| Article 1 These Provisions are developed according to the Decision of the CPC Central Committee on Deepening the Reform of the Party and State Institutions and the Plan on Deepening the Reform of the Party and State Institutions, as deliberated and adopted at the Third Plenary Session of the 19th CPC Central Committee, and the State Council Institutional Reform Proposal as approved at the First Session of the Thirteenth National People's Congress. | | 第一条 根据党的十九届三中全会审议通过的《中共中央关于深化党和国家机构改革的决定》、《深化党和国家机构改革方案》和第十三届全国人民代表大会第一次会议批准的《国务院机构改革方案》，制定本规定。 |
| Article 2 The General Administration of Customs is an institution directly under the State Council at the ministerial level. | | 第二条 海关总署是国务院直属机构，为正部级。 |
| Article 3 The General Administration of Customs shall implement the guidelines, policies, decisions and arrangements of the CPC Central Committee relating to customs work and adhere to and strengthen centralized and unified party leadership over customs work in the course of performing its duties, which mainly include the following: | | 第三条 海关总署贯彻落实党中央关于海关工作的方针政策和决策部署，在履行职责过程中坚持和加强党对海关工作的集中统一领导。主要职责是： |
| (1) It shall be responsible for the customs work nationwide. It shall draft policies for customs (including entry and exit inspection and quarantine, similarly hereinafter) work, work out relevant draft laws and regulations, and develop customs plans, departmental rules, and relevant technical specifications. | | （一）负责全国海关工作。拟订海关（含出入境检验检疫，下同）工作政策，起草相关法律法规草案，制定海关规划、部门规章、相关技术规范。 |
| (2) It shall be responsible for organizing and promoting "efficient clearance" building at ports. It shall develop rules and systems for the administration of ports in conjunction with relevant authorities, organize the working out and coordinate the execution of port development plans, take the lead in working out joint prevention and control work rules for port safety, and coordinate port-related information collection as well as the analysis, judgment and disposal of risk. It shall coordinate the working relationships among various departments in clearance at ports and guide and coordinate the port work of local governments. | | （二）负责组织推动口岸“大通关”建设。会同有关部门制定口岸管理规章制度，组织拟订口岸发展规划并协调实施，牵头拟订口岸安全联合防控工作制度，协调开展口岸相关情报收集、风险分析研判和处置工作。协调口岸通关中各部门的工作关系，指导和协调地方政府口岸工作。 |
| (3) It shall be responsible for customs supervision. It shall develop and organize the implementation of supervisory systems for inbound and outbound conveyances, goods and articles. It shall undertake the work relating to technical trade measures as provided. It shall implement policies for the administration of import and export trade as legally required, be responsible for customs protection of intellectual property rights, and be responsible for the management of customs marks and signs. It shall organize the implementation of anti-terrorism, stability maintenance, non-proliferation, export control, and other work under customs jurisdiction. It shall formulate and organize the implementation of customs supervision system for bonded business, such as processing trade, and take the lead in reviewing the establishment and adjustment of areas under special customs supervision. | | （三）负责海关监管工作。制定进出境运输工具、货物和物品的监管制度并组织实施。按规定承担技术性贸易措施相关工作。依法执行进出口贸易管理政策，负责知识产权海关保护工作，负责海关标志标识管理。组织实施海关管理环节的反恐、维稳、防扩散、出口管制等工作。制定加工贸易等保税业务的海关监管制度并组织实施，牵头审核海关特殊监管区域的设立和调整。 |
| (4) It shall be responsible for the administration of collection of import and export tariffs and other taxes and fees. It shall work out a collection administration system and develop and organize the implementation and interpretation of a classification catalog of import and export commodities. It shall take the lead in negotiating bilateral and multilateral rules of origin, work out rules of origin for import and export commodities, and be responsible for the organization and implementation of certification administration as legally required. It shall implement anti-dumping and countervailing measures, guarantee measures, and other tariff measures in accordance with the law. | | （四）负责进出口关税及其他税费征收管理。拟订征管制度，制定进出口商品分类目录并组织实施和解释。牵头开展多双边原产地规则对外谈判，拟订进出口商品原产地规则并依法负责签证管理等组织实施工作。依法执行反倾销和反补贴措施、保障措施及其他关税措施。 |
| (5) It shall be responsible for entry and exit health quarantine and the inspection and quarantine of inbound and outbound animals and plants and animal and plant products. It shall collect and analyze the information on overseas epidemics, organize the implementation of port disposal measures, and undertake the work related to public health emergencies and other emergencies at ports | | （五）负责出入境卫生检疫、出入境动植物及其产品检验检疫。收集分析境外疫情，组织实施口岸处置措施，承担口岸突发公共卫生等应急事件的相关工作。 |
