Guiding Opinions of the Ministry of Transport, the Publicity Department of the CPC Central Committee, the Office of the Central Leading Group for Cyberspace Affairs, the National Development and Reform Commission, the Ministry of Industry and Information Technology, the Ministry of Public Security, the Ministry of Housing and Urban-Rural Development, the People's Bank of China, the General Administration of Quality Supervision, Inspection and Quarantine, and the China National Tourism Administration on Encouraging and Regulating the Development of Internet Bicycle Rental

The people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government; all ministries and commissions of the State Council; and all institutions directly under the State Council: 各省、自治区、直辖市人民政府,国务院各部委、各直属机构:
Internet bicycle rental (popularly known as "bicycle sharing") is a new service mode resulting from the integrated development of the mobile Web and bicycle rental and a typical business type of the sharing economy. Over recent years, China's internet bicycle rental has developed quickly, played a positive role in better satisfying the demand of the general public for commuting, effectively solving the "last mile" issue in urban commuting, easing urban traffic jams and developing a green commuting system, and vigorously promote the development of the sharing economy. However, there are problems such as disorderly parking, ineffective operation and maintenance of bicycles, non-implementation of the primary responsibility of enterprises, and user money and information security risks. The following guiding opinions are hereby offered with the approval of the State Council for purposes of encouraging and regulating the development of internet bicycle rental. 互联网租赁自行车(俗称“共享单车”)是移动互联网和租赁自行车融合发展的新型服务模式,是分享经济的典型业态。近年来,我国互联网租赁自行车快速发展,在更好地满足公众出行需求、有效解决城市交通出行“最后一公里”问题、缓解城市交通拥堵、构建绿色出行体系等方面发挥了积极作用,有力推动了分享经济发展。但同时也存在车辆乱停乱放、车辆运营维护不到位、企业主体责任不落实、用户资金和信息安全风险等问题。为了鼓励和规范互联网租赁自行车发展,经国务院同意,现提出以下指导意见。
I. General requirements   一、北大法宝总体要求
(1) Guiding ideology. We shall comprehensively implement the spirit of the 18th CPC National Congress and the Third, Fourth, Fifth and Sixth Plenary Sessions of the 18th CPC Central Committee, carry out in depth the spirit of a series of important speeches and new concepts, thoughts and strategies of managing state affairs of General Secretary Xi Jinping, conscientiously implement the decisions and arrangements of the CPC Central Committee and the State Council, advance the overall layout for "economic, political, cultural, social, and ecological progress" in an overall manner and the Four-Pronged Comprehensive Strategy in a coordinated manner, firmly develop and implement the concept of innovative, coordinated, green, open and shared development, deepen supply-side structural reform, effectively advance the "Internet plus" action plan, encourage and regulate the development of internet bicycle rental, improve internet bicycle rental service, optimize commuting structure, build a green, low-carbon commuting system, and better satisfy the need of the people for commuting. (一)指导思想。全面贯彻党的十八大和十八届三中、四中、五中、六中全会精神,深入贯彻习近平总书记系列重要讲话精神和治国理政新理念新思想新战略,认真落实党中央、国务院决策部署,统筹推进“五位一体”总体布局和协调推进“四个全面”战略布局,牢固树立和贯彻落实创新、协调、绿色、开放、共享的发展理念,深化供给侧结构性改革,有效推进“互联网+”行动计划,鼓励和规范互联网租赁自行车发展,提升互联网租赁自行车服务水平,优化交通出行结构,构建绿色、低碳的出行体系,更好地满足人民群众出行需要。
(2) Basic principles. (二)基本原则。
-- Adhering to the orientation of service. A development mindset centering on the people shall be established, the lawful rights and interests of all parties shall be maintained, and safer, more convenient, greener and more economic commuting service shall be provided to the general public. --坚持服务为本。树立以人民为中心的发展思想,维护各方合法权益,为公众提供更安全、更便捷、更绿色、更经济的出行服务。
