The people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government; all ministries and commissions of the State Council; and all institutions directly under the State Council: 各省、自治区、直辖市人民政府,国务院各部委、各直属机构:
In recent years, all localities and all departments have kept intensifying work efforts, and environmental supervision and law enforcement have made some achievements. However, there remain some very prominent problems, such as inadequate and ineffective supervision and law enforcement, in certain localities, and cases on violations of environmental laws and regulations occurred frequently, which have been greatly concerned about by people. To implement the sprits of the Fourth Plenary Session of the 18th CPC Central Committee, and the relevant decisions and arrangements of the CPC Central Committee and the State Council, accelerate the resolution of the prominent environmental problems which impact scientific development and impair the public health, and focus on promoting the improvement of environmental quality, with the approval of the State Council, you are hereby notified of the relevant requirements for strengthening environmental supervision and law enforcement as follows: 近年来,各地区、各部门不断加大工作力度,环境监管执法工作取得一定成效。但一些地方监管执法不到位等问题仍然十分突出,环境违法违规案件高发频发,人民群众反映强烈。为贯彻落实党的十八届四中全会精神和党中央、国务院有关决策部署,加快解决影响科学发展和损害群众健康的突出环境问题,着力推进环境质量改善,经国务院同意,现就加强环境监管执法有关要求通知如下:
I. Protecting environment in strict accordance with the law, and promoting the full coverage of supervision and law enforcement   一、严格依法保护环境,推动监管执法全覆盖
Effectively resolving the problems ofimperfect and incompletelaws and regulations as well as omission of law enforcement. Environmental supervision laws and regulations shall be improved; territorial responsibilities shall be implemented; and all kinds of environmental pollution, ecological disruption and environmental risk problems shall be checked out and rectified in a comprehensive manner, so as to leave no dead angle or blind area in regulation, and declare war to pollution. 有效解决环境法律法规不健全、监管执法缺位问题。完善环境监管法律法规,落实属地责任,全面排查整改各类污染环境、破坏生态和环境隐患问题,不留监管死角、不存执法盲区,向污染宣战。
(1) Accelerating the improvement of environmental laws, regulations and standards. Ecological environment shall be protected under strict legal system; no time may be wasted in the formulation (revision) of laws and regulations in soil environment protection, air pollution prevention and control, environmental impact assessment, pollutant discharging license, environmental monitoring and other aspects; producers' legal liabilities for environmental protection shall be reinforced; and costs for violations of laws shall be significantly raised. The improvement of environmental standards for heavy metals, volatile organic compounds, hazardous wastes, persistent organic pollutants, radioactive contaminants and other fields shall be accelerated, and environmentalaccessthresholds for key industries shall be raised. All localities shall be encouraged to, according to environmental quality objectives, formulate and implement local regulations andstricter standards for pollutant discharges. Industrial transfers shall be constrained and economic restructuring and upgrading shall be forced through the implementation of environmental projection laws and regulations. (一)加快完善环境法律法规标准。用严格的法律制度保护生态环境,抓紧制(修)订土壤环境保护、大气污染防治、环境影响评价、排污许可、环境监测等方面的法律法规,强化生产者环境保护的法律责任,大幅度提高违法成本。加快完善重金属、挥发性有机物、危险废物、持久性有机污染物、放射性污染物质等领域环境标准,提高重点行业环境准入门槛。鼓励各地根据环境质量目标,制定和实施地方性法规和更严格的污染物排放标准。通过落实环保法律法规,约束产业转移行为,倒逼经济转型升级。
(2) Implementing in a comprehensive manner the linkage between administrative law enforcement and criminal justice. The environmental protection departments and public security organs at all levels shall establish the systems for joint law enforcementandjoint meeting, permanent liaison, and the supervision of the handling of major cases, among others, improve case transfer, joint investigation, information sharing and reward and punishment mechanisms, and resolutely overcome the phenomena of“failure to transfer cases,” “difficulty in transferring cases,” and “substitution of fines for criminal punishments,” so as to achieve the seamless connection between administrative punishments and criminal punishments. The transfer and filing of cases shall be subject to the legal supervision of