The departments of natural resources of all provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning; the department of natural resources of Xinjiang Production and Construction Corp.; all banking and insurance regulatory bureaus, all policy-based banks, large banks and joint-stock banks: 各省、自治区、直辖市及计划单列市自然资源主管部门,新疆生产建设兵团自然资源主管部门,各银保监局,各政策性银行、大型银行、股份制银行:
To implement the decisions and arrangements of the CPC Central Committee and the State Council on deepening the reform of “simplification of administrative procedures, devolution of powers, combination of devolution and regulation, and optimization of services” and optimizing the business environment, and fulfill the requirements set forth in the Notice of the General Office of the State Council on Shortening Time for Realty Registration (No. 8 [2019] of the General Office of the State Council), the Ministry of Natural Resources and the China Banking and Insurance Regulatory Commission have decided to strengthen cooperation on providing better and more convenient services to the public and the enterprises, set up service counters in each other's service halls for realty mortgage registration and mortgage loans, coordinate efforts in the examination and approval of loans, inquiries of realty registration documents and realty mortgage registration, speed up the process of “Internet + Realty Mortgage Registration”, improve the capabilities of preventing and forestalling financial risks, and support the financial sector in better serving the economic and social development. It is hereby notified as follows: 为贯彻落实党中央、国务院关于深化“放管服”改革、优化营商环境等决策部署和《国务院办公厅关于压缩不动产登记办理时间的通知》(国办发〔2019〕8号)要求,自然资源部和中国银保监会决定加强便民利企服务合作,互设不动产抵押登记和抵押贷款服务点,协同贷款审批、不动产登记资料查询与不动产抵押登记,加快推进“互联网+不动产抵押登记”,提升金融风险防范能力,支持金融业更加有效服务经济社会发展。现通知如下:
I. Strengthening cooperation and setting up service counters in each other's service halls for realty mortgage registration and mortgage loans   一、加强合作,互设不动产抵押登记和抵押贷款服务点
Realty registration agencies may, based on the documents jointly issued by relevant departments or the cooperative contracts signed with banking institutions, set up service counters in the eligible service halls of banking institutions, in which banking institutions shall provide service sites, dedicated Internet access, necessary office facilities and daily maintenance. Where the conditions permit, banking institutions shall, according to the principle of fairness and impartiality, set up service counters at the realty registration service halls to provide early-stage services such as consultancy for fund supervision and consultancy for mortgage loans, making it easier for enterprises and the public to sign contracts at the same time, obtain the approval of loans, and undergo the formalities of realty mortgage registration with “one-stop” services. 不动产登记机构可以通过部门联合发文或与银行业金融机构签订合作协议等,在具备条件的银行业金融机构网点设立服务点,银行业金融机构负责提供场所,布设数据专线,配备必要的办公设备并做好日常维护。有条件的地方要按照公平公正的原则,由银行业金融机构在不动产登记大厅设立服务点,提供资金监管咨询、抵押放贷咨询等前期服务。方便企业和群众同步签订合同、办理贷款审批、办理不动产抵押登记,享受“一站式”服务。
II. Providing an integrated system to support online information inquiries and mortgage registration application   二、对接系统,实现网上信息查询和抵押登记申请
Efforts shall be made to promote the construction of an electronic system for the whole process of realty mortgage registration, and actively provide an integrated system according to unified interface standards and regulations. Realty registration agencies shall develop relevant standards, determine the extent of data openness and the scope of information sharing, enable the network ports, connect the realty registration system with the service system of banking institutions, support the banking institutions in checking relevant realty registration information with authorization or in the name of mortgagees via the Internet according to law, and, together with mortgagers, submitting the application materials for realty registration. The information sharing among departments shall be deepened so as to help realty registration agencies to check, acquire and verify the financial license information of banking institutions. Banking institutions shall gradually promote the use of the “unit number of real estate”, and add the column of “the unit number of real estate” in the mortgage contract so that relevant systems can be effectively connected. 推进不动产抵押登记全程电子化系统建设,按照统一的接口标准和规范积极开展系统对接。不动产登记机构要制定相关标准,确定数据开放边界和信息共享范围,开通网络端口,联通不动产登记和银行业金融机构业务系统,支持银行业金融机构经授权或以抵押权人身份,通过网络依法查询相关不动产登记信息,与抵押人提交申请材料、提出登记申请。要深化部门间信息共享,方便不动产登记机构在线查询、获取和核实银行业金融机构金融许可证信息。银行业金融机构应在业务范围内逐步推动不动产单元号的使用,在抵押合同中增设不动产单元号栏目,便于实现相关系统的有效关联。
