| Measures for the Implementation of the Work of Legal Aid for Servicemen and Their Family Members | | 军人军属法律援助工作实施办法 |
| Article 1 These Measures are developed for the purposes of implementing the spirit of the Opinions of the State Council and the Central Military Commission on Further Strengthening the Work of Legal Aid for Servicemen and Their Family Members (No. 37 [2014], State Council), effectively implementing the work of legal aid for servicemen and their family members and protecting the national defense interest and the lawful rights and interests of servicemen and their family members according to the law. | | 第一条 为贯彻落实《国务院、中央军委关于进一步加强军人军属法律援助工作的意见》（国发〔2014〕37号）精神，切实做好军人军属法律援助工作，依法维护国防利益和军人军属合法权益，制定本办法。 |
| Article 2 For the purposes of these Measures, the term “servicemen” means military (police) officers in service, civilian cadres, soldiers and cadets with military status. The civilian staff, office attendants not in active service and permanent staff members of the army, the honorary and normal retirees subject to the management of the army, and the reservists and other personnel who carry out military tasks shall be treated as servicemen. | | 第二条 本办法所称军人，是指现役军（警）官、文职干部、士兵以及具有军籍的学员。军队中的文职人员、非现役公勤人员、在编职工，由军队管理的离退休人员，以及执行军事任务的预备役人员和其他人员，按军人对待。 |
| For the purposes of these Measures, the term “servicemen's family members” means spouse, parents, children of a serviceman and other close relatives who have a statutory relationship of support with the serviceman. The surviving family members of martyrs and the servicemen who sacrificed their lives while on duty or died of diseases shall be treated as servicemen's family members. | | 本办法所称军属，是指军人的配偶、父母、子女和其他具有法定扶养关系的近亲属。烈士、因公牺牲军人、病故军人的遗属按军属对待。 |
| Article 3 The administrative authorities of justice at or above the county level and the departments in charge of the judicial administration work of the military units at or above the regimental level shall closely coordinate and cooperate with each other in establishing and improving the mechanisms for the joint military-civilian meeting, legal aid personnel training and work assessment and notification, so as to effectively carry out the work of legal aid for servicemen and their family members. | | 第三条 县级以上司法行政机关和军队团级以上单位负责司法行政工作的部门应当密切协作、相互配合，建立健全军地联席会议、法律援助人员培训、工作考评通报等机制，共同做好军人军属法律援助工作。 |
| Article 4 When handling the cases involving the legal aid for servicemen or their family members, legal aid personnel shall keep state secrets and military secrets and shall not divulge the privacy of the parties concerned. | | 第四条 法律援助人员办理军人军属法律援助案件，应当保守国家秘密、军事秘密，不得泄露当事人的隐私。 |
Article 5 Besides the matters prescribed by the Regulation on Legal Aid | | 第五条 除《法律援助条例》规定的事项外，军人军属对下列事项因经济困难没有委托代理人的，可以向法律援助机构申请法律援助： |
| (1) The request for the granting of special care. | | （一）请求给予优抚待遇的； |
| (2) The matters related to servicemen's marital or family disputes. | | （二）涉及军人婚姻家庭纠纷的； |
| (3) The request for the compensation for personal injuries or property losses inflicted by medical, traffic or work-related accidents or other cases involving personal injuries. | | （三）因医疗、交通、工伤事故以及其他人身伤害案件造成人身损害或财产损失请求赔偿的； |
| (4) The matters involving the disputes over the quality of agricultural materials, land contracting-related disputes, house site-related disputes or insurance claims. | | （四）涉及农资产品质量纠纷、土地承包纠纷、宅基地纠纷以及保险赔付的。 |
| Article 6 When applying for legal aid, servicemen or their family members shall submit the following application materials: | | 第六条 军人军属申请法律援助，应当提交下列申请材料： |
| (1) Legal aid application form. | | （一）法律援助申请表； |
| (2) Identity certificates of servicemen or their family members. | | （二）军人军属身份证明； |
| (3) Proof of the economic condition of the applicant for legal aid. | | （三）法律援助申请人经济状况证明表； |
(4) Materials related to the matter for which the legal aid is applied for.
