The Provisions on Collective Contracts were adopted at the 7th executive meeting of the Ministry of Labor and Social Security, which are hereby promulgated and shall be implemented as of May 1, 2004.
 
《集体合同规定》已于2003年12月30日经劳动和社会保障部第7次部务会议通过,现予公布,自2004年5月1日起施行。

Chapter I. General Provisions 

第一章 总则


 
Article 1 In order to regulate the acts of conducting collective negotiations and the signing of collective contracts, to protect the legitimate rights and interests of the workers and the employing entities, the present Provisions are formulated in accordance with the Labor Law of the People's Republic of China and the Trade Union Law of the People's Republic of China.   第一条 为规范集体协商和签订集体合同行为,依法维护劳动者和用人单位的合法权益,根据《中华人民共和国劳动法》和《中华人民共和国工会法》,制定本规定。

 
Article 2 The present Provisions shall be applicable to the enterprises and the public institutions implementing enterprise-management within the territory of China (hereinafter referred to as the employing entities) that conduct collective negotiations and conclude collective contracts with their respective employees.   第二条 中华人民共和国境内的企业和实行企业化管理的事业单位(以下统称用人单位)与本单位职工之间进行集体协商,签订集体合同,适用本规定。

 
Article 3 The term "collective contract" as mentioned in the present Provisions refers to the written agreement concluded between an employing entity and the workers of this entity on matters relating to labor remuneration, working time, rest and vacations, occupational safety and health, professional training and insurance and welfare through collective negotiation in accordance with laws, regulations and rules. The term "special collective contract" as mentioned in the present Provisions refers to the special written agreement concluded between an employing entity and the workers of this entity on a specific matter in accordance with the laws, regulations and rules.   第三条 本规定所称集体合同,是指用人单位与本单位职工根据法律、法规、规章的规定,就劳动报酬、工作时间、休息休假、劳动安全卫生、职业培训、保险福利等事项,通过集体协商签订的书面协议;所称专项集体合同,是指用人单位与本单位职工根据法律、法规、规章的规定,就集体协商的某项内容签订的专项书面协议。

 
Article 4 When signing a collective contract or special collective contract and determining the related matters, the employing entity and the workers of this entity shall adopt the way of collective negotiation. The collective negotiations shall be mainly in the form of negotiation meeting.   第四条 用人单位与本单位职工签订集体合同或专项集体合同,以及确定相关事宜,应当采取集体协商的方式。集体协商主要采取协商会议的形式。

 
Article 5 When conducting a collective negotiation or signing a collective contract or special collective contract, the parties concerned shall abide by the following principles:   第五条 进行集体协商,签订集体合同或专项集体合同,应当遵循下列原则:

 
(1) Abiding by the laws, regulations and rules and the relevant provisions of the state; (一)遵守法律、法规、规章及国家有关规定;

 
(2) Respecting mutually, negotiating equally; (二)相互尊重,平等协商;

 
(3) Keeping good faith, conducting fair cooperation; (三)诚实守信,公平合作;

 
(4) Taking into consideration the legitimate rights and interests of both parties; and (四)兼顾双方合法权益;

 
(5) Not taking extreme actions. (五)不得采取过激行为。

 
Article 6 A collective contract or special collective contract shall have legal binding force on the employing entity and all the employees of this entity.   第六条 符合本规定的集体合同或专项集体合同,对用人单位和本单位的全体职工具有法律约束力。

The standards for working conditions and labor remuneration as stipulated in the labor contract signed by an employing entity and an employee shall not be lower than those in the collective contract or special collective contract.
 
用人单位与职工个人签订的劳动合同约定的劳动条件和劳动报酬等标准,不得低于集体合同或专项集体合同的规定。

 
Article 7 The administrative departments of labor and social security at (above) the level of county shall, according to their respective administrative area, conduct supervision over the information on the collective negotiations, the signing and fulfillment of collective contracts of the employing entities and their respective employees, and shall be responsible for the examination of the collective contracts or special collective contracts.   第七条 县级以上劳动保障行政部门对本行政区域内用人单位与本单位职工开展集体协商、签订、履行集体合同的情况进行监督,并负责审查集体合同或专项集体合同。

 
Chapter II. Content of Collective Negotiation 

第二章 集体协商内容


 
Article 8 Both parties to the collective negotiation may conduct collective negotiation on some or one of the following matters, to sign a collective contract or special collective contract:   第八条 集体协商双方可以就下列多项或某项内容进行集体协商,签订集体合同或专项集体合同:

 
(1) Labor remuneration; (一)劳动报酬;

 
(2) Working time; (二)工作时间;

 
(3) Rest and vacations; (三)休息休假;

 
(4) Occupational safety and health; (四)劳动安全与卫生;

 
(5) Additional insurance and welfare; (五)补充保险和福利;

 
(6) Special protection for female employees and minors; (六)女职工和未成年工特殊保护;

 
(7) Trainings of professional skills; (七)职业技能培训;

 
(8) Management of labor contracts; (八)劳动合同管理;

 
(9) Rewards and punishments; (九)奖惩;

 
(10) Staff reduction; (十)裁员;

 
(11) The term of collective contract; (十一)集体合同期限;

 
(12) Procedures for modifying or canceling the collective contract; (十二)变更、解除集体合同的程序;

 
(13) Settlement of disputes, which arise in fulfilling the collective contract, through negotiation; (十三)履行集体合同发生争议时的协商处理办法;

