The Measures for the Administration of the Engineering Consulting Industry, as deliberated and adopted at the executive meeting of the National Development and Reform Commission, are hereby issued, and shall come into force on December 6, 2017. 《工程咨询行业管理办法》已经国家发展和改革委员会主任办公会讨论通过,现予以发布,自2017年12月6日起施行。

ChapterI General Provisions 

第一章 总则

Article 1 For the purposes of strengthening the administration of the engineering consulting industry, standardizing the practicing activities, guaranteeing the engineering consulting service quality, promoting the scientific decision-making and standardized implementation of investment, and giving play to the critical roles of investment in optimizing the supply structure, these Measures are developed in accordance with the Opinions of the CPC Central Committee and the State Council on Deepening the Reform of the Investment and Financing System (No. 18 [2016] of the CPC Central Committee), the Regulation on the Administration of Confirmation and Recordation of Enterprise Investment Projects (Order No. 673 of the State Council), and other relevant laws and regulations.   第一条 为加强对工程咨询行业的管理,规范从业行为,保障工程咨询服务质量,促进投资科学决策、规范实施,发挥投资对优化供给结构的关键性作用,根据《中共中央 国务院关于深化投融资体制改革的意见》(中发〔2016〕18号)、《企业投资项目核准和备案管理条例》(国务院令第673号)及有关法律法规,制定本办法。
Article 2 The term “engineering consulting” refers to the act of providing investors, and government organs with intelligence services relating to phased or whole-process consulting and administration in the decision-making and execution of economic and social development and domestic and overseas investment construction projects by following the principles of independence, justice, and scientificity and comprehensively employing multi-disciplinary knowledge and engineering experience, modern science and technology and management skills.   第二条 工程咨询是遵循独立、公正、科学的原则,综合运用多学科知识、工程实践经验、现代科学和管理方法,在经济社会发展、境内外投资建设项目决策与实施活动中,为投资者和政府部门提供阶段性或全过程咨询和管理的智力服务。
Article 3 The term “engineering consulting entities” refers to independent legal person enterprises and public institutions established within the territory of China and engaged in engineering consulting business.   第三条 工程咨询单位是指在中国境内设立的从事工程咨询业务并具有独立法人资格的企业、事业单位。
The engineering consulting entities and the practitioners shall observe the requirements of the national laws, regulations, and policies, abide by the industrial standards and occupational ethics, and actively participate in and accept the industrial self-discipline management. 工程咨询单位及其从业人员应当遵守国家法律法规和政策要求,恪守行业规范和职业道德,积极参与和接受行业自律管理。
Article 4 The National Development and Reform Commission shall be responsible for guiding and regulating the development of the national engineering consulting industry, formulating the practicing rules and standards of engineering consulting entities, and organizing the supervision and administration of practicing activities of engineering consulting entities and the personnel thereof. The local development and reform commissions at all levels shall be responsible for guiding and regulating the development of the engineering consulting industry within their respective administrative regions and implementing the supervision and administration of practicing activities of engineering consulting entities and the personnel thereof.   第四条 国家发展改革委负责指导和规范全国工程咨询行业发展,制定工程咨询单位从业规则和标准,组织开展对工程咨询单位及其人员执业行为的监督管理。地方各级发展改革部门负责指导和规范本行政区域内工程咨询行业发展,实施对工程咨询单位及其人员执业行为的监督管理。
Article 5 The development and reform commissions at all levels shall provide policy and business guidance for the China National Association of Engineering Consultants (“CNAEC”) and other industrial organizations.   第五条 各级发展改革部门对工程咨询行业协会等行业组织进行政策和业务指导,依法加强监管。
ChapterII Administration of Engineering Consulting Entities 

