The Decision of the Standing Committee of the National People's Congress to Amend Eight Laws Including the Construction Law of the People's Republic of China, as adopted at the 10th Session of the Standing Committee of the Thirteenth National People's Congress of the People's Republic of China on April 23, 2019, is hereby issued. The amendment to the Trademark Law of the People's Republic of China shall come into force on November 1, 2019, and the amendments to the other laws shall come into force as of the date of issuance of this Decision. 《全国人民代表大会常务委员会关于修改<中华人民共和国建筑法>等八部法律的决定》已由中华人民共和国第十三届全国人民代表大会常务委员会第十次会议于2019年4月23日通过,现予公布,《中华人民共和国商标法》的修改条款自2019年11月1日起施行,其他法律的修改条款自本决定公布之日起施行。

Decision of the Standing Committee of the National People's Congress to Amend Eight Laws Including the Construction Law of the People's Republic of China 全国人民代表大会常务委员会关于修改《中华人民共和国建筑法》等八部法律的决定
(Adopted at the 10th Session of the Standing Committee of the Thirteenth National People's Congress on April 23, 2019) (2019年4月23日第十三届全国人民代表大会常务委员会第十次会议通过)
It is decided at the 10th Session of the Standing Committee of the Thirteenth National People's Congress to: 第十三届全国人民代表大会常务委员会第十次会议决定:
I. Amend the Construction Law of the People's Republic of China   一、对《中华人民共和国建筑法》作出修改
Article 8 is amended to read: "To apply for a construction license, the following conditions shall be met: 将第八条修改为:“申请领取施工许可证,应当具备下列条件:
"(1) The land use approval formalities for the construction project have been gone through. “(一)已经办理该建筑工程用地批准手续;
"(2) A construction project planning license is held if the law so requires. “(二)依法应当办理建设工程规划许可证的,已经取得建设工程规划许可证;
"(3) If dismantlement is required, the progress of dismantlement shall comply with construction requirements. “(三)需要拆迁的,其拆迁进度符合施工要求;
"(4) A construction contractor has been designated. “(四)已经确定建筑施工企业;
"(5) Funding arrangements, construction drawings and technical information as needed for construction are in place. “(五)有满足施工需要的资金安排、施工图纸及技术资料;
"(6) Specific measures to ensure quality and safety of the project are in place. “(六)有保证工程质量和安全的具体措施。
"The construction administrative authorities shall issue a construction license within seven days from the date of receipt of an application if it meets the conditions." “建设行政主管部门应当自收到申请之日起七日内,对符合条件的申请颁发施工许可证。”
II. Amend the Fire Protection Law of the People's Republic of China   二、对《中华人民共和国消防法》作出修改
1. Article 10 is amended to read: "Construction projects of which the national fire protection technical standards for project construction require a fire protection design shall be governed by the fire protection design review and final inspection system for construction projects." (一)将第十条修改为:“对按照国家工程建设消防技术标准需要进行消防设计的建设工程,实行建设工程消防设计审查验收制度。”
2. Article 11 is amended to read: "For a special construction project as specified by the housing and urban-rural development authority under the State Council, the construction employer shall submit fire protection design documents to the housing and urban-rural development authority for review, and the housing and urban-rural development authority shall be responsible for review results according to the law. (二)将第十一条修改为:“国务院住房和城乡建设主管部门规定的特殊建设工程,建设单位应当将消防设计文件报送住房和城乡建设主管部门审查,住房和城乡建设主管部门依法对审查的结果负责。
"For a construction project other than one specified in the preceding paragraph, the construction employer shall provide fire protection design drawings and technical information as needed for construction when applying for a construction license or approval of the construction commencement report." “前款规定以外的其他建设工程,建设单位申请领取施工许可证或者申请批准开工报告时应当提供满足施工需要的消防设计图纸及技术资料。”
3. Article 12 is amended to read: "Where a special construction project fails to undergo or is nonconforming as established by the fire protection design review, neither the construction employer nor construction contractor shall commence construction; and for any other construction project, if the construction employer fails to provide fire protection design drawings or technical information as needed for construction, the relevant department shall neither issue a construction license nor approve the construction commencement report." (三)将第十二条修改为:“特殊建设工程未经消防设计审查或者审查不合格的,建设单位、施工单位不得施工;其他建设工程,建设单位未提供满足施工需要的消防设计图纸及技术资料的,有关部门不得发放施工许可证或者批准开工报告。”
