Key Points of the Work for Promoting the Reform in Streamlining Administration and Delegating Powers to Lower Levels, Combination of Deregulation with Regulation and Optimizing Services in 2016 2016年推进简政放权放管结合优化服务改革工作要点
2016 is the starting year of the "13th Five-year" plan and the crucial year for promoting the supply-side structural reform. The general requirements for promoting the reform in streamlining administration and delegating powers to lower levels, combination of deregulation with regulation and optimizing services are: fully implementing the principles laid down at the 18th National Congress of the CPC, the Second, the Third, the Fourth and the Fifth Plenary Sessions of the 18th Central Committee of the CPC as well as the arrangements made at the Central Economic Work Conference and in the Report on Government Work, adopting further powerful measures to promote in both extensiveness and depth the reform in streamlining administration and delegating powers to lower levels, combination of deregulation with regulation and optimizing services by focusing on the transformation of government function and according to the concept of innovative, coordinated, green, open and sharing development, bringing into play the decisive role of the market in resource allocation and into better play the government role, breaking the system and mechanism barriers restricting enterprises and the public from handling affairs and starting up businesses, making efforts to lower the institutional transaction cost, optimizing business environment, stimulating market vitality and social creativity, closely combining such vitality and creativity with the public entrepreneurship and innovation and the development and growth of new economy, further forming the endogenous momentum for economic growth and promoting the sustainable and healthy economic and social development. 2016年是“十三五”规划开局之年,也是推进供给侧结构性改革的攻坚之年。今年推进简政放权、放管结合、优化服务改革的总体要求是:全面贯彻党的十八大和十八届二中、三中、四中、五中全会精神,认真落实中央经济工作会议和《政府工作报告》部署,按照创新、协调、绿色、开放、共享的发展理念,紧紧扭住转变政府职能这个“牛鼻子”,在更大范围、更深层次,以更有力举措推进简政放权、放管结合、优化服务改革,使市场在资源配置中起决定性作用和更好发挥政府作用,破除制约企业和群众办事创业的体制机制障碍,着力降低制度性交易成本,优化营商环境,激发市场活力和社会创造力,与大众创业、万众创新和发展壮大新经济紧密结合起来,进一步形成经济增长内生动力,促进经济社会持续健康发展。
1. Continuously streamlining administration and delegating powers to lower levels and further stimulating the market vitality and social creativity   一、持续简政放权,进一步激发市场活力和社会创造力
(1) Administrative examination and approval reform shall be deepened continuously. Continuous efforts shall be made to further delegate powers to lower levels, delegate the powers that should be delegated and cancel as much as possible the powers that can be cancelled and leave such powers directly to the market and the society. In this year, more than 50 items subject to administrative examination and approval by the departments of the State Council or to the administrative examination and approval conducted by local government as designated by the Central Government shall be cancelled, a batch of intermediary service items in administrative examination and approval by the departments of the State Council shall be removed and a batch of production licenses and business licenses shall be reduced. For the examination and approval items that truly need to be delegated to the grassroots, support shall be provided in talents, funds, technologies, equipment and other aspects to ensure that grassroots have the capacity for management of the items and can manage the items well. Similar or related examination and approval matters shall be cancelled or delegated together to improve the coordination and interaction of the delegated powers. For the administrative examination and approval items that truly need to be retained, the examination and approval standards shall be uniform, formalities simplified and procedures standardized. All administrative examination and approval items shall be handled strictly according to the statutory time limit without exceeding such time limit. Pilot reform shall continue to be conducted in relatively centralizing administrative licensing power and the local experience in comprehensive examination and approval shall be popularized. (Led by the Office of the Leading Group of the Administrative Examination and Approval System Reform of the State Council ("System Reform Office") with relevant departments of the State Council taking charge according to their division of responsibilities) (一)继续深化行政审批改革。继续加大放权力度,把该放的权力放出去,能取消的要尽量取消,直接放给市场和社会。今年要再取消50项以上国务院部门行政审批事项和中央指定地方实施的行政审批事项,再取消一批国务院部门行政审批中介服务事项,削减一批生产许可证、经营许可证。对确需下放给基层的审批事项,要在人才、经费、技术、装备等方面予以保障,确保基层接得住、管得好。对相同、相近或相关联的审批事项,要一并取消或下放,提高放权的协同性、联动性。对确需保留的行政审批事项,要统一审批标准,简化审批手续,规范审批流程。所有行政审批事项都要严格按法定时限做到“零超时”。继续开展相对集中行政许可权改革试点,推广地方实施综合审批的经验。(国务院审改办牵头,国务院各有关部门按职责分工负责)
