| For the purposes of implementing the spirit of the 19th CPC National Congress in depth, comprehensively carrying out the Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, following the explicit requirements for "enhancing the creation, protection and use of intellectual property rights" in the Report delivered by General Secretary Xi Jinping at the 19th CPC National Congress, executing the arrangements in the State Council's Plan for Market Regulation during the "13th Five-Year Plan" Period regarding implementation of the trademark and brand strategy, further improving the quality and efficiency of trademark examination, maximizing the important role of brands in leading economic development, and creating a good business environment, the following opinions on deepening the reform of trademark registration facilitation are hereby offered. | | 为深入贯彻党的十九大精神，全面落实习近平新时代中国特色社会主义思想，按照党的十九大报告关于“强化知识产权创造、保护、运用”的明确要求，落实国务院《“十三五”市场监管规划》关于实施商标品牌战略的部署，进一步提高商标审查质量和审查效率，充分发挥品牌引领经济发展的重要作用，创造良好营商环境，现就深化商标注册便利化改革提出以下意见。 |
| I. Enhancing the reform and specifying reform objectives | | 一、强化改革力度，明确改革目标 |
| According to the decisions and arrangements of the CPC Central Committee and the State Council, centering on implementing the trademark and brand strategy in depth, the reform of trademark registration facilitation shall be deepened, trademark examination systems and mechanisms shall be improved, internationally advanced level shall be focused on, the comprehensive improvement of the quality and efficiency of trademark examination shall be promoted, the trend of soaring amount of applications for trademark registration shall be effectively tackled, and the period of trademark examination business shall be further shortened. On the basis that, by the end of 2017, the period of issuance of a notice of acceptance of an application for trademark registration will have been reduced from three months to two months, and the period of examination in trademark registration will have been shortened from nine months to eight months, the following objectives will have been accomplished before the end of 2018: The period of issuance of a notice of acceptance of an application for trademark registration will have been reduced from two months to one month, the period of examination in trademark registration will have been shortened from eight months to six months, the period of examination of a trademark assignment will have been shortened from six months to four months, the period of examination of trademark modification or renewal will have been reduced from three months to two months, and the delay period for trademark search will have been reduced from three months to two months. | | 按照党中央、国务院决策部署，围绕深入实施商标品牌战略，深化商标注册便利化改革，完善商标审查体制机制，聚焦国际领先水平，促进商标审查质量和效率全面提升，有效应对商标注册申请量高速增长的态势，进一步缩短商标审查业务周期。在2017年底实现商标注册申请受理通知书发放时间由3个月压缩到2个月、商标注册审查周期由9个月压缩到8个月的基础上，2018年底前实现以下目标：商标注册申请受理通知书发放时间由2个月压缩到1个月，商标注册审查周期由8个月压缩到6个月，商标转让审查周期由6个月压缩到4个月，商标变更、续展审查周期由3个月压缩到2个月，商标检索盲期由3个月压缩到2个月。 |
| II. Advancing simplification of administrative procedures and delegation of powers and reforming systems and mechanisms | | 二、推进简政放权，改革体制机制 |
| 1. Accelerating the building of trademark examination cooperation centers. On the basis that existing trademark examination cooperation centers have developed scale-based examination capability, the Chongqing Trademark Examination Cooperation Center will have actual examination capability in April 2018. In addition, according to the actual growth of the amount of trademark applications, two to three trademark examination cooperation centers outside Beijing shall be established in an overall manner. Existing trademark examination cooperation centers shall, according to the examination tasks assumed by them, appropriately expand their size and staffing. | | （一）加快建设商标审查协作中心。在现有商标审查协作中心形成规模化审查能力基础上，重庆商标审查协作中心2018年4月形成实际审查能力。同时，根据商标申请量增长实际，统筹增设2至3个京外商标审查协作中心。现有商标审查协作中心根据承担的审查任务，适度扩大规模和人员数量。 |
| 2. Improving the services of local trademark acceptance windows. The approval of applications for establishing local trademark acceptance windows shall be accelerated, and existing centralized approval shall be changed to approval upon application. The power of online application shall be granted to local trademark acceptance windows, and automatic self service terminals for personal online applications shall be established, in order to expand the scope of trademark acceptance business. Personnel shall be arranged to guide parties in submitting online applications, the functions such as search for the information on the process of trademark business and printing and issuance of notices of acceptance of applications for trademark registration shall be added, trademark business consulting services shall be provided, and the capability of public services shall be further enhanced. | | （二）提升地方商标受理窗口服务水平。加快地方商标受理窗口申请设置审批，将原来的集中审批改为随申请随审批。开通地方商标受理窗口网上申请权限，增设个人网上申请自助终端，扩展受理商标业务范围。安排人员指导当事人提交网上申请，增加商标业务流程信息查询、商标注册申请受理通知书打印发放等功能，提供商标业务咨询，进一步增强公共服务能力。 |
| 3. Strengthening the guidance and supervision of all trademark examination cooperation centers. The job qualification appraisal of examiners and the supervision and administration of examination quality shall be strengthened, the requirements for periods at each part of the trademark work shall be strictly implemented, and double-random inspection of examiners and content subject to examination shall be realized. The supervision and guidance of the implementation of examination standards and work protocols shall be strengthened, and examination business meetings attended by all trademark examination cooperation centers shall be regularly convened, to jointly research on major problems in trademark examination business and ensure the consistent implementation of examination standards. | | （三）加强对各商标审查协作中心的指导与监管。加强审查人员岗位资格考核和审查质量监督管理，严格落实商标工作各环节的时限要求，实现对审查人员、审查内容的双随机抽检。加强审查标准、工作规程执行的监督指导，定期召开各商标审查协作中心参加的审查业务会议，共同研究商标审查业务重大问题，确保审查标准执行一致。 |