people's procuratorates. When major environmental pollution incidents or other emergencies occur, the joint investigation procedures shall be initiated promptly to prevent the loss of evidence. Public security organs shall designate institutions and personnel to take charge of investigating and punishing environmental crimes, and open cases for investigation of any suspected environmental crimes in a timely manner in accordance with the law. Where the people's courts need environmental protection technical assistance during the trials of environmental resource cases, the environmental protection departments at all levels shall give the necessary support thereto. (二)全面实施行政执法与刑事司法联动。各级环境保护部门和公安机关要建立联动执法联席会议、常设联络员和重大案件会商督办等制度,完善案件移送、联合调查、信息共享和奖惩机制,坚决克服有案不移、有案难移、以罚代刑现象,实现行政处罚和刑事处罚无缝衔接。移送和立案工作要接受人民检察院法律监督。发生重大环境污染事件等紧急情况时,要迅速启动联合调查程序,防止证据灭失。公安机关要明确机构和人员负责查处环境犯罪,对涉嫌构成环境犯罪的,要及时依法立案侦查。人民法院在审理环境资源案件中,需要环境保护技术协助的,各级环境保护部门应给予必要支持。
(3) Wasting no time in conducting the large-scale inspection on environmental protection. Prior to the end of 2015, the local governments at all levels shall organize the implementation of a comprehensive check on environmental protection; put focus on inspecting the pollutant discharges of all pollutant discharging entities, the impacts of the development and utilization of various resources on ecological environment, the environmental impact assessment system for construction projects, and the system of “Three Simultaneity (i.e. pollution prevention and control facilities of construction projects are designed, constructed and put into production and use simultaneously with the principal parts of the projects),” among others; and shall severely investigate, handle and rectify existing problems in accordance with the law, and report the relevant results to the people's governments at the next higher levels, and make them open to the public. Environmental protection and other relevant departments shall strengthen supervision, inspection and guidance, establish the mechanism for regular work scheduling, organize random checks of the inspections in all localities, and report important information to the State Council in a timely manner. (三)抓紧开展环境保护大检查。2015年底前,地方各级人民政府要组织开展一次环境保护全面排查,重点检查所有排污单位污染排放状况,各类资源开发利用活动对生态环境影响情况,以及建设项目环境影响评价制度、“三同时”(防治污染设施与主体工程同时设计、同时施工、同时投产使用)制度执行情况等,依法严肃查处、整改存在的问题,结果向上一级人民政府报告,并向社会公开。环境保护部等有关部门要加强督促、检查和指导,建立定期调度工作机制,组织对各地检查情况进行抽查,重要情况及时报告国务院。
(4) Placing emphasis on strengthening environmental supervision. A people's government at the city or county levelshall divide its administrative region into several environmental supervisory grids, specify persons in charge of supervision on a one-by-one basis, and implement supervisory schemes; and the supervisory grid division schemes shall be reported prior to the end of 2015 to the people's government at the next higher level for recordation, and be made open to the public. A people's government at the provincial, city or county level shall determine the key objects subject to supervision, divide regulation levels, improve supervisory files, and take differentiated supervisory measures; and a people's government at the township level or a sub-district office shall assist in effectively conducting the relevant work. All provincial environmental protection departments shall strengthentour inspections, and conduct random inspections on enterprises subject to intensive monitoring and control of the stateat certain proportions each year, and guide the people's governments at the city and county levels in implementing the gird regulatory measures. The environmental protection departments at the city and county levels shall assume the routine environmental supervision and law enforcement responsibilities, and strengthen onsite and random inspections. Local governments of key regions and valley areas under environmental protection shall reinforce collaborative supervision, and conduct joint law enforcement, regional law enforcement and cross law enforcement.

 (四)着力强化环境监管。各市、县级人民政府要将本行政区域划分为若干环境监管网格,逐一明确监管责任人,落实监管方案;监管网格划分方案要于2015年底前报上一级人民政府备案,并向社会公开。各省、市、县级人民政府要确定重点监管对象,划分监管等级,健全监管档案,采取差别化监管措施;乡镇人民政府、街道办事处要协助做好相关工作。各省级环境保护部门要加强巡查,每年按一定比例对国家重点监控企业进行抽查,指导市、县级人民政府落实网格化管理措施。市、县两级环境保护部门承担日常环境监管执法责任,要加大现场检查、随机抽查力度。环境保护重点区域、流域地方政府要强化协同监管,开展联合执法、区域执法和交叉执法。