In places where the conditions permit, realty registration agencies and banking and insurance regulatory bureaus at the provincial or prefectural level shall, in the mode of “head office to head office”, discuss about the plan of connecting the realty mortgage registration system and the mortgage loans system within the province or prefecture, support the system connection with the provincial branches of banking institutions and local corporate financial institutions through the dedicated financial network of the banking and insurance regulatory bureaus, or support the system connection with the municipal branches of banking institutions and local corporate financial institutions through the dedicated financial network of the banking and insurance regulatory sub-bureaus. 具备条件的地方应由省级或地市级不动产登记机构和银保监局按照“总对总”方式,共同协商确定本省或地市范围内不动产抵押登记和抵押贷款系统对接方案,通过银保监局金融专网实现与当地全国性银行业金融机构省级分行、地方法人金融机构进行系统对接,或通过银保监分局金融专网实现与当地全国性银行业金融机构市级分行、地方法人金融机构进行系统对接。
III. Improving the principles of “Internet + Realty Mortgage Registration” according to laws and regulations   三、依法依规,健全“互联网+不动产抵押登记”办事规则
Realty registration agencies shall fulfill the registration responsibilities according to law and clarify the legal relationship; not change the current system arrangement or division of duties due to “Internet + Realty Mortgage Registration”; regulate the operations according to the requirements and procedures provided in the Interim Regulation on Real Estate Registration and its implementation rules; sign cooperative contracts with banking institutions, clarify such matters as specific services, application materials, division of duties, working requirements, and legal responsibilities, and agree on the time limit of serving paper-based application materials in a centralized manner. The statutory duties of realty registration agencies such as acceptance, review, bookkeeping, and issuance of certificates shall not be commissioned or authorized to banking institutions. 不动产登记机构要切实履行依法登记职责、明晰法律关系,不因“互联网+不动产抵押登记”改变现有制度安排、职责分工,按照《不动产登记暂行条例》及其实施细则等法规政策规定的要件和程序,规范运行,与银行业金融机构签订合作协议,明确业务内容、申请材料、职责分工、工作要求、法律责任等事项,约定纸质申请材料集中送达的时限。不动产登记机构的受理、审核、登簿、发证等法定职责,不得委托或授权银行行使。
Banking institutions shall designate special persons to fill in the registration application forms together with mortgagers, collect and verify such materials as realty ownership certificates of collaterals, identity cards of mortgagers, and realty registration application forms, create an electronic version for such materials, hand it over to realty registration agencies via the Internet in a timely manner, and, together with mortgagers, submit the application for registration. Banking institutions shall assign special persons on a regular basis to deliver all paper-based application materials received to realty registration agencies. 银行业金融机构应指定专人,与抵押人共同填写登记申请书,按照申请不动产抵押登记的有关要求,收集并核对抵押物不动产权证书、抵押人身份证明、不动产登记申请书等材料,形成电子件,通过网络即时提交给不动产登记机构,与抵押人共同提出登记申请。银行业金融机构定期派专人将收取的不动产抵押登记纸质申请材料集中送不动产登记机构。
For services such as identity verification and inquiry records that need to be handled on-site by realty registration agencies, the applicants may provide the materials that have passed the identity verification and fill in the inquiry records in certain formats, and submit them along with the application materials. After receiving the application materials, realty registration agencies shall promptly examine the materials, accept those that comply with the statutory conditions and issue the acceptance certificates, complete the review, bookkeeping, and certificate issuance in a timely manner, and report the handling results. 身份核验、询问笔录等需要不动产登记机构现场办理的事项,可由申请人提交通过系统身份核验的材料和填写格式化的询问笔录完成,与申请材料一并提交。收到申请材料后,不动产登记机构要及时审查,对符合法定条件的应当受理并出具受理凭证,及时审核、登簿、发证并反馈办理结果。
IV. Simplifying materials and optimizing service processes   四、精简材料,优化相关业务办理流程
