The Interpretation of the Supreme People's Court on Several Issues concerning the Application of Law in the Trial of Criminal Cases of Refusing to Satisfy a Judgment or Ruling, as adopted at the 1657th meeting of the Judicial Committee of the Supreme People's Court on July 6, 2015, is hereby issued and shall come into force on July 22, 2015. 《最高人民法院关于审理拒不执行判决、裁定刑事案件适用法律若干问题的解释》已于2015年7月6日由最高人民法院审判委员会第1657次会议通过,现予公布,自2015年7月22日起施行。

Interpretation of the Supreme People's Court on Several Issues concerning the Application of Law in the Trial of Criminal Cases of Refusing to Satisfy a Judgment or Ruling 最高人民法院关于审理拒不执行判决、裁定刑事案件适用法律若干问题的解释
(Interpretation No. 16 [2015] of the Supreme People's Court, adopted at the 1657th meeting of the Judicial Committee of the Supreme People's Court on July 6, 2015) (2015年7月6日最高人民法院审判委员会第1657次会议通过 法释〔2015〕16号)
In order to punish criminal activities of refusing to satisfy a judgment or ruling in accordance with the law, guarantee the legal enforcement of judgments and rulings rendered by the people's courts, and effectively safeguard the lawful rights and interests of the parties, in accordance with the provisions of the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China, the Civil Procedure Law of the People's Republic of China and other laws, the interpretation on several issues concerning the application of law in the trial of criminal cases of refusing to satisfy a judgment or ruling is hereby issued as follows: 为依法惩治拒不执行判决、裁定犯罪,确保人民法院判决、裁定依法执行,切实维护当事人合法权益,根据《中华人民共和国刑法》《中华人民共和国刑事诉讼法》《中华人民共和国民事诉讼法》等法律规定,就审理拒不执行判决、裁定刑事案件适用法律若干问题,解释如下:
Article 1 Where a person subject to enforcement, a person obligated to assist in enforcement, a guarantor or any other person liable for enforcement has the capacity to satisfy the judgment or ruling rendered by a people's court but refuse to do so, and the circumstances are serious, he or she shall be convicted and punished for committing the crime of refusing to satisfy a judgment or ruling in accordance with Article 313 of the Criminal Law.   第一条 被执行人、协助执行义务人、担保人等负有执行义务的人对人民法院的判决、裁定有能力执行而拒不执行,情节严重的,应当依照刑法三百一十三条的规定,以拒不执行判决、裁定罪处罚。
Article 2 Where a person obligated to assist in enforcement has the capacity to satisfy a judgment or ruling but commits any of the following acts, he or she shall be deemed as being under “other serious circumstances of having the capacity to satisfy a judgment or ruling but refusing to do so” as prescribed in the Interpretation of the Standing Committee of the National People's Congress on Article 313 of the Criminal Law:

   第二条 负有执行义务的人有能力执行而实施下列行为之一的,应当认定为全国人民代表大会常务委员会关于刑法三百一十三条的解释中规定的“其他有能力执行而拒不执行,情节严重的情形”:
