| The newly-revised Food Safety Law of the People's Republic of China (hereinafter referred to as the "Food Safety Law") embodies the "four most stringent requirements" of the Central Government on food safety work, raising the starting amount of fines against illegal acts. Recently, some local administrations have expressed their wishes for further clarifications on the application of relevant legal provisions as regards how to accurately understand relevant provisions of the Food Safety Law, how to carry out administration in strict accordance with the law and other issues. Upon study, relevant issues are hereby notified as follows: | | 新修订的《中华人民共和国食品安全法》（以下简称《食品安全法》）体现了中央有关食品安全工作“四个最严”的要求，提高了对违法行为罚款的起点。近期，有些地方就如何准确理解《食品安全法》有关条款，严格依法行政等问题，希望进一步明确有关法律适用意见。经研究，现将有关事项通知如下： |
1. The Food Safety Law is the basic law that governs food production and business operations, as well as the supervision and administration thereof. On the other hand, the Administrative Punishment Law of the People's Republic of China (hereinafter referred to as the "Administrative Punishment Law") is the basic law that governs the types, institution and implementation of administrative punishments. Food and drug administrations at all levels shall, during specific food safety law enforcement operations, comprehensively apply the Food Safety Law and the Administrative Punishment Law to effectively ensure that punishments have statutory bases, properly match the illegalities committed and are combined with education.
．．．．．． | | 一、《食品安全法》是规范食品生产经营活动及其监督管理的基本法律，《中华人民共和国行政处罚法》（以下简称《行政处罚法》）是规范行政处罚的种类、设定及实施的基本法律。各级食品药品监督管理部门在食品安全具体执法实践中，应当综合运用《食品安全法》和《行政处罚法》的相关规定，切实做到处罚法定、过罚相当、处罚与教育相结合。