(2) Investment examination and approval reform shall be further promoted. Enterprise autonomy shall be further expanded, another amendment shall be made to the catalogue of the investment projects subject to government approval, and total reduced enterprise investment projects subject to approval by the Central Government shall account for 90% or more of the original projects. The Regulations on Approval and Record-filing Administration of Enterprise Investment Projects shall be formulated, the plan for examination and approval system reform for the investment within Central budget shall be made and the implementing plan for integrating and standardizing the investment and construction project examination and approval items shall be released. The retained investment project examination and approval items shall all be incorporated in the national unified regulatory platform for online investment project examination and approval so as to conduct "one stop" online examination and approval, greatly shorten the examination and approval process and time and increase the speed of investment examination and approval. (Led by the National Development and Reform Commission with the Ministry of Land and Resources, the Ministry of Environmental Protection, the Ministry of Housing and Urban-Rural Development, the Ministry of Transport, the Ministry of Water Resources, the Legislative Affairs Office of the State Council and other relevant departments taking charge according to their division of responsibilities) (二)深入推进投资审批改革。进一步扩大企业自主权,再修订政府核准的投资项目目录,中央政府层面核准的企业投资项目削减比例累计达到原总量的90%以上。出台《企业投资项目核准和备案管理条例》。制定中央预算内投资审批制度改革方案。出台整合规范投资建设项目报建审批事项实施方案。保留的投资项目审批事项要全部纳入全国统一的投资项目在线审批监管平台,实行“一站式”网上审批,大幅缩短审批流程和审批时间,推进投资审批提速。(国家发展改革委牵头,国土资源部、环境保护部、住房城乡建设部、交通运输部、水利部、国务院法制办等相关部门按职责分工负责)
(3) Vocational qualification reform shall be conducted on solid basis. Another batch of vocational qualification permit and recognition items shall be cancelled and the number of the reduced vocational qualifications set by the departments of the State Council shall account for 70% or more of the original number of such qualifications. Comprehensive sorting shall be made as to various types of industry access licenses and work licenses, etc. under varied names and those that are unreasonable shall be cancelled or integrated. The national vocational qualification directory list management system shall be established, the application of vocational qualification permit and recognition shall strictly be limited within the list and the vocational qualifications within the list shall not be linked to employment and startup of businesses unless they are for industrial access. The activities such as "lending out certificates" or "aid in examination" shall be strictly punished and examination and training shall be strictly separated from each other. (Led by the Ministry of Human Resources and Social Security with the Ministry of Industry and Information Technology, the Ministry of Housing and Urban-Rural Development, the Ministry of Transport, the State-owned Assets Supervision and Administration Commission of the State Council, the General Administration of Qualify Supervision, Inspection and Quarantine, the State Administration of Work Safety, the China Food and Drug Administration and other relevant departments taking charge according to their division of responsibilities) (三)扎实做好职业资格改革。再取消一批职业资格许可和认定事项,国务院部门设置的职业资格削减比例达到原总量的70%以上。全面清理名目繁多的各种行业准入证、上岗证等,不合理的要坚决取消或整合。建立国家职业资格目录清单管理制度,清单之外一律不得开展职业资格许可和认定工作,清单之内除准入类职业资格外一律不得与就业创业挂钩。严肃查处职业资格“挂证”、“助考”等行为,严格落实考培分离。(人力资源社会保障部牵头,工业和信息化部、住房城乡建设部、交通运输部、国务院国资委、质检总局、安全监管总局、食品药品监管总局等相关部门按职责分工负责)
(4) Commercial system reform shall be promoted continuously. Market entry shall be further relaxed, pre-examination and approval items in industrial and commercial registration shall continue to be greatly reduced with another one-third of such items to be reduced this year and the reduced items accounting for 90% or more of original items, and 50 or more post-examination and approval items shall be cancelled. On the basis of comprehensive implementation of "integration of three certificates (the business license, the organization code certificate, and the certificate of taxation registration) into one document" for enterprises, social insurance registration certificate and statistics registration certificate shall be integrated to realize the "integration of five certificates into one document" and "one license (business license) carrying one code (social credit code)" and reduce the institutional cost for access to startup of businesses. The coverage of "integration of three certificates into one document" shall be expanded and the business license and certificate of taxation registration for sole proprietorship shall be integrated in order that industrial and commercial registration and taxation registration can be handled by filling out "one form" and submitting "one set of materials" at "one window". The pilot reform in full-course electronic industrial and commercial registration, name registration, relaxing conditions on domicile and simplified deregistration, etc. shall be implemented in an accelerated manner. The popularization of electronic business license shall be accelerated. The pilot reform in "separation of certificate from license" shall be properly conducted to practically decrease various unnecessary licenses, solve the problem that "entry is approved while operation is not" as encountered by enterprises and form as soon as possible the experience that can be replicated and popularized. (Led by the State Administration for Industry and Commerce and the System Reform Office with the Ministry of Human Resources and Social Security, the State Administration of Taxation, the Legislative Affairs Office of the State Council, the National Bureau of Statistics and other relevant departments as well as the People's Government of Shanghai Municipality taking charge according to their division of responsibilities)

 (四)持续推进商事制度改革。进一步放宽市场准入,继续大力削减工商登记前置审批事项,今年再取消三分之一,削减比例达到原总量的90%以上,同步取消后置审批事项50项以上。在全面实施企业“三证合一”基础上,再整合社会保险登记证和统计登记证,实现“五证合一、一照一码”,降低创业准入的制度成本。扩大“三证合一”覆盖面,推进整合个体工商户营业执照和税务登记证,实现只需填写“一张表”、向“一个窗口”提交“一套材料”,即可办理工商及税务登记。加快推进工商登记全程电子化、名称登记、放宽住所条件、简易注销登记等改革试点。加快推行电子营业执照。抓好“证照分离”改革试点,切实减少各种不必要的证,解决企业“准入不准营”的问题,尽快总结形成可复制、可推广的经验。(工商总局、国务院审改办牵头,人力资源社会保障部、税务总局、国务院法制办、国家统计局等相关部门和上海市人民政府按职责分工负责)
