| Article 1 In order to regulate and administer the activities of practice of law in the Mainland by Taiwan residents holding the national legal profession qualifications, these Measures are formulated in accordance with the relevant provisions of the Lawyers Law of the People's Republic of China (hereinafter referred to as "the Lawyers Law”) and the Administrative Measures for the Practice of Law by Lawyers. | | 第一条 为规范取得国家法律职业资格的台湾居民在大陆从事律师职业的活动及管理，根据《中华人民共和国律师法》（以下简称《律师法》）及《律师执业管理办法》的有关规定，制定本办法。 |
| Article 2 A Taiwan resident who has passed the National Judicial Examination and acquired the Legal Profession Qualification Certificate of the People's Republic of China may apply for practicing law in the Mainland according to law. | | 第二条 参加国家司法考试合格，取得《中华人民共和国法律职业资格证书》的台湾居民，可以依法在大陆申请律师执业。 |
| To apply for practicing law in the Mainland, a Taiwan resident shall meet other conditions as prescribed by the Lawyers Law. | | 台湾居民在大陆申请律师执业，还应当符合《律师法》规定的其他条件。 |
| Article 3Where a Taiwan resident is approved to practice law in a law firm in the Chinese mainland, he may engage in the non-litigation legal affairs of the Chinese mainland in such manner as serving as a legal advisor, representing a client, providing consulting services, or drafting legal documents for a client, and may handle Taiwan-related civil cases in the manner of representing a client in legal proceedings, and the scope of the said Taiwan-related civil cases shall be specified by the Ministry of Justice in an announcement. | | 第三条 台湾居民获准在大陆律师事务所执业，可以担任法律顾问、代理、咨询、代书等方式从事大陆非诉讼法律事务，也可以担任诉讼代理人的方式代理涉台民事案件，代理涉台民事案件的范围由司法部以公告方式作出规定。 |
| Where a Taiwan resident practices law in a Mainland law firm, he shall abide by the laws, regulations and rules of the state, strictly observe the lawyers' professional ethics and disciplines, and accept the supervision and administration by the justice administrative organs in the Mainland and the professional management by the Mainland lawyers association. | | 台湾居民在大陆律师事务所执业，应当遵守国家法律、法规和规章，恪守律师职业道德和执业纪律，接受大陆司法行政机关的监督和管理，接受大陆律师协会的行业管理。 |
Article 4 Where a Taiwan resident applies for practicing law in the Mainland, he shall intern in a Mainland law firm for one year and pass the assessment of the local lawyers association in accordance with the Lawyers Law, the Administrative Measures for the Practice of Law by Lawyers, and the Rules for the Internship Administration of Those Applying for Practice of Law formulated by the All China Lawyers Association.