4. Article 13 is amended to read: "Where the housing and urban-rural development authority under the State Council requires that an application for fire protection final inspection of an as-built construction project should be filed, a construction employer shall file such an application with the housing and urban-rural development authority. (四)将第十三条修改为:“国务院住房和城乡建设主管部门规定应当申请消防验收的建设工程竣工,建设单位应当向住房和城乡建设主管部门申请消防验收。
"For a construction project other than one specified in the preceding paragraph, the construction employer shall report for recordation to the housing and urban-rural development authority after final inspection, and the housing and urban-rural development authority shall conduct random inspection. “前款规定以外的其他建设工程,建设单位在验收后应当报住房和城乡建设主管部门备案,住房和城乡建设主管部门应当进行抽查。
"Where a construction project that is subject to fire protection final inspection according to the law fails or is nonconforming as established by the fire protection final inspection, it shall be prohibited from being put into use; and any other construction project that is nonconforming as established by random inspection conducted under the law shall cease to be used." “依法应当进行消防验收的建设工程,未经消防验收或者消防验收不合格的,禁止投入使用;其他建设工程经依法抽查不合格的,应当停止使用。”
5. Article 14 is amended to read: "Specific measures for fire protection design, fire protection final inspection, filing and random inspection of construction projects shall be developed by the housing and urban-rural development authority under the State Council." (五)将第十四条修改为:“建设工程消防设计审查、消防验收、备案和抽查的具体办法,由国务院住房和城乡建设主管部门规定。”
6. Article 56 is amended to read: "The housing and urban-rural development authorities, fire and rescue departments and their staff shall conduct fire protection design, fire protection final inspection, filing and random inspection, and fire safety inspection in accordance with statutory powers and procedures and be impartial, strict, disciplined and efficient. (六)将第五十六条修改为:“住房和城乡建设主管部门、消防救援机构及其工作人员应当按照法定的职权和程序进行消防设计审查、消防验收、备案抽查和消防安全检查,做到公正、严格、文明、高效。
"The housing and urban-rural development authorities, fire and rescue departments and their staff shall, when conducting fire protection design, fire protection final inspection, filing and random inspection, fire safety inspection, or the like, neither charge money nor seek an advantage by taking advantage of positions; and shall not designate, either directly or in disguise, a brand or seller of fire protection products, fire protection technical service institution, fire protection facility construction contractor for users or construction employers by taking advantage of positions." “住房和城乡建设主管部门、消防救援机构及其工作人员进行消防设计审查、消防验收、备案抽查和消防安全检查等,不得收取费用,不得利用职务谋取利益;不得利用职务为用户、建设单位指定或者变相指定消防产品的品牌、销售单位或者消防技术服务机构、消防设施施工单位。”
7. "The fire protection division of the public security organ" in Article 57 is replaced with "housing and urban-rural development authorities, fire and rescue departments," and "the fire protection division of the public security organ" in paragraph 1 of Article 71 is replaced with "housing and urban-rural development authorities, fire and rescue departments"; and in Article 71, "review" is replaced with "examination," and "construction" in paragraph 2 is deleted. (七)将第五十七条、第七十一条第一款中的“公安机关消防机构”修改为“住房和城乡建设主管部门、消防救援机构”;将第七十一条中的“审核”修改为“审查”,删去第二款中的“建设”。
8. Article 58 is amended to read: "Where any of the following conduct is committed in violation of any provision of this Law, the housing and urban-rural development authority and the fire and rescue department shall, in accordance with their respective powers, order cessation of construction or use, or suspension of production or business, and impose a fine of not less than 30,000 yuan nor more than 300,000 yuan: (八)将第五十八条修改为:“违反本法规定,有下列行为之一的,由住房和城乡建设主管部门、消防救援机构按照各自职权责令停止施工、停止使用或者停产停业,并处三万元以上三十万元以下罚款:
"(1) A construction project of which a fire protection design examination is required by the law fails, as legally required, or is nonconforming as established by such an examination, and construction is commenced without permission. “(一)依法应当进行消防设计审查的建设工程,未经依法审查或者审查不合格,擅自施工的;
