| Announcement on Clarifying the Administrative Licensing Items concerning Workplaces under Customs Supervision | | 关于明确海关监管作业场所行政许可事项的公告 |
| In accordance with the relevant provisions of the Administrative License Law of the People's Republic of China, the Measures of the Customs of the People's Republic of China for Implementing the Administrative License Law of the People's Republic of China and the Interim Measures of the People's Republic of China for the Administration of Customs Supervision Zones, the relevant administrative licensing items concerning workplaces under customs supervision are hereby announced as follows: | | 根据《中华人民共和国行政许可法》、《中华人民共和国海关实施〈中华人民共和国行政许可法〉办法》和《中华人民共和国海关监管区管理暂行办法》有关规定，现将海关监管作业场所行政许可有关事项公告如下： |
| I. The conditions that shall be satisfied and the materials that need to be submitted by an enterprise that applies for operating a workplace under customs supervision shall be governed by the relevant provisions of Articles 14 and 15 of the Interim Measures of the People's Republic of China for the Administration of Customs Supervision Zones (Application Form for the Registration of an Enterprise Operating a Workplace under Customs Supervision, Annex 1). | | 一、申请经营海关监管作业场所的企业（以下称申请人）应当具备的条件以及需要提交的材料，按照《中华人民共和国海关监管区管理暂行办法》第十四条和第十五条有关规定执行（《经营海关监管作业场所企业注册申请书》，附件1）。 |
| II. Applicants shall assume the legal liabilities for the authenticity, legality and validity of the materials they submit. Where the competent customs offices may obtain the electronic texts of the relevant materials through the information technology systems, the applicants are not required to submit them separately. | | 二、申请人应当对所提交材料的真实性、合法性、有效性承担法律责任。主管海关可以通过信息化系统获取有关材料电子文本的，申请人无需另行提交。 |
| III. The competent customs offices shall conduct the field verification of whether the workplaces under customs supervision the applicants apply for operating comply with the Norms for Setting the Workplaces under Customs Supervision (developed and announced separately by the General Administration of Customs). | | 三、主管海关应当对申请经营的海关监管作业场所是否符合《海关监管作业场所设置规范》（由海关总署另行制定并公告）进行实地验核。 |
IV. Where an applicant is found to meet the registration conditions upon examination, the competent customs office shall make and issue the Registration Certificate of the XX Customs of the People's Republic of China for an Enterprise Operating a Workplace under Customs Supervision (hereinafter referred to as the “Registration Certificate,” Annex 2).
