The Interim Measures of the People's Republic of China for the Administration of Areas under Customs Supervision, as deliberated and adopted at the executive meeting of the General Administration of Customs (“GAC”) on December 27, 2016, are hereby issued, and shall come into force on November 1, 2017. The Measures of the Customs of the People's Republic of China for the Administration of Places under Customs Supervision issued by Order No. 171 of the GAC on January 30, 2008 and Article 6 of the Decision of the General Administration of Customs on Amending Some Rules issued by Order No. 227 of the GAC on April 27, 2015 shall be repealed concurrently. 《中华人民共和国海关监管区管理暂行办法》已于2016年12月27日经海关总署署务会议审议通过,现予公布,自2017年11月1日起施行。2008年1月30日海关总署令第171号发布的《中华人民共和国海关监管场所管理办法》、2015年4月27日海关总署令第227号公布的《海关总署关于修改部分规章的决定》》第六条同时废止。

Interim Measures of the People's Republic of China for the Administration of Areas under Customs Supervision 中华人民共和国海关监管区管理暂行办法
Chapter I General Provisions 

第一章 总 则

 
Article 1 For the purpose of regulating the administration of areas under customs supervision, these Measures are developed in accordance with the provisions of the Customs Law of the People's Republic of China and other relevant laws and administrative regulations.   第一条 为了规范海关监管区的管理,根据《中华人民共和国海关法》以及其他有关法律、行政法规的规定,制定本办法。
Article 2 For the purpose of these Measures, the “areas under customs supervision” means the places and sites prescribed in Article 100 of the Customs Law of the People's Republic of China where the customs office conducts the supervision and administration of transport vehicles, goods and articles that enter or leave China, including the areas under special customs supervision, bonded places under customs supervision, workplaces under customs supervision, duty-free shops and other places and sites with the businesses under customs supervision.   第二条 本办法所称海关监管区,是指《中华人民共和国海关法》第一百条所规定的海关对进出境运输工具、货物、物品实施监督管理的场所和地点,包括海关特殊监管区域、保税监管场所、海关监管作业场所、免税商店以及其他有海关监管业务的场所和地点。
For the purpose of these Measures, “workplaces under customs supervision” means the places that are operated and managed by enterprises, used for the entry, exit and berth of transport vehicles that enter or leave China or transport vehicles within China that carry goods under customs supervision, and the relevant business activities such as the entry, exit, loading, unloading, storage, consolidation and temporary storage of goods under customs supervision, comply with the Standards for the Setup of Workplaces under Customs Supervision (hereinafter referred to as the “Rules for the Setup of Workplaces”), and for the handling of relevant customs formalities. 本办法所称海关监管作业场所,是指由企业负责经营管理,供进出境运输工具或者境内承运海关监管货物的运输工具进出、停靠,从事海关监管货物的进出、装卸、储存、集拼、暂时存放等有关经营活动,符合《海关监管作业场所设置规范》(以下简称《场所设置规范》),办理相关海关手续的场所。
The Rules for the Setup of Workplaces shall be otherwise developed and announced by the GAC. 《场所设置规范》由海关总署另行制定并公告。
Article 3 These Measures shall apply to the customs' administration of the areas under the supervision of the customs office.   第三条 本办法适用于海关对海关监管区的管理。
Where the rules of the customs office have separate provisions on the administration of the areas under special customs supervision, bonded places under customs supervision and duty-free shops, such provisions shall apply. 海关规章对海关特殊监管区域、保税监管场所、免税商店的管理另有规定的,从其规定。
Article 4 Citizens, legal persons and other organizations that conduct the businesses approved in accordance with the law within the areas under customs supervision shall conduct the relevant businesses according to the requirements of relevant competent departments.   第四条 公民、法人和其他组织在海关监管区内开展依法应当经过批准的业务的,应当按照相关主管部门的要求开展有关业务。
Article 5 The custom offices' implementation of these Measures shall not affect any other department's performance of corresponding functions.   第五条 海关实施本办法的规定不妨碍其他部门履行其相应职责。
Chapter II Administration of Areas under Customs Supervision 

第二章 海关监管区的管理

 
Article 6 An area under customs supervision shall set up the infrastructure, inspection and check facilities and corresponding supervision equipment in compliance with the customs' regulatory requirements.   第六条 海关监管区应当设置符合海关监管要求的基础设施、检查查验设施以及相应的监管设备。
Article 7 The customs office shall, in accordance with the provisions of the Customs Law of the People's Republic of China, exercise such powers as inspecting and checking transport vehicles, goods and articles that enter or leave China within the area under customs supervision.   第七条 海关依照《中华人民共和国海关法》的规定,对海关监管区内进出境运输工具、货物、物品行使检查、查验等权力。
