The Ordinance on Disciplines for the People's Police of the Public Security Organs, which were deliberated and adopted at the 8th minister's executive meeting of the Ministry of Supervision on November 27, 2009, the 32nd executive meeting of the Ministry of Human Resources and Social Security on November 2, 2009, the 6th minister's executive meeting of the Ministry of Public Security on July 28, 2009 and the 13th executive meeting of the State Administration of Civil Service on September 29, 2009, was approved by the State Council on March 10, 2010, is hereby promulgated, and shall come into force on June 1, 2010. | |
《公安机关人民警察纪律条令》已经2009年11月27日监察部第8次部长办公会议、2009年11月2日人力资源和社会保障部第32次部务会议、2009年7月28日公安部第6次部长办公会议、2009年9月29日国家公务员局第13次局务会议审议通过。2010年3月10日经国务院批准，现予公布，自2010年6月1日起施行。 |

| Chapter I General Provisions | | 第一章 总 则 |

| Article 1 To solemnify the disciplines of the public security organs, regularize the acts of the people's police of the public security organs and guarantee the lawful fulfillment of duties by the public security organs and the people's police thereof, this Ordinance is formulated pursuant to the People's Police Law of the People's Republic of China, theAdministrativeSupervision Law of the People's Republic of China, the Civil Servant Law of the People's Republic of China, the Regulation on the Disciplinary Actions against Civil Servants of Administrative Organs, the Organizational Management Regulation of the Public Security Organs and other relevant laws and administrative regulations. | | 第一条 为了严明公安机关纪律，规范公安机关人民警察的行为，保证公安机关及其人民警察依法履行职责，根据《中华人民共和国人民警察法》、《中华人民共和国行政监察法》、《中华人民共和国公务员法》、《行政机关公务员处分条例》、《公安机关组织管理条例》等有关法律、行政法规，制定本条令。 |

| Article 2 The people's police of the public security organs shall strictly abide by the provisions on the disciplines for the people's police of the public security organs as prescribed in the People's Police Law of the People's Republic of China, the Administrative Supervision Law of the People's Republic of China and other relevant laws and regulations. Where any people's policeman of any public security organ shall be subject to disciplinary liability for the violation of any law or discipline, a disciplinary action shall be taken against him under this Ordinance. | | 第二条 公安机关人民警察应当严格遵守《中华人民共和国人民警察法》、《中华人民共和国公务员法》等法律法规关于公安机关人民警察纪律的规定。公安机关人民警察违法违纪，应当承担纪律责任的，依照本条令给予处分。 |
Where there are different provisions in any law, administrative regulation or the State Council's decision with regard to the disciplinary action against a policeman, such provisions shall apply. | |
法律、行政法规、国务院决定对公安机关人民警察处分另有规定的，从其规定。 |

| Article 3 Where any policeman shall be subject to disciplinary liability for violating any of the laws or disciplines, a disciplinary action shall be taken against him by the appointment and removal organ or the supervisory organ within its powers. | | 第三条 公安机关人民警察违法违纪，应当承担纪律责任的，由任免机关或者监察机关按照管理权限依法给予处分。 |
Where any public security organ shall be subject to disciplinary liability for violating any of the laws or disciplines, disciplinary actions shall be taken against the liable leaders and the directly liable persons. | |
公安机关有违法违纪行为，应当追究纪律责任的，对负有责任的领导人员和直接责任人员给予处分。 |