第二章 工程咨询单位管理

Article 6 The engineering consulting entities shall be subject to the administration of informative recordation. An engineering consulting entity shall record the following information through the National Investment Project Online Approval and Regulation Platform (hereinafter referred to as the “online platform”):   第六条 对工程咨询单位实行告知性备案管理。工程咨询单位应当通过全国投资项目在线审批监管平台(以下简称在线平台)备案以下信息:
(1) basic information, including the business license for an enterprise (certificate of legal person for a public institution), on-the-job personnel and technical force, the number of years for engaging in engineering consulting business, and the contact means; (一)基本情况,包括企业营业执照(事业单位法人证书)、在岗人员及技术力量、从事工程咨询业务年限、联系方式等;
(2) the engineering consulting field in which the engineering consulting entity engages and the scope of services; (二)从事的工程咨询专业和服务范围;
(3) the allocation of professional technicians in the recorded field; and (三)备案专业领域的专业技术人员配备情况;
(4) a brief introduction to non-confidential consulting results. (四)非涉密的咨询成果简介。
The engineering consulting entity shall ensure that the recordation information is true, accurate, and complete. Where there is any change in the recordation information, the engineering consulting entity shall, in a timely manner, inform the public through the online platform. 工程咨询单位应当保证所备案信息真实、准确、完整。备案信息有变化的,工程咨询单位应及时通过在线平台告知。
The basic information on engineering consulting entities shall be publicized by the National Development and Reform Commission through the online platform. 工程咨询单位基本信息由国家发展改革委通过在线平台向社会公布。
Article 7 The engineering consulting business shall be classified according to the following fields:   第七条 工程咨询业务按照以下专业划分:
(1) agriculture and forestry; (一)农业、林业;
(2) water conservancy and hydropower; (二)水利水电;
(3) electric power (including thermal powers, hydropower, nuclear power, and new energy); (三)电力(含火电、水电、核电、新能源);
(4) coal; (四)煤炭;
(5) oil and natural gas; (五)石油天然气;
(6) road; (六)公路;
(7) railway and urban rail transport; (七)铁路、城市轨道交通;
(8) civil aviation; (八)民航;
(9) water transport (including port, river, and harbor projects); (九)水运(含港口河海工程);
(10) electronic and information engineering (including telecommunication, broadcasting and TV, and informatization); (十)电子、信息工程(含通信、广电、信息化);
(11) metallurgy (including steel and non-ferrous metal); (十一)冶金(含钢铁、有色);
(12) petrochemical engineering, chemical engineering, and pharmaceuticals; (十二)石化、化工、医药;
(13) nuclear industry; (十三)核工业;
(14) machinery (including intelligent manufacturing); (十四)机械(含智能制造);
(15) light industry and textile; (十五)轻工、纺织;
(16) construction materials; (十六)建材;
(17) architecture; (十七)建筑;
(18) projects of municipal public utilities; (十八)市政公用工程;
(19) ecological construction and environmental projects; (十九)生态建设和环境工程;
(20) hydrology and geology, engineering measurement, and geo-technical engineering; and (二十)水文地质、工程测量、岩土工程;
(21) others, as the actual fields could be. (二十一)其他(以实际专业为准)。
Article 8 The scope of engineering consulting services includes:   第八条 工程咨询服务范围包括:
(1) planning consulting, including the preparation of the overall plan, special plans, regional plans, and industrial plans; (一)规划咨询:含总体规划、专项规划、区域规划及行业规划的编制;
(2) project consulting, including the preparation of the plans for research on project investment chances, and investment and financing, the project proposals (preliminary feasibility studies), the project feasibility study reports, the project application reports, and the fund application reports, and consulting of Public-Private Partnership (PPP) projects; (二)项目咨询:含项目投资机会研究、投融资策划,项目建议书(预可行性研究)、项目可行性研究报告、项目申请报告、资金申请报告的编制,政府和社会资本合作(PPP)项目咨询等;
(3) appraisal consulting, including the appraisal of the plans, project proposals, feasibility study reports, project application reports, fund application reports, implementation plans for PPP projects, and preliminary designs authorized by the governments at all levels and the relevant departments, the interim and post appraisal of plans and projects, and the examination of rough budgets and final accounts of projects as well as professional technical services required for the performance of investment management functions; (三)评估咨询:各级政府及有关部门委托的对规划、项目建议书、可行性研究报告、项目申请报告、资金申请报告、PPP项目实施方案、初步设计的评估,规划和项目中期评价、后评价,项目概预决算审查,及其他履行投资管理职能所需的专业技术服务;
(4) whole-process engineering consulting, including the continuous provision of partial or integrated solution and administration services for the decision-making, execution, and operation of projects by using multiple service mode combinations. The prices of engineering design, engineering costs, and engineering supervision shall be determined by the relevant competent department of the State Council. (四)全过程工程咨询:采用多种服务方式组合,为项目决策、实施和运营持续提供局部或整体解决方案以及管理服务。有关工程设计、工程造价、工程监理等资格,由国务院有关主管部门认定。
Article 9 The conclusion of a service contract and the launching of the corresponding consulting business by an engineering consulting entity shall be consistent with the recorded field and scope of services.   第九条 工程咨询单位订立服务合同和开展相应的咨询业务,应当与备案的专业和服务范围一致。
Article 10 The engineering consulting entities shall establish a sound consulting quality management system, and establish and carry out the accountability system for personnel in positions including review of documents regarding consulting quality and results.   第十条 工程咨询单位应当建立健全咨询质量管理制度,建立和实行咨询成果质量、成果文件审核等岗位人员责任制。
Article 11 The engineering consulting entity shall conclude a written contract with the client, the contract shall specify the rights and obligations of all parties, and all parties shall jointly abide by the contract. The contract shall specify the ownership of intellectual property rights formed in consulting activities.

   第十一条 工程咨询单位应当和委托方订立书面合同,约定各方权利义务并共同遵守。合同中应明确咨询活动形成的知识产权归属。
