| Several Opinions on Establishing a Permanent Resource Environment Carrying Capacity Monitoring and Early Warning Mechanism | | 《关于建立资源环境承载能力监测预警长效机制的若干意见》主要内容如下。 |
| The following opinions are hereby offered for purposes of implementing in depth the strategic arrangements of the CPC Central Committee and the State Council for deepening the ecological civilization system reform, promoting regulated, routine and institutional monitoring and early warning of the carrying capacity of the resource environment, and guiding and restraining all regions in order for them to plan economic and social development according to the carrying capacity of the resource environment. | | 为深入贯彻落实党中央、国务院关于深化生态文明体制改革的战略部署，推动实现资源环境承载能力监测预警规范化、常态化、制度化，引导和约束各地严格按照资源环境承载能力谋划经济社会发展，现提出以下意见。 |
| I. General requirements | | 一、总体要求 |
| (1) Guiding ideology. We shall comprehensively implement the spirit of the 18th CPC National Congress and the Third, Fourth, Fifth and Sixth Plenary Sessions of the 18th CPC Central Committee, follow the guidance of Deng Xiaoping Theory, important thoughts of "Three Represents," and Scientific Outlook on Development, carry out in depth the spirit of a series of important speeches and new concepts, thoughts and strategies of managing state affairs of General Secretary Xi Jinping, conscientiously implement the decisions and arrangements of the CPC Central Committee and the State Council, closely center on advancing the overall layout for "economic, political, cultural, social, and ecological progress" in an overall manner and the Four-Pronged Comprehensive Strategy in a coordinated manner, firmly develop and implement the new development concept, unswervingly implement main functional area strategy and system, establish a permanent resource environment carrying capacity monitoring and early warning mechanism featuring complete means, shared data, real time and efficiency, powerful control, and multi-party synergism, effectively regulate the order of space development, reasonably control the intensity of space development, practically restrict various development activities to the extent of the carrying capacity of the resource environment, and lay a solid foundation for establishing a pattern of efficient, coordinated, and sustainable land space development. | | （一）指导思想。全面贯彻党的十八大和十八届三中、四中、五中、六中全会精神，以邓小平理论、“三个代表”重要思想、科学发展观为指导，深入贯彻习近平总书记系列重要讲话精神和治国理政新理念新思想新战略，认真落实党中央、国务院决策部署，紧紧围绕统筹推进“五位一体”总体布局和协调推进“四个全面”战略布局，牢固树立和贯彻落实新发展理念，坚定不移实施主体功能区战略和制度，建立手段完备、数据共享、实时高效、管控有力、多方协同的资源环境承载能力监测预警长效机制，有效规范空间开发秩序，合理控制空间开发强度，切实将各类开发活动限制在资源环境承载能力之内，为构建高效协调可持续的国土空间开发格局奠定坚实基础。 |

| -- Adhering to the combination of regular assessment and real-time monitoring. Based on the conditions of the carrying capacity of the resource environment in different regions, assessment shall be regularly made across the country or in particular regions, and the trends in key regions shall be instantaneously monitored to raise the efficiency of monitoring and early warning. | | --坚持定期评估与实时监测相结合。针对不同区域资源环境承载能力状况，定期开展全域和特定区域评估，实时监测重点区域动态，提高监测预警效率。 |

Based on different carrying capability overload types of the resource environment, the overall arrangements for land and sea shall be adhered to, and a differentiated, operable control system shall be developed according to local conditions, so as to restrict regions with deteriorating resource environment, stimulate regions with improved resource environment, and raise the level of monitoring and early warning. | | --坚持从严管制与有效激励相结合。针对不同资源环境超载类型，坚持陆海统筹，因地制宜制定差异化、可操作的管控制度，既限制资源环境恶化地区，又激励资源环境改善地区，提高监测预警水平。 |
| -- Adhering to the combination of government supervision and social supervision. The combination of centralization and decentralization, interactions between upper and lower levels, and overall advancement shall be adhered to, the government's supervision capability shall be enhanced, all social sectors shall be encouraged to vigorously participate, and the role of social supervision shall be fully used, so as to join forces of monitoring and early warning. | | --坚持政府监管与社会监督相结合。坚持统分结合、上下联动、整体推进，强化政府监管能力，鼓励社会各方积极参与，充分发挥社会监督作用，形成监测预警合力。 |
