The Several Provisions of the Supreme People's Court on the Execution of Property-oriented Penalties have been adopted at the 1478th session of the Judicial Committee of the Supreme People's Court on November 30, 2009. They are hereby promulgated and shall come into force on June 1, 2010. | |

These Provisions are formulated in accordance with the Criminal Law of the People's Republic of China,the Criminal Procedure Law of the People's Republic of China | |
为完善财产刑的执行制度，规范财产刑的执行工作，依照《中华人民共和国刑法》、《中华人民共和国刑事诉讼法》等法律规定，制定本规定。 |

| Article 1 Property-oriented penalties shall be executed by the organ of the people's court of the first instance, which is in charge of the execution of judgments. | | 第一条 财产刑由第一审人民法院负责裁判执行的机构执行。 |
If the property subject to execution is located at another place, the people's court of the first instance may entrust the people's court at the same level at the place where the property is located to execute the penalty on its behalf. | |
被执行的财产在异地的，第一审人民法院可以委托财产所在地的同级人民法院代为执行。 |

| Article 2 The people's court of the first instance shall file and execute the legal document on the execution of property-oriented penalties after the criminal judgment or ruling made by it comes into force or after it receives the effective criminal judgment or ruling made by the people's court at a higher level. | | 第二条 第一审人民法院应当在本院作出的刑事判决、裁定生效后，或者收到上级人民法院生效的刑事判决、裁定后，对有关财产刑执行的法律文书立案执行。 |

| Article 3 With regard to the execution of fines, where the enforcee fails to pay in full amount within the time limit specified in the judgment or ruling, the people's court shall subject the enforcee to compulsory payment upon the expiration of that time limit. | | 第三条 对罚金的执行，被执行人在判决、裁定确定的期限内未足额缴纳的，人民法院应当在期满后强制缴纳。 |
The people's court shall immediately execute the confiscation of property in the case of a penalty of confiscation. | |
对没收财产的执行，人民法院应当立即执行。 |

Article 4 The people's court shall investigate the state of properties of the enforcee pursuant to law and shall timely adopt enforcement measures such as sealing up, distraining, freezing, etc. where it finds that the enforcee has property for execution and therefore it is necessary to seal it up, distrain or freeze it.