-- Adhere to reform and innovation. With the "Internet plus" action as an opportunity, the decisive role of the market in resource allocation shall be used, the role of the government shall be better underscored, a new mode of cooperation between the government and enterprises shall be explored, and the driving force and dynamism of enterprises for innovation shall be triggered, so as to promote the sound and orderly development of the industry. --坚持改革创新。以“互联网+”行动为契机,发挥市场在资源配置中的决定性作用和更好地发挥政府作用,探索政府与企业合作新模式,激发企业创新动力和活力,促进行业健康有序发展。
-- Adhering to regulation and order. Problem orientation shall be adhered to, inclusive and prudential regulation shall be implemented, a development environment encouraging and regulating the development of internet bicycle rental shall be formed, the primary responsibility of enterprises shall be fulfilled, enterprise business operation shall be regulated in accordance with the law, users shall be guided in being honest and civilized, and the normal operation and parking order shall be maintained. --坚持规范有序。坚持问题导向,实施包容审慎监管,形成鼓励和规范互联网租赁自行车的发展环境,落实企业主体责任,依法规范企业经营,引导用户守诚信、讲文明,维护正常运行和停放秩序。
-- Adhering to territorial jurisdiction. The urban people's governments, as the entity responsible for administration of internet bicycle rental, shall fully exercise autonomy and use its creativity, adopt measures suitable to local conditions, and explore the development mode in line with the local actual circumstances. --坚持属地管理。城市人民政府是互联网租赁自行车管理的责任主体,充分发挥自主权和创造性,因地制宜、因城施策,探索符合本地实际的发展模式。
-- Adhering to multi-party joint governance. All parties shall be fully motivated, industrial self-discipline shall be strengthened, and the general public shall be guided in vigorously participating, so as to form a pattern of joint governance of the government, enterprises, social organizations and the general public. --坚持多方共治。充分调动各方面积极性,加强行业自律,引导公众积极参与,形成政府、企业、社会组织和公众共同治理的局面。
II. Implementing policies encouraging development   二、实施鼓励发展政策
(3) Scientifically determining development orientation. Internet bicycle rental is non-motor vehicle sharing, a part of the urban green transport system, and a commuting service mode facilitating the short-distance commuting of the general public and the connection and transfer of the public transportation system. All regions shall adhere to developing public transport in priority, developing internet bicycle rental in an overall manner, advance the integrated development of public bicycle rental and internet bicycle rental, and establish and improve a multiple-layer, diversified urban commuting service system. The development of internet electric bicycle rental shall be discouraged. (三)科学确定发展定位。互联网租赁自行车是分时租赁营运非机动车,是城市绿色交通系统的组成部分,是方便公众短距离出行和公共交通接驳换乘的交通服务方式。各地要坚持优先发展公共交通,统筹发展互联网租赁自行车,推进公共租赁自行车与互联网租赁自行车融合发展,建立完善多层次、多样化的城市出行服务系统。不鼓励发展互联网租赁电动自行车。
(4) Guiding the orderly distribution of bicycles. Each city may, based on its characteristics, the demand of the general public for commuting and the development orientation of internet bicycle rental, research and establish a bicycle distribution mechanism matching the urban space tolerance capability, parking facility resources, and the demand of the general public for commuting, among others, guide internet bicycle rental providers in distributing bicycles in a reasonable and orderly manner, and ensure the sound and orderly development and safe and stable operation of the industry. (四)引导有序投放车辆。各城市可根据城市特点、公众出行需求和互联网租赁自行车发展定位,研究建立与城市空间承载能力、停放设施资源、公众出行需求等相适应的车辆投放机制,引导互联网租赁自行车运营企业合理有序投放车辆,保障行业健康有序发展和安全稳定运行。
(5) Improving the bicycle road network. Slow moving road network and bicycle parking facilities shall be reasonably distributed, included in the comprehensive urban transport system plans and connected with urban public transport plans. The building of cycle ways shall be vigorously advanced, and cycle ways shall be made more networked and accessible. The organization of cycling shall be optimized, road signs and marking lines shall be improved, and illegal acts such as occupation of non-motor vehicles shall be corrected, so as to ensure the conditions of cycling.
