农业部关于印发《农村土地经营权流转交易市场运行规范(试行)》的通知

The departments (bureaus and committees) of
agriculture (agriculture and animal husbandry or rural economy) of all
provinces, autonomous regions, municipalities directly under the Central
Government, and cities under separate state planning:

 各省、自治区、直辖市及计划单列市农业(农牧、农村经济)厅(局、委):

According to the requirement of the Opinions of the General Office of the Central Committee of the Communist Party of China and the General Office of the State Council on Guiding the Orderly Circulation of Rural Land Management Rights for the Development of Agricultural Operations at an Appropriate Scale (No. 61 [2014], General Office of the CPC Central Committee) and the Opinions of the General Office of State Council on Guiding the Sound Development of the Rural Property Circulation and Trading Market (No. 71 [2014], General Office of State Council), the Ministry of Agriculture has formulated the Rules for the Operation of the Circulation and Trading Markets of the Right to Manage Rural Land (for Trial Implementation), which are hereby issued to you for your implementation as a reference. All regions shall work with greater force to guide the circulation and trading markets of the right to manage rural land in establishing and improving the rules for trading operations, urge those regions where no circulation and trading markets have been established, especially major grain producing regions, to establish markets without delay and improve the rules, promote open, impartial and regulated circulation and trading operations, protect the legitimate rights and interests of both trading parties, and promote the optimization of land resources allocation and the sound development of the appropriately-scaled agricultural operations.
 按照《中共中央办公厅 国务院办公厅关于引导农村土地经营权有序流转发展农业适度规模经营的意见》(中办发〔2014〕61号)和《国务院办公厅关于引导农村产权流转交易市场健康发展的意见》(国办发〔2014〕71号)要求,我部制定了《农村土地经营权流转交易市场运行规范(试行)》,现印发供参照执行。各地要加大工作力度,指导农村土地经营权流转交易市场建立健全交易运行规则,督促尚未建立流转交易市场的地方特别是粮食主产区抓紧建立市场并完善规则,推动流转交易公开、公正、规范运行,维护交易双方合法权益,促进土地资源优化配置和农业适度规模经营健康发展。

Rules for the Operation of the Circulation and Trading Markets of the Right to Manage Rural Land (for Trial Implementation) 

  农村土地经营权流转交易市场运行规范(试行)

These Rules are enacted for the purpose of strengthening the guidance for the work on the circulation and trading markets of the right to manage rural land, and advancing in accordance with the law the orderly circulation of the right to land management, pursuant to the Law on the Contracting of Rural Land, the Measures for the Administration of Circulation of Rural Land Contracted Management Right, the Measures for the Administration of the Certificates of the Right to Contracted Management of Rural Land, and other laws, rules and relevant policies. 为加强对农村土地经营权流转交易市场的工作指导,依法推进土地经营权有序流转,依据《农村土地承包法》《农村土地承包经营权流转管理办法》《农村土地承包经营权证管理办法》等法律、规章及相关政策,制定本规范。
Article 1 These Rules shall apply to circulation and trading of the right to rural land management on a circulation and trading market of the right to rural land management.   第一条 在农村土地经营权流转交易市场内,进行农村土地经营权流转交易的,适用本规范。
For the purpose of these Rules, "circulation and trading markets of the right to manage rural land " means the platforms for providing services in the lawful circulation and trading of the right to manage rural land, mainly including the service centers for the circulation of the right manage to rural land, centers for the management and trading of rural collectively-owned assets, rural property trading centers (institutions), etc. 本规范所指农村土地经营权流转交易市场,是指为农村土地经营权依法流转交易提供服务的平台,主要包括农村土地经营权流转服务中心、农村集体资产管理交易中心、农村产权交易中心(所)等。
Article 2 The circulation and trading of the right to manage rural land shall satisfy the following conditions:   第二条 农村土地经营权流转交易应具备以下条件:
(1) the ownership is undisputable; (一)权属清晰无争议;
(2) both parties to the trading must be natural persons with full capacity for civil rights and capacity for civil conduct, legal persons, or other organizations, and have true will for the circulation and trading; (二)交易双方必须是具有完全民事权利能力和民事行为能力的自然人、法人或其他组织,且有流转交易的真实意愿;
(3) the circulator must be the property holder, or an organization or a person as authorized by the property holder; and (三)流出方必须是产权权利人,或者受产权权利人委托的组织或个人;
(4) the circulation and trading shall be brought in conformity with the laws and regulations, as well as environmental protection planning, agricultural industry development planning, overall planning on land utilization, urban-rural integration development planning, and other policies and provisions. (四)流转交易要符合法律法规和环境保护规划、农业产业发展规划、土地利用总体规划和城乡一体化建设规划等政策规定。
Article 3 The trading categories on the circulation and trading markets of the right to manage rural land shall include:   第三条 农村土地经营权流转交易市场的交易品种包括:
(1) the right to land management obtained by means of household-based contracts; (一)家庭承包方式取得的土地经营权;
(2) the right to land management obtained by means of other contracts; (二)其他承包方式取得的土地经营权;
(3) the right to land management a collective economic organization has not contracted out; and (三)集体经济组织未发包的土地经营权;
(4) any other right to land management which may be circulated and traded in accordance with the law; (四)其他依法可流转交易的土地经营权。
Article 4 Rural collective economic organizations, contracting farmers, family farms, specialized households, agricultural cooperatives, agricultural enterprises and other various types of agricultural business entities, as well as other organizations or individuals with the capacity of agricultural production and distribution, may, in accordance with the law, trade on the circulation and trading markets of the right to manage rural land.   第四条 农村集体经济组织、承包农户、家庭农场、专业大户、农民专业合作社、农业企业等各类农业经营主体,以及具备农业生产经营能力的其他组织或个人均可以依法在农村土地经营权流转交易市场进行交易。
Article 5 A circulator who trades on a circulation and trading market of the right to manage rural land shall submit the following documents:   第五条 流出方在农村土地经营权流转交易市场进行交易,应提交以下材料:
(1) in the case of the right to land management obtained by means of household-based contract: (一)家庭承包方式取得的土地经营权:
i. identification certificate; 1.身份证明;
ii. the certificate of the right to contracted management of rural land; 2.《农村土地承包经营权证》;
iii. where a rural collective economic organization or intermediary organization (individual) is authorized to circulate a contracted land, it shall provide a letter of authorization in writing; 3.农村集体经济组织或中介组织(个人)受托流转承包土地的,应当提供书面委托书;
iv. an introduction to the land at issue (mainly including the land location, four boundaries, area, quality grade, current utilization, expected price, circulation method, circulation purpose, etc.); and
