Constitution of the World Health Organization 世界卫生组织组织法

THE STATES parties to this Constitution declare, in conformity with the Charter of the United Nations, that the following principles are basic to the happiness, harmonious relations and security of all peoples:
 
本组织法的签字国以联合国宪章为依据,宣告下列各项原则为各国人民幸福、和睦与安全的基础。

Health is a state of complete physical, mental and social well-being and not merely the absence of disease or infirmity.
 
健康是身体、精神与社会的全部的美满状态,不仅是免病或残弱。

The enjoyment of the highest attainable standard of health is one of the fundamental rights of every human being without distinction of race, religion, political belief, economic or social condition.
 
享受可能获得的最高健康标准是每个人的基本权利之一,不因种族、宗教政治信仰、经济及社会条件而有区别。

The health of all peoples is fundamental to the attainment of peace and security and is dependent upon the fullest cooperation of individuals and States.

The achievement of any State in the promotion and protection of health is of value to all.
 
任何国家在增进和维护健康方面的成就都是对全人类有价值的。

Unequal development in different countries in the promotion of health and control of disease, especially communicable disease, is a common danger.

Healthy development of the child is of basic importance; the ability to live harmoniously in a changing total environment is essential to such development.

The extension to all peoples of the benefits of medical, psychological and related knowledge is essential to the fullest attainment of health.

Informed opinion and active cooperation on the part of the public are of the utmost importance in the improvement of the health of the people.
 
群众的正确意见与积极合作对于增进人民的健康至关重要。

Governments have a responsibility for the health of their peoples which can be fulfilled only by the provision of adequate health and social measures.
 
各国政府对人民健康负有一定的责任,唯有采取充分的卫生与社会措施。

ACCEPTING THESE PRINCIPLES, and for the purpose of cooperation among themselves and with others to promote and protect the health of all peoples, the contracting parties agree to the present Constitution, and hereby establish the World Health Organization as a specialized agency within the terms of Article 57 of the Charter of the United Nations.
 
各签字国接受上述原则,并为达成相互间及与其他机构的合作,以增进和维护各国人民的健康起见,同意本组织法,并依照联合国宪章第五十七条,作为一个专门机构,成立世界卫生组织。

 
Chapter I: Objective 第一章目的

 
Article 1 第一条

The objective of the World Health Organization (hereafter called the Organization) shall be the attainment by all peoples of the highest possible level of health.
 
世界卫生组织(以下简称“本组织”)的目的是使全世界人民获得可能达到的最高的健康水平。

 
Chapter II: Functions 第二章任务

 
Article 2 第二条

In order to achieve its objective, the functions of the Organization shall be:
 
为达到其目的,本组织的任务应为:

 
(a) to act as the directing and coordinating authority on international health work; 1.担任国际卫生工作的指导与协调主权。

 
(b) to establish and maintain effective collaboration with the United Nations, specialized agencies, governmental health administrations, professional groups and such other organizations as may be deemed appropriate; 2.与联合国、专门机构、各国政府卫生行政主管,各学术或职业团体、及其所认为适当的其他组织建立并维持有效的关系。

 
(c) to assist governments, upon request, in strengthening health services; 3.根据申请,协助各国政府加强卫生业务。

 
(d) to furnish appropriate technical assistance and, in emergencies, necessary aid upon the request or acceptance of governments; 4.根据各国政府申请,或愿予接受的情况下,提供适当的技术援助,并在紧急情况下给予必要的救济。

 
(e) to provide or assist in providing, upon the request of the United Nations, health services and facilities to special groups, such as the peoples of trust territories; 5.根据联合国申请,对特殊组合,例如联合国托管区人民,提供或协助提供卫生业务与设备。

 
(f) to establish and maintain such administrative and technical services as may be required, including epidemiological and statistical services; 6.在需要时,设置并维持行政与技术业务,包括流行病学及统计业务。

 
(g) to stimulate and advance work to eradicate epidemic, endemic and other diseases; 7.促成并推进消灭流行病、地方病、及其他疾病的工作。

 
(h) to promote, in cooperation with other specialized agencies where necessary, the prevention of accidental injuries; 8.必要时,与其他专门机构合作,加强防止意外创伤事故。

 
(i) to promote, in cooperation with other specialized agencies where necessary, the improvement of nutrition, housing, sanitation, recreation, economic or working conditions and other aspects of environmental hygiene; 9.必要时,与其他专门机构合作,促成增进营养、住宅建设、环境卫生、文娱、经济或工作的条件、以及其他环境方面的保健工作。

 
(j) to promote cooperation among scientific and professional groups which contribute to the advancement of health; 10.促成致力于增进健康的科学与职业团体间的合作。

 
(k) to propose conventions, agreements and regulations, and make recommendations with respect to international health matters and to perform such duties as may be assigned thereby to the Organization and are consistent with its objective; 11.提议国际公约、协定与规章的签订及对其他国际卫生事态,提出建议并执行由此授予与本组织目的相一致的各项任务。

