| For purposes of regulating the relevant procedures and requirements for trademark applications submitted via the Internet in data message form (hereinafter referred to as the “online trademark applications”), these Provisions are developed in accordance with the Trademark Law of the People's Republic of China and the Regulation on the Implementation of the Trademark Law of the People's Republic of China. | | 为了规范通过互联网以数据电文方式提交的商标申请（以下简称商标网上申请）的有关程序和要求，根据《中华人民共和国商标法》及《中华人民共和国商标法实施条例》，制定本规定。 |
| Article 1 To submit an online trademark registration application, an applicant shall be a natural person, a legal person or any other organization qualified to apply for trademark registration as prescribed in the Trademark Law. | | 第一条 提交商标网上申请业务，申请人应为符合商标法规定的商标注册申请主体资格的自然人、法人或者其他组织。 |
| Article 2 A trademark applicant may file an application on its own or entrust a legally formed trademark agency to file an online trademark application. The relationship between a trademark applicant and a trademark agency filing an online trademark registration application on its behalf is one of trademark agency trust. | | 第二条 商标申请人可以自行办理，也可以委托依法设立的商标代理机构办理商标网上申请。商标申请人与为其提交商标注册网上申请的商标代理机构为商标代理委托关系。 |
| A foreigner or foreign enterprise shall entrust a legally formed trademark agency to file an online trademark application. | | 外国人或者外国企业提交商标网上申请应当委托依法设立的商标代理机构办理。 |
| Article 3 A trademark applicant handling applications on its own shall file an online user registration application before filing an online trademark application and accurately enter authentic and valid user information as required. | | 第三条 商标申请人自行办理商标申请事宜的，在提交商标网上申请前需在线提交用户注册申请，按要求准确填写真实有效的用户信息。 |
| A trademark applicant with an electronic business license may use its electronic business license to file user registration application. | | 商标申请人持有电子营业执照的，可以使用电子营业执照进行用户注册申请。 |
| Article 4 Where a trademark applicant has successfully registered a user, but does not use it within three years, the user shall be automatically deregistered. A trademark applicant that is still required to handle the business of online trademark application may re-submit an application for user registration. | | 第四条 商标申请人用户注册成功后，三年内未使用，将自动注销用户。商标申请人仍需办理商标网上申请业务的，可重新提交用户注册。 |
Article 5 A trademark applicant whose user information is changed shall submit an online application for change in user information in a timely manner. A trademark applicant that has an electronic business license and whose information is changed shall undergo the formalities of information change with the organ issuing electronic business license and file an application for change in user information. An applicant that has filed a trademark registration application and whose name or address has changed shall handle the change formalities separately.
