| Article 1 For the purposes of regulating auctions, maintaining the auction order, and protecting the lawful rights and interests of all parties to auctions, these Measures are developed in accordance with the Auction Law of the People's Republic of China and other laws and regulations. | | 第一条 为了规范拍卖行为，维护拍卖秩序，保护拍卖活动各方当事人的合法权益，根据《中华人民共和国拍卖法》等法律法规，制定本办法。 |
| Article 2 Auction enterprises, clients, bidders and other parties participating in auctions shall, when engaging in auctions, comply with the relevant laws and regulations and these Measures, and observe the principles of openness, impartiality, fairness and good faith. | | 第二条 拍卖人、委托人、竞买人及其他参与拍卖活动的当事人从事拍卖活动，应当遵守有关法律法规和本办法，遵循公开、公平、公正、诚实信用的原则。 |
| Article 3 An administrative department for industry and commerce shall conduct supervision and administration of auctions in accordance with the Auction Law of the People's Republic of China and other laws and regulations and these Measures, with its main functions including: | | 第三条 工商行政管理部门依照《中华人民共和国拍卖法》等法律法规和本办法对拍卖活动实施监督管理，主要职责是： |
| (1) conducting registration of auction enterprises in accordance with the law; | | （一）依法对拍卖人进行登记注册； |
| (2) supervising and administering auction enterprises, clients, bidders and other parties participating in auctions in accordance with the law; | | （二）依法对拍卖人、委托人、竞买人及其他参与拍卖活动的当事人进行监督管理； |
| (3) investigating and punishing illegal auction sales; and | | （三）依法查处违法拍卖行为； |
| (4) other functions as prescribed by laws, regulations and rules. | | （四）法律法规及规章规定的其他职责。 |
| For the purpose of these Measures, “administrative departments for industry and commerce” include market supervision and administration departments performing the functions of industrial and commercial administration. | | 本办法所称工商行政管理部门，包括履行工商行政管理职责的市场监督管理部门。 |
Article 4 An applicant for the formation of an auction enterprise shall, in accordance with the Auction Law of the People's Republic of China, the Company Law of the People's Republic of China and other laws and regulations, file an application for registration with the administrative department for industry and commerce to obtain a business license, and, upon verification by the department in charge of the auction industry of the people's government of the province, autonomous region, or municipality directly under the Central Government where the enterprise is located, obtain a license for engaging in the auction business.