 
(l) to promote maternal and child health and welfare and to foster the ability to live harmoniously in a changing total environment; 12.促进妇幼卫生及福利,并培育其在不断变化的总环境中具有融洽生活的能力。

 
(m) to foster activities in the field of mental health, especially those affecting the harmony of human relations; 13.促进在精神卫生方面的活动,特别是影响人类的和睦关系的活动。

 
(n) to promote and conduct research in the field of health; 14.促进并执行卫生研究工作。

 
(o) to promote improved standards of teaching and training in health, medical and related professions; 15.促进医学、卫生及其有关专业方面的教学与培训标准的改进。

 
(p) to study and report on, in cooperation with other specialized agencies where necessary, administrative and social techniques affecting public health and medical care from preventive and curative points of view, including hospital services and social security; 16.从预防与治疗的观点出发,必要时同其他专门机构合作,对各项足以影响公共卫生与医疗保健的行政管理及社会设施的技术,包括医院业务及社会安全方面进行研究并提出报告。

 
(q) to provide information, counsel and assistance in the field of health; 17.提供卫生领域的情报,咨询及协助。

 
(r) to assist in developing an informed public opinion among all peoples on matters of health; 18.协助培养各国人民对于卫生问题的正确舆论。

 
(s) to establish and revise as necessary international nomenclatures of diseases, of causes of death and of public health practices; 19.根据需要,制定并修订有关疾病、死因、及公共卫生实施方面的国际定名。

 
(t) to standardize diagnostic procedures as necessary; 20.按需要,规定诊断程序标准。

 
(u) to develop, establish and promote international standards with respect to food, biological, pharmaceutical and similar products; 21.发展、建立、并促进食品、生物制品、药物、及其他类似制品的国际标准。

 
(v) generally to take all necessary action to attain the objective of the Organization. 22.总之,采取各种必要措施,达到本组织的目的。

 
Chapter III: Membership and Associate Membership 第三章会员与准会员

 
Article 3 第三条

Membership in the Organization shall be open to all States.
 
所有国家均有资格参加本组织为会员。

 
Article 4 第四条

Members of the United Nations may become Members of the Organization by signing or otherwise accepting this Constitution in accordance with the provisions of Chapter XIX and in accordance with their constitutional processes.
 
联合国各会员,按本组织第十九章规定,并依照各该国立法程序签署或以其他方式接受本组织法者,均得为本组织会员。

 
Article 5 第五条

The States whose governments have been invited to send observers to the International Health Conference held in New York, 1946, may become Members by signing or otherwise accepting this Constitution in accordance with the provisions of Chapter XIX and in accordance with their constitutional processes provided that such signature or acceptance shall be completed before the first session of the Health Assembly.
 
应邀派遣观察员出席一九四六年在纽约召开的国际卫生会议的各国政府,在本组织首届卫生大会召开前根据本组织法第十九章规定并依各该国立法程序签署或以其他方式接受本组织法者,均得为本组织会员。

 
Article 6 第六条

Subject to the conditions of any agreement between the United Nations and the Organization, approved pursuant to Chapter XVI, States which do not become Members in accordance with Articles 4 and 5 may apply to become Members and shall be admitted as Members when their application has been approved by a simple majority vote of the Health Assembly.
 
在不违背本组织根据组织法第十六章规定与联合国所达成的任何协议的情况下,凡未能依照本组织法第四、五两条规定参加为会员者,均可申请为会员,经卫生大会以过半数通过即可为本组织会员。

 
Article 7 第七条

If a Member fails to meet its financial obligations to the Organization or in other exceptional circumstances the Health Assembly may, on such conditions as it thinks proper, suspend the voting privileges and services to which a Member is entitled. The Health Assembly shall have the authority to restore such voting privileges and services.
 
会员不能履行承担本组织会费的义务或有其他特殊情况时,卫生大会在其认为适当的情况下,可停止该会员的表决权及会员所应得的受益与权利。但卫生大会也有权恢复该会员的表决权与受益权。

 
Article 8 第八条

Territories or groups of territories which are not responsible for the conduct of their international relations may be admitted as Associate Members by the Health Assembly upon application made on behalf of such territory or group of territories by the Member or other authority having responsibility for their international relations. Representatives of Associate Members to the Health Assembly should be qualified by their technical competence in the field of health and should be chosen from the native population. The nature and extent of the rights and obligations of Associate Members shall be determined by the Health Assembly.
 