When undergoing the loan procedures at banking institutions, mortgagers may submit the mortgage registration application materials all at the same time, transmit them to realty registration agencies via the Internet, without having to go to the realty registration agencies again to file the application; no longer need to submit their identity cards when going through deregistration formalities; simplify such materials as identity cards when applying for both realty transfer registration and mortgage registration. The application for, acceptance and review of advance notice registration, mortgage advance notice registration, transfer registration and mortgage registration may be handled all at the same time. For contracts on principal creditor's rights and mortgage contracts when going through mortgage registration, the core information required can be first collected. To avoid the repeated submissions of business licenses, financial licenses, identity cards of the entities' legal representatives or responsible persons, realty registration agencies shall build a centralized inspection system for common materials of relevant banking institutions; and if the aforesaid information changes, banking institutions shall update it in a timely manner. 抵押人在银行业金融机构办理贷款手续时可以一并提交抵押登记申请材料,通过网络传输至登记机构,无需当事人再到登记机构提交申请;对于抵押权注销登记,不再提交抵押人身份证明材料;对于不动产转移登记同时发生抵押的,精简相同的身份证明等材料,预告登记和抵押预告登记、转移登记和抵押登记可以一并申请、一并受理与审核;对于办理抵押登记时需要的抵押担保主债权合同、抵押合同,可以首先提取登记所需的核心信息。不动产登记机构应当建立相关银行业金融机构共性材料集中查验制度,避免反复提交营业执照、金融许可证、单位法人代表或负责人身份证等材料;上述信息变化的,银行业金融机构应及时更新。
V. Providing services specifically for the convenience of the public and the enterprises   五、精准服务,拓展便民利企办理事项
Realty registration agencies and relevant banking institutions shall, according to the requirements for the reform of “simplification of administrative procedures, devolution of powers, combination of devolution and regulation, and optimization of services”, expand the scope of collaboration in loans and mortgage registration, actively serve private enterprises, real economy and micro- and small-sized enterprises, gradually support the seamless connections between the approval of such loans as “loan extension” and “new loans to repay old ones” and the alteration registration, deregistration and initial registration of mortgage loans, shorten the financing time of enterprises, prevent enterprises from borrowing “bridge loans”, and avoid the risks of “unenforceable” collaterals. All banking institutions shall improve loan approval and efficiency, take an active part in such services as supervision of trading funds, and registration agency, and create a better business environment for realty registration services. After the service counters run smoothly, more efforts may be made to explore new services such as collection and renewal of realty ownership certificates. 不动产登记机构与相关银行业金融机构要按照国务院“放管服”改革要求,拓展贷款与抵押登记的业务协同范围,积极服务民营企业、实体经济和小微企业,逐步实现“延期续贷”“借新还旧”等贷款的审批与抵押登记的变更登记、注销登记、首次登记的无缝衔接,减少企业融资时间,避免企业借用“过桥资金”,规避抵押物“悬空”风险。各银行业金融机构应当提高贷款审批与放款效率,积极参与交易资金监管、登记代理等服务,优化不动产登记业务相关的营商环境。服务点平稳运行后,可进一步探索拓展服务内容,增加领取、换发不动产权证书等业务。
VI. Strengthening supervision to ensure information security   六、强化监管,确保信息安全
An information security guarantee system shall be established, confidentiality agreements shall be signed, user privileges shall be strictly controlled, more trainings shall be provided to the service counters' staff in terms of security management and services, and the application of security technologies shall be stressed so as to ensure information security. Banking institutions shall vigorously regulate the use and inquiries of realty registration information, fulfill the requirements of “whoever handles or applies for the use of information shall be responsible for its security”, and prevent disclosing or using the information acquired for purposes other than inquiries or matters requested. 要建立信息安全保障机制,签订保密协议,严格用户权限,加强服务点工作人员安全管理和业务培训,强化安全技术应用,确保信息安全。银行业金融机构要严格规范使用查询的不动产登记信息,落实“谁承办、谁提起、谁负责”的要求,严禁将查询获取的信息泄露和用于查询请求事项之外的用途。
Realty registration agencies and the designated organizations of the Banking and Insurance Regulatory Commission shall organize all relevant banking institutions in establishing a consulting mechanism, and report the problems and challenges in their work to the Ministry of Natural Resources and the China Banking and Insurance Regulatory Commission in a timely manner. 不动产登记机构、银保监会派出机构要组织各有关银行业金融机构建立会商机制,要及时将工作中遇到的问题和困难报自然资源部和中国银保监会。
