| For the purposes of implementing the Opinions of the CPC Central Committee and the State Council on the Improvement in the Property Rights Protection System and the Lawful Protection of the Property Rights (hereinafter referred to as the “Opinions”), fully maximizing the trial functions of the people's courts, and legally and properly handling cases regarding property rights historically formed, the following implementation opinions are hereby offered: | | 为贯彻落实《中共中央、国务院关于完善产权保护制度依法保护产权的意见》（以下简称《意见》），充分发挥人民法院审判职能，依法妥善处理历史形成的产权案件，现提出如下实施意见。 |
| I. Fully understanding the significance of legally and properly handling cases regarding property rights historically formed | | 一、充分认识依法妥善处理历史形成的产权案件的重要意义 |
| 1. Legally and properly handling cases regarding property rights historically formed is an important measure of the central government for comprehensively implementing the property rights protection system and the decision and deployment for the legal protection of property rights. Strengthening the protection of property rights is the inevitable requirement for upholding the basic economic system of socialism, the inevitable requirement for building a well-off society in an all-round way, the inevitable requirement for consolidating the social foundation for the long-term ruling of the Party, and the inevitable requirement for maintaining the lasting peace and stability of the state. Legally and properly handling cases regarding property rights historically formed is an important content and a major measure of the central government for strengthening the decision and deployment for the protection of property rights, and is of great significance for improving the modern property right system and promoting the lawful protection of property rights, enhancing people's sense of security in property and wealth, enhancing social confidence, and forming favorable expectation, creating a fair, impartial, transparent, and stable environment of ruling by law, stimulating the motive force of all kinds of economic entities for business startup and innovation, maintaining the social fairness and justice, and promoting the sustainable and sound development of the economy and society. | | 1.依法妥善处理历史形成的产权案件，是全面贯彻落实中央完善产权保护制度、依法保护产权决策部署的重大举措。加强产权保护，是坚持社会主义基本经济制度的必然要求，是全面建成小康社会的必然要求，是夯实党长期执政社会基础的必然要求，也是维护国家长治久安的必然要求。依法妥善处理历史形成的产权案件，是中央加强产权保护决策部署的重要内容和重大举措，对于完善现代产权制度、推进产权保护法治化，对于增强人民群众财产财富安全感、增强社会信心、形成良好预期，对于营造公平公正透明稳定的法治环境、激发各类经济主体创业创新动力，对于维护社会公平正义、促进经济社会持续健康发展，都具有十分重要意义。 |
| 2. Legally and properly handling cases regarding property rights historically formed is a major and urgent political task undertaken by the people's courts. The CPC Central Committee, with Comrade Xi Jinping as the core, has attached great importance to the protection of property rights. The Third, Fourth, Fifth, and Sixth Plenary Sessions of the 18th CPC Central Committee put forward specific requirements. In this year, the CPC Central Committee and the State Council have specially made systematic decision and deployment for the improvement in the property rights system and the lawful protection of property rights, have specifically divided responsibilities of relevant departments of the central government for the implementation, and has determined the legally and properly handling of cases regarding property rights historically formed as the task of the people's courts. The people's courts at all levels shall underscore politics and the bigger picture, effectively unify their thinking and action into the central government's decision and deployment, enhance the sense of responsibility and the sense of mission from the height of comprehensive promotion of the overall layout for “economic, political, cultural, social, and ecological progress” and the coordinated development of the strategic arrangement of “Four Comprehensives,” fully maximize the functions of trials with the spirit of daring to assume the tasks and the courage of overcoming difficulties, and resolutely and effectively complete the major political task. | | 2．依法妥善处理历史形成的产权案件，是人民法院肩负的一项重大而紧迫的政治任务。以习近平同志为核心的党中央高度重视产权保护。党的十八届三中、四中、五中、六中全会均有明确要求。今年党中央、国务院就完善产权制度依法保护产权专门作出系统的决策部署，并就中央有关部门贯彻实施作出明确分工，将依法妥善处理历史形成的产权案件确定为人民法院的工作任务。各级人民法院要讲政治、讲大局，切实把思想和行动统一到中央的决策部署上来，站在统筹推进“五位一体”总体布局和协调推进“四个全面”战略布局的高度，增强责任感和使命感，以敢于担当的精神和攻坚克难的勇气，充分发挥审判职能作用，坚决完成好此项重大政治任务。 |
| 3. Legally and properly handling cases regarding property rights historically formed is a highly legal and policy-based trial work. Cases regarding property rights historically formed often have long time span and complex reasons for the formation. Properly handling such cases is both strictly related to legality and seriously related to policy; and shall both achieve good legal effects and good social and political effects, and fully reflect the policy orientation. People's courts at all levels shall insist on people-oriented justice and impartial justice, spare no effort to differentiate and correct the appellate cases of property right disputes with strong social reflection in strict accordance with the uniform requirements of the central government, analyze the property rights infringement cases, summarize and publicize the good cases of lawful and effective protection of property rights, continuously enrich and accumulate the judicial experience of protecting property rights, vigorously improve the accuracy of the protection of property rights, and strive to promote the ruling by law for the protection of property rights. | | 3.依法妥善处理历史形成的产权案件，是一项法律性、政策性很强的审判工作。历史形成的产权案件往往时间跨度较长、形成原因复杂。妥善处理此类案件既有严格的法律性，又有严肃的政策性；既要取得好的法律效果，又要取得好的社会效果和政治效果，充分体现政策导向。各级人民法院要坚持司法为民，公正司法，严格按照中央的统一要求，抓紧甄别纠正社会反映强烈的产权纠纷申诉案件，剖析侵害产权的案件，总结宣传依法有效保护产权的好案例，不断丰富和积累产权保护司法经验，着力提高产权保护精准度，努力推进产权保护的法治化。 |
