国务院关于完善进出口商品质量安全风险预警和快速反应监管体系切实保护消费者权益的意见

The people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government; all ministries and commissions of the State Council; and all institutions directly under the State Council: 各省、自治区、直辖市人民政府,国务院各部委、各直属机构:
The quality safety of imports and exports is related to the vital interests of the people, border safety and sustainable development of foreign trade and is an important part of realizing a strong quality country. Scientific prevention and effective control of quality safety risks is an important way to strengthen comprehensive quality administration, promote quality improvement and enhance the people's fulfillment, and an important part of the reform of simplification of administrative procedures, delegation of powers, combination of decentralization and control, and optimization of services, and is of great significance for accelerating the link and replacement of momentum and advancing the supply-side structural reform, the quality safety governance system, and modernization of governance capability. Upon constant exploration and practice, China has basically established an imports and exports quality safety risk early warning and quick response regulation system (hereinafter referred to as "quality safety risk early warning and regulation system") and made preliminary achievements, but there are still problems such as limited channels for information collection, inadequate assessment capability, incomplete early warning system, incomplete disposition system, and desired strengthening of joint social governance. The following opinions on further improving the quality safety risk early warning and regulation system and practically protecting consumer rights and interests are hereby offered. 进出口商品质量安全事关人民群众切身利益、国门安全和对外贸易可持续发展,是实现质量强国的重要组成部分。科学预防和有效控制质量安全风险,是加强全面质量管理、促进质量提升、增强人民群众获得感的重要途径,是深化简政放权、放管结合、优化服务改革的重要内容,对加快新旧动能接续转换,推进供给侧结构性改革、质量安全治理体系和治理能力现代化具有重要意义。经过不断探索实践,我国基本建立起进出口商品质量安全风险预警和快速反应监管体系(以下简称质量安全风险预警监管体系)并初具成效,但还存在信息采集渠道有限、评估能力不足、预警制度不健全、处置机制不完善、社会共治有待加强等问题。现就进一步完善质量安全风险预警监管体系、切实保护消费者权益提出以下意见。
I. General requirements   一、总体要求
(1) Guiding ideology. (一)指导思想。
We shall comprehensively implement the spirit of the 18th National Congress of the Communist Party of China ("CPC") and the Third, Fourth, Fifth and Sixth Plenary Sessions of the 18th CPC Central Committee, carry out in depth the spirit of a series of important speeches and new concepts, thoughts and strategies of managing state affairs of General Secretary Xi Jinping, conscientiously implement the decisions and arrangements of the CPC Central Committee and the State Council, advance the overall layout for "economic, political, cultural, social, and ecological progress" in an overall manner and the Four-Pronged Comprehensive Strategy in a coordinated manner, adhere to the development thought centering on the people and the general work keynote of seeking progress while keeping performance stable, firmly develop and implement the new development concept, with risk administration as main thread, with guaranteeing the quality safety of imports and exports and promoting quality improvement as core, and constantly promote the modernization of the quality safety governance system and capability. 全面贯彻党的十八大和十八届三中、四中、五中、六中全会精神,深入贯彻习近平总书记系列重要讲话精神和治国理政新理念新思想新战略,认真落实党中央、国务院决策部署,统筹推进“五位一体”总体布局和协调推进“四个全面”战略布局,坚持以人民为中心的发展思想,坚持稳中求进工作总基调,牢固树立和贯彻落实新发展理念,以风险管理为主线,以保障进出口商品质量安全和促进质量提升为核心,持续推动质量安全治理体系和治理能力现代化。
(2) Basic principles. (二)基本原则。
Orienting on security and strictly holding the bottom line. The overall national security concept shall be implemented, people orientation shall be always adhered to, the vital interests of the people shall be put on top of the agenda, the relationship between quality safety and development shall be correctly handled, no quality safety problems shall be tolerated, and the bottom line of non-occurrence of systematic, regional or industrial quality safety risks shall be held. 安全为本,严守底线。落实总体国家安全观,始终强调以人为本,把人民群众的切身利益放在首位,正确处理质量安全与发展的关系,对质量安全问题“零容忍”,守住不发生系统性、区域性、行业性质量安全风险的底线。