 
(14) Liabilities for breach of collective contract; and (十四)违反集体合同的责任;

 
(15) Other matters agreed on by both parties through negotiation. (十五)双方认为应当协商的其他内容。

 
Article 9 The labor remuneration shall mainly cover:   第九条 劳动报酬主要包括:

 
(1) the level of wages, the wage distribution system, the wage standards and the wage distribution method of an employing entity; (一)用人单位工资水平、工资分配制度、工资标准和工资分配形式;

 
(2) the measures for wage payments; (二)工资支付办法;

 
(3) the overtime wages and the standards on allowances or subsidies and the measures for the distribution of premium; (三)加班、加点工资及津贴、补贴标准和奖金分配办法;

 
(4) the measures for the adjustment of wages; (四)工资调整办法;

 
(5) the wages and treatments during the probation period, the medical leave or family leave; (五)试用期及病、事假等期间的工资待遇;

 
(6) the measures for paying the wages (subsistence allowance) to the employees under special circumstances; and (六)特殊情况下职工工资(生活费)支付办法;

 
(7) measures for distributing other labor remunerations. (七)其他劳动报酬分配办法。

 
Article 10 The working time shall mainly cover:   第十条 工作时间主要包括:

 
(1) the system of working hours; (一)工时制度;

 
(2) the measures for overtime work; (二)加班加点办法;

 
(3) the working time for special jobs; and (三)特殊工种的工作时间;

 
(4) the standard for labor quota (四)劳动定额标准。

 
Article 11 The rest and vocations shall mainly include:   第十一条 休息休假主要包括:

 
(1) the measures for the daily rest time, weekly rest days arrangement and annual vocations; (一)日休息时间、周休息日安排、年休假办法;

 
(2) the rest time and vocations for the employees who are unable to implement the standard working time; and (二)不能实行标准工时职工的休息休假;

 
(3) other vocations. (三)其他假期。

 
Article 12 The occupational safety and health shall mainly cover:   第十二条 劳动安全卫生主要包括:

 
(1) the occupational safety and health responsibility system; (一)劳动安全卫生责任制;

 
(2) the working conditions and safety technologies and measures; (二)劳动条件和安全技术措施;

 
(3) the procedures for safe operations; (三)安全操作规程;

 
(4) the standard for distributing labor protection appliances; and (四)劳保用品发放标准;

 
(5) regular health examinations and occupation health examinations. (五)定期健康检查和职业健康体检。

 
Article 13 The additional insurances and welfares shall mainly include:   第十三条 补充保险和福利主要包括:

 
(1) the types and scopes of the additional insurances; (一)补充保险的种类、范围;

 
(2) the basic welfare system and welfare facilities; (二)基本福利制度和福利设施;

 
(3) the extension of medical leave and the treatments; and (三)医疗期延长及其待遇;

 
(4) the welfare system regarding the relatives of the employees. (四)职工亲属福利制度。

 
Article 14 The special protection of female employees and minors shall mainly include:   第十四条 女职工和未成年工的特殊保护主要包括:

 
(1) the types of work that shall not be assigned to female employees and minors; (一)女职工和未成年工禁忌从事的劳动;

 
(2) the labor protection for female employees during their periods of catamenia, pregnancy, confinement and breast feeding; (二)女职工的经期、孕期、产期和哺乳期的劳动保护;

 
(3) the regular health examination for female employees and minors; and (三)女职工、未成年工定期健康检查;

 
(4) the employment and registration of minors. (四)未成年工的使用和登记制度。

 
Article 15 The training of professional skills shall mainly include:   第十五条 职业技能培训主要包括:

 
(1) the planning on the training of professional skills and the annual plan; (一)职业技能培训项目规划及年度计划;

 
(2) the withholding and use of fees for the training of professional skills; and (二)职业技能培训费用的提取和使用;

 
(3) the measures for guaranteeing and perfecting the training of professional skills. (三)保障和改善职业技能培训的措施。

 
Article 16 The management of labor contracts shall mainly include:   第十六条 劳动合同管理主要包括:

 
(1) the date a labor contract is concluded; (一)劳动合同签订时间;

 
(2) the conditions for determining the duration of a labor contract; (二)确定劳动合同期限的条件;

 
(3) the general principle for modifying, canceling and renewing a labor contract, and the conditions for terminating a labor contract without fixed time period; and (三)劳动合同变更、解除、续订的一般原则及无固定期限劳动合同的终止条件;

 
(4) the conditions and time period for the probation. (四)试用期的条件和期限。

 
Article 17 The rewards and punishments shall mainly include:   第十七条 奖惩主要包括:

 
(1) the labor disciplines; (一)劳动纪律;

 
(2) the performance evaluation reward and punishment system; and (二)考核奖惩制度;

 
(3) the reward and punishment procedures; (三)奖惩程序。

 
Article 18 The staff reduction shall mainly include:   第十八条 裁员主要包括:

 
(1) the program on staff reduction; (一)裁员的方案;

 
(2) the procedures for staff reduction; and (二)裁员的程序;

 
(3) the implementing measures for staff reduction and the compensation standards; (三)裁员的实施办法和补偿标准。

 
Chapter III. The Representatives of Collective Negotiation 

第三章 集体协商代表


 
Article 19 The term "the representatives of collective negotiation" (hereinafter referred to as representatives) as mentioned in the present Provisions refers to the people who appear according to the legal procedures and are entitled to participate in the collective negotiation on behalf of the interests of their own party.
