According to the provisions in the Law of the People's Republic of China on the Administration of Entry and Exit of Aliens, the penalty of ordering aliens to leave the country within a time limit shall be decided by the Ministry of Public Security. In order to enhance law enforcement efficiency and facilitate the timely handling of crimes and offences committed by aliens, and according to the relevant legal provisions, the Ministry of Public Security has decided to authorize the departments and bureaus of public security in all provinces, autonomous regions and municipalities directly under the Central Government to exercise the examination and approval power for the penalty of ordering aliens to leave the country within a time limit. The relevant matters are hereby notified as follows: | |
根据《中华人民共和国外国人入境出境管理法》的规定，对外国人处以限期出境的，由公安部决定。为提高执法效率，便于及时处理外国人违法犯罪案件，根据有关法律规定，公安部决定委托各省、自治区、直辖市公安厅、局行使部分限期出境的审批权。现就有关问题通知如下： |

| I. Where an alien is under any of the following circumstances, if case facts are simple, evidence is irrefutable and the alien shall be imposed on the penalty of ordering to leave the country within a time limit, the penalty shall be subject to examination and approval by the department or bureau of public security in the local province, autonomous region or municipality directly under the Central Government, and the department or bureau of public security shall make a Written Decision on Public Security Administrative Punishments and send a copy thereof to the Ministry of Public Security for archival purpose: | | 一、外国人有下列情形之一，且案情简单、证据确凿，依法应当限期出境的，限期出境处罚由各省、自治区、直辖市公安厅、局审批，制作《公安行政处罚决定书》，并抄报公安部备案： |

| 1. Illegally entering our country; | | (一)非法入境的； |
| |
|
| 2. Illegally staying and residing in our country; | | (二)非法居留的； |
| |
|
| 3. Illegally getting employment in our country; | | (三)非法就业的； |
| |
|
| 4. Forging, altering, using under false pretenses, transferring, purchasing or selling visa or certificate; | | (四)伪造、涂改、冒用、转让、买卖签证、证件的； |

5. Any alien is founded suffering from any diseases as provided for in Article 7 (d) of the Detailed Rules for Implementing the Law on the Administration of Entry and Exit of Aliens while he is staying and residing in our country, and the organ of public security has ordered the alien to leave our country upon request of the health administrative department of our country but the alien fails to do so; or