Mainly conducting prevention and combining prevention with control. Quality safety risk prevention shall be always prioritized, measures such as risk monitoring, ex-ante early warning and education and guidance shall be vigorously taken, and a progressive, dimensional prevention system shall be developed to realize earliest discovery, research and judgment, warning and disposition, effective prevention, and systematic tackling of quality safety risks. 预防为主,防控结合。始终把质量安全风险预防工作放在重要位置,积极实施风险监测、预警前置和教育引导等措施,构建递进式、立体化预防体系,实现质量安全风险早发现、早研判、早预警、早处置,有效预防、系统应对。
Leading with innovation and making scientific decisions. Cutting-edge risk management technologies and modern technological means shall be fully used to establish risk management big data platforms and promote "Internet plus regulation," so as to scientifically research on and judge quality safety risks of imports and exports and constantly make risk early warning and quick response decisions more accurate, scientific, effective and authoritative. 创新引领,科学决策。充分利用风险管理前沿技术和现代科技手段,打造风险管理大数据平台,推动“互联网+监管”,科学研判进出口商品质量安全风险,不断提升风险预警和快速反应决策的准确性、科学性、有效性、权威性。
Openness, sharing, joint governance and interaction. Information exchange, mutual admission of regulation, and mutual assistance in law enforcement shall be advanced in depth, the departmental law enforcement cooperation mechanism shall be improved, social resources shall be encouraged to extensively participate, and international cooperation and exchange shall be strengthened, so as to raise the level of joint prevention and control and realize joint social governance and shared development. 开放共享,共治联动。深入推进信息互换、监管互认、执法互助,健全部门间执法协作机制,鼓励社会力量广泛参与,加强国际合作与交流,提升联防联控水平,实现社会共同治理和共享发展。
(3) Objectives. (三)工作目标。
We shall make all efforts, during the "13th Five-Year Plan" period, by improving the quality safety risk early warning and regulation system, to establish a national data-integrating risk information platform, an authoritative risk assessment center, an unimpeded risk information exchange and sharing channel, and an efficient risk early warning and quick response mechanism and to establish and improve an imports and exports quality safety regulation system. Consumer rights and interests and border safety shall be practically protected, and the general public shall be prevented from and protected against injury resulting from quality safety risks, so as to provide quality supply for livelihood guarantees and economic development. Industrial transformation and upgrading and sound development of foreign trade shall be served, risk prevention and control decisions shall be scientifically guided, and technological trade measures shall be used in a precise, timely and effective manner. The deepening of the reform of simplification of administrative procedures, delegation of powers, combination of decentralization and control, and optimization of services shall be adhered to, the decisive role of the market in resource allocation shall be fully exerted, the role of the government shall be effectively exerted, and a steady, fair, transparent, and predictable business environment shall be created. 力争在“十三五”期间,通过完善质量安全风险预警监管体系,建立全国数据集成的风险信息平台、权威的风险评估中心、畅通的风险信息交流共享渠道、高效的风险预警和快速反应机制,建立健全进出口商品质量安全监管制度。切实维护消费者权益和国门安全,预防和保护社会公众免受质量安全风险伤害,为民生保障与经济发展提供高质量供给。服务产业转型升级和外贸健康发展,科学指导风险防控决策,精准、及时、有效运用技术性贸易措施。坚持深化“放管服”改革,充分发挥市场在资源配置中的决定性作用和更好发挥政府作用,营造稳定公平透明可预期的营商环境。
II. Tasks   二、工作任务
(1) Comprehensively strengthening quality safety risk monitoring. (一)全面加强质量安全风险监测。
i. Implementing the risk monitoring plan. A unified national imports and exports quality safety risk monitoring plan shall be developed and issued, risk monitoring from ports to markets shall be organized and conducted, risk factors impacting personal health, property safety, and environmental safety, among others, shall be randomly inspected and tested, quality safety risks, including health, physical, chemical, biological and environmental hazards, shall be systematically and constantly monitored, and quality safety monitoring results shall be issued in accordance with the law. Food safety risks shall be monitored under the Food Safety Law. (The General Administration of Quality Supervision, Inspection and Quarantine shall take the lead, and the Ministry of Agriculture, the National Health and Family Planning Commission, the State Administration for Industry and Commerce, and the China Food and Drug Administration shall be responsible according to the division of duties) 1.实施风险监测计划。制定、发布全国统一的国家进出口商品质量安全风险监测计划,组织开展从口岸到市场的风险监测工作,针对影响人体健康、财产安全、环境安全等风险因素开展抽查检测,系统和持续地监测健康危害、物理危害、化学危害、生物危害、环境危害等质量安全风险,依法发布质量安全监测结果。食品安全风险监测按照食品安全法有关要求执行。(质检总局牵头,农业部、国家卫生计生委、工商总局、食品药品监管总局按职责分工负责)
