing mineral right not in gas or oil and not to affect the exploration and mining under an existing mineral right in non-oil or gas and, if avoidance is impossible, voluntarily quit so as to ensure the work safety and protect the lawful rights and interests of the other party.

 互不影响和权益保护协议不得损害国家利益和第三方合法权益。采取承诺方式的,非油气探矿权申请人应当承诺不影响已设矿业权勘查开采活动,确保安全生产、保护对方合法权益等;油气探矿权申请人应当承诺合理避让已设非油气矿业权,且不影响已设非油气矿业权勘查开采活动,无法避让的要主动退出,确保安全生产、保护对方合法权益等。
