| Notice of the relevant matters is hereby given as follows in order to implement in depth the spirit of the 18th CPC National Congress and the Third, Fourth, Fifth and Sixth Plenary Sessions of the 18th CPC Central Committee, carry out in-depth the decisions and deployment of the CPC Central Committee and the State Council on implementing the innovation-driven development strategy and the national intellectual property strategy and on accelerating the building of a powerful intellectual property country, and give fully use the functions and roles of notary service in protecting intellectual property. | | 为深入贯彻落实党的十八大和十八届三中、四中、五中、六中全会精神，深入贯彻落实党中央、国务院关于实施创新驱动发展战略和国家知识产权战略，加快知识产权强国建设的决策部署，充分发挥公证服务知识产权保护的职能作用，现就有关事项通知如下。 |
| I. The significance of strengthening the service of notarization for intellectual property right protection | | |
| As China's economic development enters the new normal phase and China's innovation-driven development strategy is implemented in depth, the intellectual property is increasingly becoming the strategic resource of national development and the essential factor of international competitiveness. Intellectual property, as an important element of the modern property rights system and important guarantee for innovation-driven development, has an increasingly important status and role in the national social and economic development. The notary system is a preventive judicial attestation system, has the functions of service, communications, proof and supervision, and is uniquely advantageous and plays important role in the aspects including maintaining the order of the market economy, guaranteeing and realizing citizens' rights and interests, promoting opening up, and strengthening the building of social honesty. Notarized matters have the statutory validity of proof, effect of compulsory execution, and effect of essential elements to establish legal acts. Notarization has bright prospective in serving intellectual property right protection, promoting the implementation of the innovation-driven development strategy and the national intellectual property strategy, and accelerating the building of a powerful intellectual property country. Strengthening the service of notarization for intellectual property right protection and giving full play of the functions and advantages of the notary system in intellectual property right protection are important content of strengthening the protection and application of intellectual property, innovating on and improving the intellectual property management mechanism and improving the intellectual property public service system and an important measure to implement in depth the intellectual property strategy and accelerate the building of a powerful intellectual property country. The competent justice departments, competent industry and commerce departments, copyright offices, and intellectual property offices at all levels shall, from the perspective of comprehensively implementing the rule of law, advancing the socialist legal construction, carrying out the innovation-driven development strategy, and accelerating the building of a powerful intellectual property country, fully recognize the significance of strengthening the service of notarization for intellectual property protection, vigorously create conditions, enhance service, innovate means and methods, advance the service of notarization for intellectual property protection, maintain the positive order of innovation on and creation, application and protection of intellectual property, and promote and ensure the sound development of China's intellectual property cause. | | 随着我国经济发展进入新常态和我国创新驱动发展战略的深入实施，知识产权日益成为国家发展的战略性资源和国际竞争力的核心要素。知识产权作为现代产权制度的重要构成、创新驱动发展的重要保障，在国家经济社会发展中的地位和作用日益凸显。公证制度是一项预防性的司法证明制度，具有服务、沟通、证明、监督的功能，在维护市场经济秩序、保障和实现公民权益、促进对外开放、加强社会诚信建设等方面具有独特优势和重要作用。经过公证证明的事项具有法定的证据效力、强制执行效力和法律行为成立要件效力。公证工作在服务知识产权保护，促进实施创新驱动发展战略和国家知识产权战略，加快知识产权强国建设中大有可为。加强公证服务知识产权保护工作，充分发挥公证制度在知识产权保护中的功能和优势，是加强知识产权保护运用、创新完善知识产权管理机制、健全知识产权公共服务体系的重要内容，也是深入实施知识产权战略、加快知识产权强国建设的重要举措。各级司法行政机关、工商行政管理机关、版权局、知识产权局要从全面依法治国和推进社会主义法治建设的高度，从实施创新驱动发展战略，加快知识产权强国建设的高度，充分认识加强公证服务知识产权保护工作的重要意义，积极创造条件，加大服务力度，创新方式方法，推进公证服务知识产权保护，维护知识产权创新、创造、应用和保护的良好秩序，促进和保障我国知识产权事业健康发展。 |
