| Article 1 For the purposes of strengthening the management of ocean observation data, ensure the safety and sharing of the marine observation data, and serving the economic and social development and the building of ecological civilization, these Measures are developed in accordance with the Regulation on the Administration of Ocean Observation and Forecasting. | | 第一条 为了加强海洋观测资料管理，保障海洋观测资料的安全和共享使用，为经济社会发展和生态文明建设服务，根据《海洋观测预报管理条例》，制定本办法。 |
| Article 2 The submission, safekeeping, disclosure, sharing, using services and international exchange of the ocean observation data shall be governed by these Measures. | | 第二条 海洋观测资料的汇交、保管、公开、共享、使用服务和国际交换，适用本办法。 |
| For the purposes of these Measures, “ocean observation data” means the data obtained from the activities of observing and measuring the tide, salinity, sea temperature, sea waves, sea ice, tsunami and so on for the purposes of understanding and describing the oceanic conditions and the data obtained from such activities as the collection, transmission, analysis and evaluation of relevant data, including the observation data of the ocean observation stations, buoy observation data, vessel observation data, etc. | | 本办法所称海洋观测资料，是指以掌握、描述海洋状况为目的，对潮汐、盐度、海温、海浪、海冰、海啸波等进行的观察测量活动中获取的资料以及对相关数据采集、传输、分析和评价活动中获取的资料，包括海洋观测站观测资料、浮标观测资料、船舶观测资料等。 |
| Article 3 The oceanic administration of the State Council shall be responsible for the management of the ocean observation data of the whole country. | | 第三条 国务院海洋主管部门负责全国海洋观测资料的管理。 |
| The local sea area offices of the oceanic administration of the State Council (hereinafter referred to as the “local sea area offices”) shall be responsible for the management of the ocean observation data in their respective sea areas. | | 国务院海洋主管部门的海区派出机构（以下简称海区派出机构）负责所辖海区海洋观测资料的管理。 |
| The oceanic administrations of the coastal provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the management of the ocean observation data within their respective administrative regions. | | 沿海省、自治区、直辖市海洋主管部门负责本行政区域内海洋观测资料的管理。 |
| Article 4 The oceanic administration of the State Council shall entrust the ocean observation data management institution of the state to be responsible for the routine submission, safekeeping, quality control, and use services of the ocean observation data across the country, and assume technical support of the oceanic administration of the State Council concerning the management of the ocean observation data | | 第四条 国务院海洋主管部门委托国家海洋观测资料管理机构负责全国海洋观测资料的日常汇交、保管、质量控制和使用服务，承担国务院海洋主管部门有关海洋观测资料管理的技术支撑等工作。 |
| The local sea area offices and the oceanic administrations of the coastal provinces, autonomous regions and municipalities directly under the Central Government may entrust the ocean observation data management institutions at the same level to be responsible for the routine submission, safekeeping, quality control, and use services of the ocean observation data in the sea areas or administrative regions under their jurisdictions, and assume technical support concerning the management of the ocean observation data. | | 海区派出机构和沿海省、自治区、直辖市海洋主管部门可以委托同级海洋观测资料管理机构负责所辖海区或者行政区域内海洋观测资料的日常汇交、保管、质量控制和使用服务，承担有关海洋观测资料管理的技术支撑等工作。 |
| Article 5 Entities and individuals that have made outstanding contributions to the management of ocean observation data shall be commended and rewarded by the oceanic administration. | | 第五条 对在海洋观测资料管理工作中作出突出贡献的单位和个人，由海洋主管部门给予表彰和奖励。 |
| Article 6 Entities carrying out the ocean observation activities in the areas of the People's Republic of China and other sea areas under the jurisdiction of the People's Republic of China shall, under the provisions of these Measures, submit the ocean observation data to relevant oceanic administrations. | | 第六条 在中华人民共和国领域和中华人民共和国管辖的其他海域内从事海洋观测活动的单位，应当按照本办法的规定向有关海洋主管部门汇交海洋观测资料。 |
| Article 7 The local sea area offices and the ocean administrations of the provinces, autonomous regions and municipalities directly under the Central Government shall develop a directory of entities required to submit ocean observation data in the sea areas or administrative regions under their jurisdictions, specify the entities that need to submit the data and the scope, contents, methods, etc. of the submitted data, and make an announcement. | | 第七条 海区派出机构和省、自治区、直辖市海洋主管部门应当建立所辖海区或者行政区域内海洋观测资料汇交单位名录，明确需要汇交资料的单位以及汇交资料的范围、内容、方式等，并予以公布。 |
| Article 8 The oceanic administrations of the coastal provinces, autonomous regions and municipalities directly under the Central Government shall sort out and develop the catalogues of the ocean observation data submitted by the quarter based on the ocean observation data they have received, and submit them to the local sea area offices. | | |
| The oceanic administrations of the coastal provinces, autonomous regions and municipalities directly under the Central Government shall sort out and develop the submission catalogues of the ocean observation data on a quarterly basis by analyzing the ocean observation data they have received and the submission catalogues submitted by the coastal provinces, autonomous regions and municipalities directly under the Central Government, and submit them to the ocean observation data management institution of the state. | | 海区派出机构对其接收的海洋观测资料以及沿海省、自治区、直辖市报送的汇交目录，应当按照季度整理编制海洋观测资料汇交目录，并报送国家海洋观测资料管理机构。 |
| The ocean observation data management institution of the state shall develop the submission catalogues of the ocean observation data on an annual basis after analyzing the submission catalogues that they received from the local sea area offices, and publish them. | | 国家海洋观测资料管理机构对其接收的海区派出机构报送的汇交目录，应当按照年度编制海洋观测资料汇交目录，并予以公布。 |
| Article 9 The marine administrative departments of the coastal provinces, autonomous regions and municipalities directly under the Central Government shall transmit the ocean observing data they received to the local sea area offices in a real-time manner through the data transmission network. | | 第九条 沿海省、自治区、直辖市海洋主管部门应当将接收的海洋观测资料通过数据传输网络实时传输至海区派出机构。 |