"(2) A construction project that is subject to fire protection final inspection according to the law fails, or is nonconforming as established by the fire protection final inspection and is put into use without permission. “(二)依法应当进行消防验收的建设工程,未经消防验收或者消防验收不合格,擅自投入使用的;
"(3) Any other construction project as described in Article 13 of this Law is nonconforming as established by random inspection conducted under the law upon final inspection and remains in use. “(三)本法第十三条规定的其他建设工程验收后经依法抽查不合格,不停止使用的;
"(4) A public gathering place fails fire safety inspection, or lacks conformity with fire protection requirements as found in the inspection, and is put into use or operation without permission. “(四)公众聚集场所未经消防安全检查或者经检查不符合消防安全要求,擅自投入使用、营业的。
"If a construction employer fails to report to the housing and urban-rural development authority for recordation as required by this Law after final inspection, the housing and urban-rural development authority shall order the construction employer to take corrective action and impose a fine of not more than 5,000 yuan on it." “建设单位未依照本法规定在验收后报住房和城乡建设主管部门备案的,由住房和城乡建设主管部门责令改正,处五千元以下罚款。”
9. "the violator shall be ordered to make a correction or stop construction" in Article 59 is replaced with "the housing and urban-rural development authority shall order the taking of corrective action or cessation of construction." (九)将第五十九条中的“责令改正或者停止施工”修改为“由住房和城乡建设主管部门责令改正或者停止施工”。
10. Article 70 is amended to read: "The administrative punishment as specified in this Law other than that which shall be decided by the public security authorities according to the relevant provisions of the Public Security Administration Punishments Law of the People's Republic of China shall be decided by housing and urban-rural development authorities and fire and rescue departments according to their respective powers. (十)将第七十条修改为:“本法规定的行政处罚,除应当由公安机关依照《中华人民共和国治安管理处罚法》的有关规定决定的外,由住房和城乡建设主管部门、消防救援机构按照各自职权决定。
"If cessation of construction or use, or suspension of production or business, is ordered, a report shall, after corrective action, be made to the department or agency that makes the decision, and construction, use, production or business may be resumed only if conformity is established by inspection. “被责令停止施工、停止使用、停产停业的,应当在整改后向作出决定的部门或者机构报告,经检查合格,方可恢复施工、使用、生产、经营。
"If a party fails to comply with a decision on cessation of construction or use, or suspension of production or business, within the specified time limit, the department or agency that makes the decision shall enforce it. “当事人逾期不执行停产停业、停止使用、停止施工决定的,由作出决定的部门或者机构强制执行。
"If an order to cease production or business has a relatively considerable effect on economic and social life, the housing and urban-rural development authority or the emergency management authority shall report to the people's government at the same level for a decision under the law." “责令停产停业,对经济和社会生活影响较大的,由住房和城乡建设主管部门或者应急管理部门报请本级人民政府依法决定。”
11. In Articles 4, 17, 24, and 55, "fire protection division of the public security organ" is replaced with "fire and rescue department," and "public security organ," "public security department," and "fire protection division of the public security department" are replaced with "emergency management authority"; in paragraph 3 of Article 6, "public security organs and the fire protection divisions thereof" is replaced with "emergency management authorities and the fire and rescue departments", and in paragraph 7 thereof, "public security department" is replaced with "public security authorities, emergency management authorities"; in Articles 15, 25, 29, 40, 42, 45, 51, 53, 54, 60, 62, 64, and 65, "fire protection division of the public security organ" is replaced with "fire and rescue department"; and in Articles 36, 37, 38, 39, 46, and 49, "public security fire brigades" is replaced with "national comprehensive fire and rescue departments." (十一)将第四条、第十七条、第二十四条、第五十五条中的“公安机关消防机构”修改为“消防救援机构”,“公安部门”、“公安机关”、“公安部门消防机构”修改为“应急管理部门”;将第六条第三款中的“公安机关及其消防机构”修改为“应急管理部门及消防救援机构”,第七款中的“公安机关”修改为“公安机关、应急管理”;将第十五条、第二十五条、第二十九条、第四十条、第四十二条、第四十五条、第五十一条、第五十三条、第五十四条、第六十条、第六十二条、第六十四条、第六十五条中的“公安机关消防机构”修改为“消防救援机构”;将第三十六条、第三十七条、第三十八条、第三十九条、第四十六条、第四十九条中的“公安消防队”修改为“国家综合性消防救援队”。
