| For the purpose of maximizing the role of professional legal talents in insurance regulation, the CIRC develop the Work Plan for Government Lawyers of the China Insurance Regulatory Commission according to the relevant requirements of the Opinions of the General Office of the CPC Central Committee and the General Office of the State Council on Promoting the Legal Adviser System and the Government Lawyer and Corporate Lawyer System (No. 30 [2016], General Office of the CPC Central Committee). | For the purpose of implementing the spirit of the 19th CPC National Congress, this Plan is developed, with regard to developing a government lawyer system in the CIRC system, based on the actual work of the CIRC and its dispatched offices, according to the work requirements of the Opinions of the General Office of the CPC Central Committee and the General Office of the State Council on Promoting the Legal Adviser System and the Government Lawyer and Corporate Lawyer System (No. 30 [2016], General Office of the CPC Central Committee). | | 为贯彻党的十九大精神，按照中央办公厅、国务院办公厅《关于推行法律顾问制度和公职律师公司律师制度的意见》（中办发〔2016〕30号）的工作要求，结合保监会及派出机构工作实际，就建立保监会系统公职律师制度，制定本方案。 |
| I. Job requirements and duties of government lawyers | | 一、公职律师的任职条件与职责范围 |
| 1. Job requirements. | | （一）任职条件。 |
| A person meeting the following conditions may apply for the job: | | 具备下列条件的人员，可以提出任职申请： |
| (1) Possessing the qualifications as a lawyer of the People's Republic of China or legal vocational qualifications. | | 1.具有中华人民共和国律师资格或法律职业资格； |
| (2) As a public officer within the staffing of the CIRC or its dispatched office. | | 2.系中国保监会及其派出机构正式在编公职人员； |
| (3) Having worked in the CIRC system for two years or more (excluding the probation period) and engaged in legal affairs. | | 3.在保监会系统中工作2年以上（不含试用期），且从事法律事务相关工作； |
| (4) Rated as "competent" or above in the annual appraisals over the last two years. | | 4.最近2年年度考核等次在“称职”以上； |
| (5) Good character and conduct, good political and business qualities, without records of violations of the laws and regulations or other circumstances inappropriate for legal work. | | 5.品行端正，并具有良好的政治、业务素质，无违法违规记录及其他不宜从事法律工作的情形； |
| (6) Consent of the CIRC to his assumption of the job. | | 6.中国保监会同意其担任公职律师。 |
| 2. Duties. | | （二）职责范围。 |
| (1) Participating in the drafting, review and amendment of laws, administrative regulations, rules, and regulatory documents on insurance supervision. | | 1.参与保险监督法律、行政法规、规章、规范性文件的起草、审议和修改工作； |
| (2) Offering legal opinions on major decision making and regulatory action. | | 2.为重大决策、重大监管行为提供法律意见； |
| (3) Participating in the negotiations over cooperative projects and assisting in drafting and amending important legal instruments or major contracts to which his/her entity is a party. | | 3.参与合作项目的洽谈，协助起草、修改重要的法律文书或者以所在单位为一方当事人的重大合同； |
| (4) Participating in administrative reconsideration, litigation, arbitration, and other legal affairs. | | 4.参与行政复议、诉讼、仲裁等法律事务； |
| (5) Providing legal services for the disposition of law or litigation-related cases, public complaint cases and major emergencies, among others. | | 5.为处置涉法涉诉案件、信访案件和重大突发事件等提供法律服务； |
| (6) Other work which his/her entity requires a government lawyer to undertake. | | 6.所在单位要求公职律师承担的其他工作。 |
| II. Rights and obligations of government lawyers | | 二、公职律师的权利与义务 |
| 1. Government lawyers enjoy the following rights. | | （一）公职律师享受以下权利。 |
(1) When practicing law, enjoying lawyers' practicing rights as described in the Lawyers Law, among others, in meeting, accessing case files, investigation and evidence gathering, questioning, cross-examination, debate, and other aspects as well as other rights as provided by the Lawyers Law.