不能自行负责处理国际关系的领土或领土群,经负责对该领土或领土群国际关系的会员国或政府当局代为申请,并经卫生大会通过,得为本组织准会员。出席卫生大会的准会员代表,应具有卫生技术方面的能力,并应由该领土或领土群的本地人中选出代表。准会员权利与义务的性质及其范围由卫生大会决定。

 
Chapter IV: Organs 第四章机构

 
Article 9 第九条

The work of the Organization shall be carried out by:

(a) The World Health Assembly (hereinafter called the Health Assembly); 1.世界卫生大会(以下简称卫生大会);

 
(b) The Executive Board (hereinafter called the Board); 2.执行委员会(以下简称执委会);

 
(c) The Secretariat. 3.秘书处。

 
Chapter V: the World Health Assembly 第五章世界卫生大会

 
Article 10 第十条

The Health Assembly shall be composed of delegates representing Members.
 
卫生大会由各会员的代表组成。

 
Article 11 第十一条

Each Member shall be represented by not more than three delegates, one of whom shall be designated by the Member as chief delegate. These delegates should be chosen from among persons most qualified by their technical competence in the field of health, preferably representing the national health administration of the Member.
 
各会员的代表最多不得超过三人。其中一人应由会员指定为首席代表。这些代表应就卫生领域内技术能力最强的人员中选拔,并以能代表该会员的国家卫生行政部门为合宜。

 
Article 12 第十二条

Alternatives and advisers may accompany delegates.
 
副代表及顾问可随同代表出席。

 
Article 13 第十三条

The Health Assembly shall meet in regular annual session and in such special sessions as may be necessary. Special sessions shall be convened at the request of the Board or of a majority of the Members.
 
卫生大会每年举行一次例会,必要时得召开特别会议。特别会议应在执委会或多数会员的要求下召开。

 
Article 14 第十四条

The Health Assembly, at each annual session, shall select the country or region in which the next annual session shall be held, the Board subsequently fixing the place. The Board shall determine the place where a special session shall be held.
 
卫生大会在每年例会中应选定下届例会在某一国家或地区举行,具体开会地点由执委会最后决定。每次特别会议的召开地点亦由执委会决定。

 
Article 15 第十五条

The Board, after consultation with the Secretary-General of the United Nations, shall determine the date of each annual and special session.
 
执委会经与联合国秘书长商洽后,决定每届年度例会及特别会议的召开日期。

 
Article 16 第十六条

The Health Assembly shall elect its President and other officers at the beginning of each annual session. They shall hold office until their successors are elected.
 
卫生大会于每届年度例会开始时应选出主席及其他职员,其任期至继任人被选出时为止。

 
Article 17 第十七条

The Health Assembly shall adopt its own rules of procedure.
 
卫生大会应自行制定议事规程。

 
Article 18 第十八条

The functions of the Health Assembly shall be:
 
卫生大会的任务如下:

 
(a) to determine the policies of the Organization; 1.决定本组织的政策。

 
(b) to name the Members entitled to designate a person to serve on the Board; 2.选定派遣代表参加执委会的会员。

 
(c) to appoint the Director-General; 3.任命总干事。

 
(d) to review and approve reports and activities of the Board and of the Director-General and to instruct the Board in regard to matters upon which action, study, investigation or report may be considered desirable; 4.审查执委会与总干事的工作报告及业务活动,并指示执委会关于应需采取行动、调查研究或报告的事项。

 
(e) to establish such committees as may be considered necessary for the work of the Organization; 5.设置本组织工作所必需的各种委员会。

 
(f) to supervise the financial policies of the Organization and to review and approve the budget; 6.监督本组织的财务政策,并审查和通过预算。

 
(g) to instruct the Board and the Director-General to bring to the attention of Members and of international organizations, governmental or non-governmental, any matter with regard to health which the Health Assembly may consider appropriate; 7.指示执委会及总干事,就卫生大会认为适当的任何卫生事项,提请各会员、各政府或非政府的国际组织给予注意。

 
(h) to invite any organization, international or national, governmental or non-governmental, which has responsibilities related to those of the Organization, to appoint representatives to participate, without right of vote, in its meetings or in those of the committees and conferences convened under its authority, on conditions prescribed by the Health Assembly; but in the case of national organizations, invitations shall be issued only with the consent of the government concerned; 8.邀请与本组织职责有关的任何国际的或全国性的组织,政府的或非政府的组织派遣代表,在卫生大会所指定的条件下,参加卫生大会、委员会、或由卫生大会召开的会议,但无表决权。至于全国性的组织,须经有关政府同意后始得邀请。

 
(i) to consider recommendations bearing on health made by the General Assembly, the Economic and Social Council, the Security Council or Trusteeship Council of the United Nations, and to report to them on the steps taken by the Organization to give effect to such recommendations; 9.考虑联合国大会、经济及社会理事会、安全理事会或托管理事会所提出的有关卫生问题的建议,并向其报告本组织就上项建议所采取的步骤。

 
(j) to report to the Economic and Social Council in accordance with any agreement between the Organization and the United Nations; 10.根据本组织与联合国的协定,向经济及社会理事会提出报告。

 
(k) to promote and conduct research in the field of health by the personnel of the Organization, by the establishment of its own institutions or by cooperation with official or non-official institutions of any Member with the consent of its government;