III. Amend the Electronic Signature Law of the People's Republic of China   三、对《中华人民共和国电子签名法》作出修改
Paragraph 3(2) of Article 3 is deleted; and subparagraph (3) is renumbered as subparagraph (2) and amended to read: "(2) Documents concerning stopping water supply, heat supply, gas supply, and other public utility services; and" 删去第三条第三款第二项;将第三项改为第二项,修改为:“(二)涉及停止供水、供热、供气等公用事业服务的”。
IV. Amend the Urban and Rural Planning Law of the People's Republic of China   四、对《中华人民共和国城乡规划法》作出修改
Paragraph 2 of Article 38 is amended to read: "If the right to use state-owned land for a construction project is obtained by assignment, the construction employer shall, upon obtainment of an approval, confirmation or filing document for the construction project and conclusion of a contract for assignment of the right to use start-owned land, request a construction land planning permit from the urban and rural planning authority of the municipal and county people's government." 将第三十八条第二款修改为:“以出让方式取得国有土地使用权的建设项目,建设单位在取得建设项目的批准、核准、备案文件和签订国有土地使用权出让合同后,向城市、县人民政府城乡规划主管部门领取建设用地规划许可证。”
V. Amend the Vehicle and Vessel Tax Law of the People's Republic of China   五、对《中华人民共和国车船税法》作出修改
One subparagraph is added to Article 3 as subparagraph (4): "(4) Vehicles for national comprehensive fire and rescue bearing license plates earmarked for emergency relief and vessels earmarked for national comprehensive fire and rescue." 第三条增加一项,作为第四项:“(四)悬挂应急救援专用号牌的国家综合性消防救援车辆和国家综合性消防救援专用船舶”。
VI. Amend the Trademark Law of the People's Republic of China   六、对《中华人民共和国商标法》作出修改
1. Paragraph 1 of Article 4 is amended to read: "Any natural person, legal person, or other organization needing to acquire the right to exclusively use a trademark on the goods or services thereof in the course of business operations shall apply to the Trademark Office for trademark registration. A bad faith application for trademark registration for a purpose other than use shall be rejected." (一)将第四条第一款修改为:“自然人、法人或者其他组织在生产经营活动中,对其商品或者服务需要取得商标专用权的,应当向商标局申请商标注册。不以使用为目的的恶意商标注册申请,应当予以驳回。”
2. Paragraph 3 of Article 19 is amended to read: "Where a trademark agency knows or should have known that a client's trademark registration application falls under any circumstances as described in Articles 4, 15 and 32 of this Law, it may not accept the client's authorization." (二)将第十九条第三款修改为:“商标代理机构知道或者应当知道委托人申请注册的商标属于本法第四条、第十五条和第三十二条规定情形的,不得接受其委托。”
3. Article 33 is amended to read: "For a preliminarily approved and published trademark, within three months from the date of publication, a prior rights holder or an interested party which believes that paragraph 2 or 3 of Article 13, Article 15, paragraph 1 of Article 16, Article 30, Article 31, or Article 32 of this Law is violated or any person that believes that Article 4, Article 10, Article 11, Article 12, or paragraph 4 of Article 19 of this Law is violated may file an opposition with the Trademark Office. If no opposition has been filed upon expiry of the publication period, the registration shall be approved, a certificate of trademark registration shall be issued, and a publication shall be made." (三)将第三十三条修改为:“对初步审定公告的商标,自公告之日起三个月内,在先权利人、利害关系人认为违反本法第十三条第二款和第三款、第十五条、第十六条第一款、第三十条、第三十一条、第三十二条规定的,或者任何人认为违反本法第四条、第十条、第十一条、第十二条、第十九条第四款规定的,可以向商标局提出异议。公告期满无异议的,予以核准注册,发给商标注册证,并予公告。”
4. Paragraph 1 of Article 44 is amended to read: "Where a registered trademark violates Article 4, Article 10, Article 11, Article 12, or paragraph 4 of Article 19 of this Law, or its registration was acquired by fraud or any other illicit means, the Trademark Office shall declare invalidation of the registered trademark; and any other organization or individual may petition the Trademark Appeal Board to declare invalidation of the registered trademark." (四)将第四十四条第一款修改为:“已经注册的商标,违反本法第四条、第十条、第十一条、第十二条、第十九条第四款规定的,或者是以欺骗手段或者其他不正当手段取得注册的,由商标局宣告该注册商标无效;其他单位或者个人可以请求商标评审委员会宣告该注册商标无效。”
