The Provisions of the Supreme People's Court on the Trial Procedure for State Compensation Cases of the Compensation Committees of the People's Courts, as adopted at the 1513th session of the Judicial Committee of the Supreme People's Court on February 28, 2011, are hereby issued and shall come into force on March 22, 2011.
 
最高人民法院《关于人民法院赔偿委员会审理国家赔偿案件程序的规定》已于2011年2月28日由最高人民法院审判委员会第1513次会议通过,现予公布,自2011年3月22日施行。

最高人民法院关于人民法院赔偿委员会审理国家赔偿案件程序的规定

(No. 6 [2011] of the Supreme People's Court)

According to the State Compensation Law of the People's Republic of China (hereinafter referred to as the “State Compensation Law”) as amended on April 29, 2010, the following provisions on the trial procedure for state compensation cases of the compensation committees of the people's courts (hereinafter referred to as the “compensation committees”) are made in light of the actualities of the state compensation work:
 
根据2010年4月29日修正的《中华人民共和国国家赔偿法》(以下简称国家赔偿法),结合国家赔偿工作实际,对人民法院赔偿委员会(以下简称赔偿委员会)审理国家赔偿案件的程序作如下规定:

 
Article 1 A compensation claimant shall, when applying for a compensation decision to the compensation committee, submit an application form for compensation in quadruplicate. Where a compensation claimant really has difficulty in completing the application form, he may make an oral application. In case of an oral application, the people's court shall fill out a Registration Form for Compensation Application, to which the compensation claimant shall affix his signature or seal.   第一条 赔偿请求人向赔偿委员会申请作出赔偿决定,应当递交赔偿申请书一式四份。赔偿请求人书写申请书确有困难的,可以口头申请。口头提出申请的,人民法院应当填写《申请赔偿登记表》,由赔偿请求人签名或者盖章。

 
Article 2 A compensation claimant shall, when applying for a compensation decision to the compensation committee, provide the following legal instruments and certification materials:   第二条 赔偿请求人向赔偿委员会申请作出赔偿决定,应当提供以下法律文书和证明材料:

 
1. A written decision made by the organ liable for compensation; (一)赔偿义务机关作出的决定书;

 
2. A written reconsideration decision made by the reconsideration organ, except when the people's court is the organ liable for compensation; (二)复议机关作出的复议决定书,但赔偿义务机关是人民法院的除外;

 
3. A receipt of application for compensation issued by the organ liable for compensation and other relevant certification materials, if the organ liable for compensation or the reconsideration organ fails to make a decision within the prescribed time limit; (三)赔偿义务机关或者复议机关逾期未作出决定的,应当提供赔偿义务机关对赔偿申请的收讫凭证等相关证明材料;

 
4. The legal instruments made by the organs performing the criminal investigation, prosecution and trial functions in the criminal, civil, administrative and execution procedures of the case involved in the application for compensation; (四)行使侦查、检察、审判职权的机关在赔偿申请所涉案件的刑事诉讼程序、民事诉讼程序、行政诉讼程序、执行程序中作出的法律文书;

 
5. The materials proving that the official acts of the organ liable for compensation have infringed upon the legitimate rights of and caused damage to the compensation claimant; and (五)赔偿义务机关职权行为侵犯赔偿请求人合法权益造成损害的证明材料;

 
6. Other materials proving that the application for compensation meets the application conditions. (六)证明赔偿申请符合申请条件的其他材料。

 
Article 3 The compensation committee shall, after receiving an application for compensation, docket it within 7 days if deeming that the application meets the application conditions after examination, and notify the compensation claimant, the organ liable for compensation and the reconsideration organ; or decide not to accept it within 7 days, if deeming that the application does not meet the application conditions. The compensation committee shall decide to dismiss the application, if finding that the application does not meet the application conditions after docketing it.   第三条 赔偿委员会收到赔偿申请,经审查认为符合申请条件的,应当在七日内立案,并通知赔偿请求人、赔偿义务机关和复议机关;认为不符合申请条件的,应当在七日内决定不予受理;立案后发现不符合申请条件的,决定驳回申请。

The time limit prescribed in the preceding paragraph shall be calculated from the date on which the compensation committee receives the application for compensation. If the application materials are incomplete, the compensation committee shall notify the compensation claimant of all necessary supplements and corrections at the same time within 5 days, and the time of receiving the application for compensation shall be calculated from the date on which the compensation committee receives such supplements and corrections.
 
前款规定的期限,自赔偿委员会收到赔偿申请之日起计算。申请材料不齐全的,赔偿委员会应当在五日内一次性告知赔偿请求人需要补正的全部内容,收到赔偿申请的时间应当自赔偿委员会收到补正材料之日起计算。

 
Article 4 The compensation committee shall, within 5 days after docketing an application for compensation, serve a copy of the application form for compensation or a copy of the Registration Form for Compensation Application on the organ liable for compensation and the reconsideration organ.   第四条 赔偿委员会应当在立案之日起五日内将赔偿申请书副本或者《申请赔偿登记表》副本送达赔偿义务机关和复议机关。

 
Article 5 A compensation claimant may authorize one or two persons as his agent(s). A lawyer, a close relative of the citizen who applies for compensation, a person recommended by the relevant social group or his work unit, or any other citizen permitted by the compensation committee may serve as an agent upon authorization.   第五条 赔偿请求人可以委托一至二人作为代理人。律师、提出申请的公民的近亲属、有关的社会团体或者所在单位推荐的人、经赔偿委员会许可的其他公民,都可以被委托为代理人。

The organ liable for compensation or the reconsideration organ may authorize one or two of its personnel as agent(s).
 
赔偿义务机关、复议机关可以委托本机关工作人员一至二人作为代理人。

 
Article 6 Where a compensation claimant, the organ liable for compensation or the reconsideration organ has an agent, a power of attorney signed or sealed by the principal shall be submitted to the compensation committee.   第六条 赔偿请求人、赔偿义务机关、复议机关委托他人代理,应当向赔偿委员会提交由委托人签名或者盖章的授权委托书。

The power of attorney shall state the matters and powers delegated to the agent. The agent shall have a special authorization from the principal when accepting, relinquishing or modifying the compensation claim.
 
授权委托书应当载明委托事项和权限。代理人代为承认、放弃、变更赔偿请求,应当有委托人的特别授权。

 
Article 7 The compensation committee shall, when hearing a compensation case, designate a judge to be responsible for the specific handling of the case.   第七条 赔偿委员会审理赔偿案件,应当指定一名审判员负责具体承办。

The judge responsible for the specific handling of a compensation case shall find out the truth, produce a trial report, and submit it to the compensation committee for deliberation and decision.