| II. Control mechanisms | | 二、管控机制 |
| (3) Comprehensive supporting measures. The carrying capacity of the resource environment shall be marked by three grades: overload, critical overload, and non-overload; according to whether the damage to resource environment deteriorates or eases, more specifically, overload is marked by two early warning grades: red and orange, critical overload is marked by two early warning grades: yellow and blue, and non-overload is marked by early warning grade: green; and the early warning grades rank in a descending order as follows: red, orange, yellow, blue and green. | | （三）综合配套措施。资源环境承载能力分为超载、临界超载、不超载三个等级，根据资源环境耗损加剧与趋缓程度，进一步将超载等级分为红色和橙色两个预警等级、临界超载等级分为黄色和蓝色两个预警等级、不超载等级确定为绿色无警等级，预警等级从高到低依次为红色、橙色、黄色、蓝色、绿色。 |
| Comprehensive reward or punishment measures shall be taken correspondingly against or for regions of red early warning grade, or of green early warning grade, or whose early warning grade changes. A region whose grade changes from critical overload to overload shall be handled by reference to the comprehensive supporting measures against regions of red early warning grade; a region whose grade changes from non-overload to critical overload shall be handled by reference to single-item control measures regarding water resources, land resources, the environment, ecology, or sea areas, among others, in overloaded regions, as the case may be, or, when necessary, by reference to the comprehensive supporting measures against regions of red early warning grade; and a region whose grade changes from overload to critical overload, or from critical overload to non-overload, is entitled to rewarding measures according to specific circumstances. | | 对红色预警区、绿色无警区以及资源环境承载能力预警等级降低或者提高的地区，分别实行对应的综合奖惩措施。对从临界超载恶化为超载的地区，参照红色预警区综合配套措施进行处理；对从不超载恶化为临界超载的地区，参照超载地区水资源、土地资源、环境、生态、海域等单项管控措施酌情进行处理，必要时可参照红色预警区综合配套措施进行处理；对从超载转变为临界超载或者从临界超载转变为不超载的地区，实施不同程度的奖励性措施。 |
In a region of red early warning grade, the strictest limited regional approval shall be implemented in relation to overloading factors, the approval formalities for new construction, reconstruction and construction expansion projects shall be suspended by law, time tables for the quitting of industries causing the overload shall be specified, and urban construction land shall shrink; an existing enterprise that seriously damages the carrying capacity of the resource environment, or damages ecological resources by illegally discharging pollution, shall be restricted in production, or halt production to take corrective measures, by law, be subject to severe punitive measures according to the laws and regulations, such as fine, ordering business halt, shutdown, and transferring relevant persons liable for administrative detention, and, if criminally punishable, be held criminally liable; persons in charge of government departments ineffectively exercising regulation and relevant persons liable shall be subject to administrative action or held criminally liable, according to the seriousness of the circumstances; an official who causes serious damage and is liable in the aspect of the ecological environment and resources shall be admonished, ordered to apologize publicly, handled by the organization or be subject to action by party or government discipline, rather than promoted or transferred to a significant post; and the local government shall make an action plan for systematically easing overload degree according to the overloading factors and have the red early warning grade degraded within a given time.
．．．．．． | | 对红色预警区，针对超载因素实施最严格的区域限批，依法暂停办理相关行业领域新建、改建、扩建项目审批手续，明确导致超载产业退出的时间表，实行城镇建设用地减量化；对现有严重破坏资源环境承载能力、违法排污破坏生态资源的企业，依法限制生产、停产整顿，并依法依规采取罚款、责令停业、关闭以及将相关责任人移送行政拘留等措施从严惩处，构成犯罪的依法追究刑事责任；对监管不力的政府部门负责人及相关责任人，根据情节轻重实施行政处分直至追究刑事责任；对在生态环境和资源方面造成严重破坏负有责任的干部，不得提拔使用或者转任重要职务，视情况给予诫勉、责令公开道歉、组织处理或者党纪政纪处分；当地政府要根据超载因素制定系统性减缓超载程度的行动方案，限期退出红色预警区。