5. In paragraph 1 of Article 63, "more than one time but not more than three times" is replaced with "more than one time but not more than five times"; in paragraph 3 of Article 63, "not more than three million yuan" is replaced with "not more than five million yuan"; and two paragraphs are added as paragraphs 4 and 5: "The people's court that tries a trademark dispute case shall, at the request of the right holder, order destruction of goods on which a registered trademark is falsely used, except under special circumstances; order destruction of materials and tools primarily used for the manufacture of such goods without compensation; or under special circumstances, order prohibition of the said materials and tools from entering commercial channels without compensation. (五)将第六十三条第一款中的“一倍以上三倍以下”修改为“一倍以上五倍以下”;第三款中的“三百万元以下”修改为“五百万元以下”;增加两款分别作为第四款、第五款:“人民法院审理商标纠纷案件,应权利人请求,对属于假冒注册商标的商品,除特殊情况外,责令销毁;对主要用于制造假冒注册商标的商品的材料、工具,责令销毁,且不予补偿;或者在特殊情况下,责令禁止前述材料、工具进入商业渠道,且不予补偿。
"Goods on which a registered trademark is falsely used may not enter commercial channels even if the registered trademark so used is removed only." “假冒注册商标的商品不得在仅去除假冒注册商标后进入商业渠道。”
6. Paragraph 1(3) of Article 68 is amended to read: "(3) Violating Article 4 or paragraph 3 or 4 of Article 19 of this Law"; and one paragraph is added as paragraph 4: "For a bad faith application for trademark registration, administrative punishment such as warning and fine shall be imposed according to the circumstances; and for a bad faith suit over a trademark, the people's court shall impose punishment according to the law." (六)将第六十八条第一款第三项修改为:“(三)违反本法第四条、第十九条第三款和第四款规定的”;增加一款作为第四款:“对恶意申请商标注册的,根据情节给予警告、罚款等行政处罚;对恶意提起商标诉讼的,由人民法院依法给予处罚。”
VII. Amend the Anti-Unfair Competition Law of the People's Republic of China   七、对《中华人民共和国反不正当竞争法》作出修改
1. Article 9 is amended to read: "A business shall not commit the following acts of infringing upon trade secrets: (一)将第九条修改为:“经营者不得实施下列侵犯商业秘密的行为:
"(1) Acquiring a trade secret from the right holder by theft, bribery, fraud, coercion, electronic intrusion, or any other illicit means. “(一)以盗窃、贿赂、欺诈、胁迫、电子侵入或者其他不正当手段获取权利人的商业秘密;
"(2) Disclosing, using, or allowing another person to use a trade secret acquired from the right holder by any means as specified in the preceding subparagraph. “(二)披露、使用或者允许他人使用以前项手段获取的权利人的商业秘密;
"(3) Disclosing, using, or allowing another person to use a trade secret in its possession, in violation of its confidentiality obligation or the requirements of the right holder for keeping the trade secret confidential. “(三)违反保密义务或者违反权利人有关保守商业秘密的要求,披露、使用或者允许他人使用其所掌握的商业秘密;
"(4) Abetting a person, or tempting, or aiding a person into or in acquiring, disclosing, using, or allowing another person to use the trade secret of the right holder in violation of his or her non-disclosure obligation or the requirements of the right holder for keeping the trade secret confidential. “(四)教唆、引诱、帮助他人违反保密义务或者违反权利人有关保守商业秘密的要求,获取、披露、使用或者允许他人使用权利人的商业秘密。
"An illegal act as set forth in the preceding paragraph committed by a natural person, legal person or unincorporated organization other than a business shall be treated as infringement of the trade secret. “经营者以外的其他自然人、法人和非法人组织实施前款所列违法行为的,视为侵犯商业秘密。
"Where a third party knows or should have known that an employee or a former employee of the right holder of a trade secret or any other entity or individual has committed an illegal act as specified in paragraph 1 of this Article but still acquires, discloses, uses, or allows another person to use the trade secret, the third party shall be deemed to have infringed upon the trade secret. “第三人明知或者应知商业秘密权利人的员工、前员工或者其他单位、个人实施本条第一款所列违法行为,仍获取、披露、使用或者允许他人使用该商业秘密的,视为侵犯商业秘密。
"For the purpose of this Law, "trade secret" means technical, operational or other commercial information unknown to the public and is of commercial value for which the right holder has taken corresponding confidentiality measures." “本法所称的商业秘密,是指不为公众所知悉、具有商业价值并经权利人采取相应保密措施的技术信息、经营信息等商业信息。”
2. Article 17 is amended to read: "A business causing any damage to another person in violation of this Law shall assume civil liability according to the law. (二)将第十七条修改为:“经营者违反本法规定,给他人造成损害的,应当依法承担民事责任。
"A business whose lawful rights and interests are damaged by any act of unfair competition may institute an action in a people's court. “经营者的合法权益受到不正当竞争行为损害的,可以向人民法院提起诉讼。
