| According to the Administrative Regulations of the People's Republic of China on the Import and Export of Goods and the relevant commitments of China's accession to the WTO, the Ministry of Commerce of the People's Republic of China (the "MOFCOM") has formulated Total Allowable Import Volume and Application Conditions and Procedures of Non-state Trading of Crude Oil in 2018, which are hereby promulgated. | | 根据《中华人民共和国货物进出口管理条例》和我国加入世贸组织的有关承诺，商务部制定了《2018年原油非国营贸易进口允许量总量、申请条件和申请程序》，现予以公布。 |

| I. Allowable import volume of non-state trading of crude oil in 2018 | | 一、2018年原油非国营贸易进口允许量 |
| Allowable import volume of non-state trading of crude oil in 2018 is 142.42 million tons. | | 2018年原油非国营贸易进口允许量为14242万吨。 |
| II. Application Conditions | | 二、申请条件 |
| (I) the enterprises who have crude oil import performance over the past two years or have the qualification for imports of crude oil approved by the competent industrial departments of the State; | | （一）近两年具有原油进口业绩或经国家产业主管部门核准的使用进口原油的资质； |
| (II) the enterprises that have the right to use crude oil terminals with a capacity of not less than 50 thousand tons (or railway ports of transshipment capacity of 2 million tons per year), and the right to use crude oil storage tanks of not less than 200 thousand cubic meters; | | （二）拥有不低于5万吨的原油水运码头（或每年200万吨换装能力的铁路口岸）的使用权，以及库容不低于20万立方米原油储罐的使用权； |
| (III) foreign trade dealers whose bank credit is not less than USD 20 million (or RMB 120 million); | | （三）银行授信不低于2000万美元（或1.2亿人民币）的对外贸易经营者； |
| (IV) enterprises that have professionals being engaged in international oil trade (at least two); | | （四）拥有从事石油国际贸易专业人员（至少2人）； |
| (V) the enterprises that have not involved in smuggling, tax evasion, or arbitrage records or have not been subject to administrative and criminal punishment due to illegal operations in the past 2 years; | | （五）企业无走私、偷逃税、逃汇、套汇记录，近2年内未因违法违规经营受到行政、刑事处罚； |
| (VI) other factors to consider. | | （六）其他需要考虑的因素。 |
| III. Application Materials | | 三、申请材料 |
| The following materials are required for application: | | 申请企业须提交以下材料： |
| (I) application letter. includes the basic situation of the company, description for eligibility for application, application reasons, specific programs with respect to crude oil procurement, production, use or sale, introduction to professionals being engaged in international oil trade and others; | | （一）申请函。包括公司基本情况、符合申请条件的说明、申请原因及有关原油采购、生产使用或销售的具体方案、从事石油国际贸易专业人员简介等； |
(II) copy of the qualified Duplicate of Business License after annual review bearing signature of the legal representative and copies of the Registration Form for Foreign Trade Operators or Qualification Certificate of Import and Export Enterprises or Operation Certificate of Foreign-funded Enterprises bearing seal of archival filing and registration (or the filing receipt obtained based on the Interim Administrative Measures for the Record-filing of the Incorporation and Change of Foreign-funded Enterprises), Registration Certificate of the Consignees and Consignors of Import and Export Goods for Customs Declaration and the Organization Code Certificate;