| (6) It shall be responsible for the legal inspection of import and export commodities. It shall supervise and administer the appraisal, verification, and quality safety of import and export commodities. It shall be responsible for the inspection and quarantine as well as supervision and administration of food and cosmetics imports and conduct food export-related work in accordance with bilateral and multilateral agreements. | | （六）负责进出口商品法定检验。监督管理进出口商品鉴定、验证、质量安全等。负责进口食品、化妆品检验检疫和监督管理，依据多双边协议实施出口食品相关工作。 |
| (7) It shall be responsible for customs risk management. It shall organize customs trade investigations, market research, and risk monitoring and establish a risk assessment indicator system, risk monitoring, early warning and tracking system, and risk management, prevention and control mechanism. It shall implement customs credit management and be responsible for customs audit. | | （七）负责海关风险管理。组织海关贸易调查、市场调查和风险监测，建立风险评估指标体系、风险监测预警和跟踪制度、风险管理防控机制。实施海关信用管理，负责海关稽查。 |
| (8) It shall be responsible for customs statistics for the country's trade in import and export goods, among others. It shall release customs statistical information and customs statistics, organize dynamic monitoring and assessment, and establish an information public service platform serving import and export enterprises. | | （八）负责国家进出口货物贸易等海关统计。发布海关统计信息和海关统计数据，组织开展动态监测、评估，建立服务进出口企业的信息公共服务平台。 |
| (9) It shall be responsible for the national anti-smuggling coordination. It shall investigate and deal with smuggling and violation cases according to the law, be responsible for the investigation, detention, execution of arrests, and pre-trial in smuggling crime cases under its jurisdiction, and organize the implementation of customs anti-smuggling work. | | （九）负责全国打击走私综合治理工作。依法查处走私、违规案件，负责所管辖走私犯罪案件的侦查、拘留、执行逮捕、预审工作，组织实施海关缉私工作。 |
| (10) It shall be responsible for formulating and organizing the implementation of customs science and technology development plans as well as laboratory construction and technical support plans. It shall organize relevant scientific research and technology introduction. | | （十）负责制定并组织实施海关科技发展规划、实验室建设和技术保障规划。组织相关科研和技术引进工作。 |
| (11) It shall be responsible for international cooperation and exchanges in the customs field. It shall join relevant international organizations and enter into and implement relevant international cooperation accords, agreements and protocols on behalf of the country. | | （十一）负责海关领域国际合作与交流。代表国家参加有关国际组织，签署并执行有关国际合作协定、协议和议定书。 |

| (a) Strengthening supervision and strictly ensuring border security. With risk management as the main line, the establishment of a risk management, prevention and control mechanism gathering risk information, unifying analysis and judgment, and centralizing command and disposition shall be accelerated, the scope of supervision shall be expanded from the clearance link at ports to the whole chain and extensive fields of entry and exit, a shift in supervisory mode from separate operations to integration and intensiveness shall be made, and the intelligence and precision of supervision shall be further improved, so as to effectively protect economic security and resolutely prevent foreign garbage, smuggled ivory, and other goods and articles that endanger ecological safety and people's health, as well as infectious diseases and pests, among others, from entering the country. | | 1.加强监管严守国门安全。以风险管理为主线，加快建立风险信息集聚、统一分析研判和集中指挥处置的风险管理防控机制，监管范围从口岸通关环节向出入境全链条、宽领域拓展延伸，监管方式从分别作业向整体集约转变，进一步提高监管的智能化和精准度，切实保障经济安全，坚决将洋垃圾、走私象牙等危害生态安全和人民健康的货物物品以及传染病、病虫害等拒于国门之外。 |
(b) Simplifying administrative procedures and decentralizing powers to promote trade facilitation. The contents of customs operations shall be consolidated, items subject to approval shall be further reduced, interim operational links and procedures shall be cut, "integrating examination with inspection and quarantine" shall be advanced, and "integrating multiple inspections" shall be expanded, so as to optimize clearance procedures and reduce clearance time. Various government service resources and data shall be consolidated, and the advancement of international trade "single window" shall be accelerated, so as to enable enterprises to "complete all formalities by logging in at one time." The construction of "Internet plus Customs" shall be accelerated so that clearance materials are accessible across the country once filed in one place and susceptible of sharing and use by one submission. The construction of an information public service platform serving import and export enterprises shall be accelerated to collect and reorganize import and export product access standards, technical regulations, and customs supervision policies and measures, among others, of all countries, so as to provide convenient inquiry, consultation, and other services for import and export enterprises and realize free or low-cost access to information.