ii. Expanding risk information collection channels. Mobile Web technologies shall be used to improve consumer complaint and enterprise report channels. The inspection, testing and certification body risk information report system shall be implemented. Universities, scientific research institutes, and industry associations shall be encouraged to voluntarily report information on quality safety risks. The information on public opinions shall be constantly collected. A quality safety injury information and food-borne disease information collection and investigation system shall be established. The collection of information on counterfeit and shoddy products in key fields such as goods markets combining domestic and foreign trade, e-commerce and border trade and in key regions including countries along "Belt and Road" and emerging markets shall be strengthened. International exchange shall be strengthened, and bilateral and multilateral information notification, investigation and cooperation relating to quality safety shall be conducted. (The General Administration of Quality Supervision, Inspection and Quarantine shall take the lead, and the Ministry of Agriculture, the Ministry of Commerce, the National Health and Family Planning Commission, the State Administration for Industry and Commerce, the China Food and Drug Administration, and the Certification and Accreditation Administration shall be responsible according to the division of duties) 2.拓宽风险信息采集渠道。运用移动互联技术,完善消费者投诉和企业报告渠道。实行检验检测认证机构风险信息报告制度。鼓励大专院校、科研院所、行业协会等主动报告质量安全风险信息。持续开展舆情信息收集。建立质量安全伤害信息和食源性疾病信息收集调查制度。加强内外贸结合商品市场、电子商务、边境贸易等重点领域和“一带一路”沿线国家、新兴市场等重点区域的假冒伪劣商品信息搜集工作。加强国际交流,开展双边、多边质量安全信息通报、调查合作。(质检总局牵头,农业部、商务部、国家卫生计生委、工商总局、食品药品监管总局、国家认监委按职责分工负责)
iii. Improving basic guarantees for risk monitoring. The building of a data-integrating national imports and exports quality safety risk information platform shall be accelerated by depending on China's backbone electronic inspection and quarantine system. Oriented on major countries and regions, the geographic advantages of key ports across the country shall be arranged in an overall manner, key industries and emerging business types shall be highlighted, and a group of quality safety risk monitoring stations shall be planned. (The General Administration of Quality Supervision, Inspection and Quarantine shall be responsible) 3.完善风险监测基础保障。依托中国电子检验检疫主干系统,加快建设全国数据集成的进出口商品质量安全风险信息平台。面向主要贸易国家和地区,统筹全国重点口岸区位优势,突出重点产业和新兴业态,规划布局一批质量安全风险监测点。(质检总局负责)
iv. Establishing a risk information sharing and exchange mechanism. The role of international trade "single window" shall be used to collect and share data pertinent to imports and exports. Joint port safety prevention and control shall be strengthened, the connection between the imports and exports quality safety risk information platform and the port risk control deployment centers shall be promoted, and an integrated national risk monitoring data sharing and exchange mechanism shall be established. Cross-department, cross-region, and cross-industry cooperation in injury information notification shall be promoted, and the sharing of information on injury reports relating to goods, food-borne disease, traffic accidents, and fire shall be accelerated. Unsafe factors in product design and manufacturing shall be accurately mastered to provide basis to develop prevention and control measures. (The General Administration of Quality Supervision, Inspection and Quarantine shall take the lead, and the Ministry of Public Security, the Ministry of Agriculture, the Ministry of Commerce, the National Health and Family Planning Commission, the General Administration of Customs, the State Administration for Industry and Commerce, the China Food and Drug Administration, and the National Office of Port Administration shall be responsible according to the division of duties) 4.构建风险信息共享交换机制。发挥国际贸易“单一窗口”作用,采集和共享进出口商品相关数据。加强口岸安全联合防控,推动进出口商品质量安全风险信息平台与口岸风险布控中心对接,构建全国一体化的风险监测数据共享与交换机制。推动跨部门、跨区域、跨行业的伤害信息通报协作,加快实现与商品相关的伤害报告、食源性疾病、交通事故、火灾事故等信息的共享。准确掌握商品设计和制造中的不安全因素,为制定防控措施提供依据。(质检总局牵头,公安部、农业部、商务部、国家卫生计生委、海关总署、工商总局、食品药品监管总局、国家口岸办按职责分工负责)