| Article 4 Where any policeman receives any disciplinary action, his promotion shall be delayed or his police rank shall be lowered under the relevant provisions. | | 第四条 对受到处分的公安机关人民警察，应当依照有关规定延期晋升、降低或者取消警衔。 |
| |
|
| Article 5 Where policeman violates any law or discipline and is suspected of being involved in any crime, he shall be subject to criminal liability. | | 第五条 公安机关人民警察违法违纪涉嫌犯罪的，应当依法追究刑事责任。 |
| |
|
| Article 6 The supervisory body stationed by a supervisory organ at the public security organ at the same level has the authority to investigate into the violations of laws or disciplines which fall under the jurisdiction of the supervisory body stationed by a supervisory organ at the next lower level to the public security organ at the same level, and may investigate into the violations of laws or disciplines which fall under the jurisdiction of the supervisory body stationed by any supervisory organ under its jurisdiction to the public security organ at the same level, if necessary. | | 第六条 监察机关派驻同级公安机关监察机构可以调查下一级监察机关派驻同级公安机关监察机构管辖范围内的违法违纪案件，必要时也可以调查所辖各级监察机关派驻同级公安机关监察机构管辖范围内的违法违纪案件。 |
The supervisory body stationed by a supervisory organ at the public security organ at the same level may, upon the approval of the supervisory organ, investigate into the violations of laws or disciplines committed by any leader of the public security organ at a lower level. | |
监察机关派驻同级公安机关监察机构经派出它的监察机关批准，可以调查下一级公安机关领导人员的违法违纪案件。 |
Upon the end of investigation, the supervisory body stationed by a supervisory organ at the public security organ at the same level shall, according to the personnel management powers, give a disciplinary suggestion to the organ making disciplinary action decisions, which shall make a disciplinary action decision by law. | |
调查结束后，按照人事管理权限，监察机关派驻同级公安机关监察机构应当向处分决定机关提出处分建议，由处分决定机关依法作出处分决定。 |

| Chapter II Acts Violating any Law or Discipline and the Applicable Disciplinary Actions | | 第二章 违法违纪行为及其适用的处分 |
| |
|
| Article 7 Anyone who commits any of the following acts shall be given a disciplinary action of expulsion: | | 第七条 有下列行为之一的，给予开除处分： |
| |
|
| 1. Escaping to an overseas area, illegally leaving the country, or refusing to return from an overseas trip by violating relevant provisions; | | （一）逃往境外或者非法出境、违反规定滞留境外不归的； |
| |
|
| 2. Participating, harboring or conniving at any illegal or criminal activity which jeopardizes the national security; | | （二）参与、包庇或者纵容危害国家安全违法犯罪活动的； |
| |
|
| 3. Participating, harboring or conniving at any criminal activity committed by organizations which are by nature criminal gangs; | | （三）参与、包庇或者纵容黑社会性质组织犯罪活动的； |
| |
|
| 4. Dropping notes to criminal suspects; or | | （四）向犯罪嫌疑人通风报信的； |
| |
|
| 5. Illegally allowing other people enter into or leave China. | | （五）私放他人出入境的。 |
| |
|
| Article 8 Anyone who spreads any words that may damage the national prestige shall be given a special demerit; be demoted or removed from office if the circumstances are rather serious; or be expulsed if the circumstances are serious. | | 第八条 散布有损国家声誉的言论的，给予记大过处分；情节较重的，给予降级或者撤职处分；情节严重的，给予开除处分。 |

| Article 9 Anyone who commits any of the following acts shall be given a demerit or a special demerit; be demoted or removed from office if the circumstances are rather serious; or be expulsed if the circumstances are serious: | | 第九条 有下列行为之一的，给予记过或者记大过处分；情节较重的，给予降级或者撤职处分；情节严重的，给予开除处分： |

| 1. Intentionally establishing a case, withdrawing a case, submitting a motion for arrest or deciding a referral for prosecution as in violation of provisions; | | （一）故意违反规定立案、撤销案件、提请逮捕、移送起诉的； |
| |
|
| 2. Taking, changing or lifting criminalcompulsory measures such as criminal detention, recognizance on bail and residence surveillance or administrative detention as in violation of provisions; | | （二）违反规定采取、变更、撤销刑事拘留、取保候审、监视居住等刑事强制措施或者行政拘留的； |
| |
|
| 3. Illegally depriving of or restricting other people's personal freedom; | | （三）非法剥夺、限制他人人身自由的； |
| |
|
| 4. Illegally searching other people's body, belongings, domicile or place; | | （四）非法搜查他人身体、物品、住所或者场所的； |
| |
|
5. Extending the custody time or taking other people into custody in any disguised form as in violation of provisions; or