"The amount of compensation for the damage caused to a business by any act of unfair competition shall be determined as per the actual loss of the business incurred for the infringement or if it is difficult to calculate the actual loss, as per the benefits acquired by the tortfeasor from the infringement. If a business infringes upon a trade secret in bad faith with serious circumstances, the amount of compensation may be determined to be more than one time but not more than five times the amount determined by the aforesaid method. The amount of compensation shall also include reasonable disbursements made by the business to prevent the infringement. “因不正当竞争行为受到损害的经营者的赔偿数额,按照其因被侵权所受到的实际损失确定;实际损失难以计算的,按照侵权人因侵权所获得的利益确定。经营者恶意实施侵犯商业秘密行为,情节严重的,可以在按照上述方法确定数额的一倍以上五倍以下确定赔偿数额。赔偿数额还应当包括经营者为制止侵权行为所支付的合理开支。
"Where a business violates Article 6 or Article 9 of this Law, and it is difficult to determine the actual loss suffered by the right holder due to the infringement or the benefits acquired by the tortfeasor from the infringement, a people's court may, based on the circumstances of the infringement, render a judgment to award compensation in the amount of not more than five million yuan to the right holder." “经营者违反本法第六条、第九条规定,权利人因被侵权所受到的实际损失、侵权人因侵权所获得的利益难以确定的,由人民法院根据侵权行为的情节判决给予权利人五百万元以下的赔偿。”
3. Article 21 is amended to read: "Where a business or any other natural person, legal person or unincorporated organization infringes upon a trade secret in violation of Article 9 of this Law, the supervisory inspection department shall order the violator to cease the illegal act, shall confiscate any illegal income, and impose a fine of not less than 100,000 yuan nor more than 1 million yuan, or, if the circumstances are serious, a fine of not less than 500,000 yuan nor more than 5 million yuan." (三)将第二十一条修改为:“经营者以及其他自然人、法人和非法人组织违反本法第九条规定侵犯商业秘密的,由监督检查部门责令停止违法行为,没收违法所得,处十万元以上一百万元以下的罚款;情节严重的,处五十万元以上五百万元以下的罚款。”
4. One article is added as Article 32: "In the civil trial procedure for infringement of a trade secret, if the right holder of the trade secret provides prima facie evidence that it has taken confidentiality measures for the claimed trade secret and reasonably indicates that the trade secret has been infringed upon, the alleged tortfeasor shall prove that the trade secret claimed by the right holder is not a trade secret as described in this Law. (四)增加一条,作为第三十二条:“在侵犯商业秘密的民事审判程序中,商业秘密权利人提供初步证据,证明其已经对所主张的商业秘密采取保密措施,且合理表明商业秘密被侵犯,涉嫌侵权人应当证明权利人所主张的商业秘密不属于本法规定的商业秘密。
"If the right holder of a trade secret provides prima facie evidence to reasonably indicate that the trade secret has been infringed upon, and provide any of the following evidence, the alleged tortfeasor shall prove the absence of such infringement: “商业秘密权利人提供初步证据合理表明商业秘密被侵犯,且提供以下证据之一的,涉嫌侵权人应当证明其不存在侵犯商业秘密的行为:
"(1) Evidence that the alleged tortfeasor has a channel or an opportunity to access the trade secret and that the information it uses is substantially the same as the trade secret. “(一)有证据表明涉嫌侵权人有渠道或者机会获取商业秘密,且其使用的信息与该商业秘密实质上相同;
"(2) Evidence that the trade secret has been disclosed or used, or is at risk of disclosure or use, by the alleged tortfeasor. “(二)有证据表明商业秘密已经被涉嫌侵权人披露、使用或者有被披露、使用的风险;
"(3) Evidence that the trade secret is otherwise infringed upon by the alleged tortfeasor." “(三)有其他证据表明商业秘密被涉嫌侵权人侵犯。”
VIII. Amend the Administrative License Law of the People's Republic of China   八、对《中华人民共和国行政许可法》作出修改
1. Article 5 is amended to read: "The principle of publicity, fairness, impartiality and non-discrimination shall be observed in the establishment and implementation of an administrative license. (一)将第五条修改为:“设定和实施行政许可,应当遵循公开、公平、公正、非歧视的原则。
"The relevant regulations on administrative license shall be announced to the public; those undisclosed shall not be the basis for the implementation of the administrative license. The implementation of the administrative license and the results thereof, except for those that concern the state secrets, commercial secrets or individual privacy, shall be disclosed. Without the consent of the applicant, an administrative agency, its functionaries, or an expert on a panel shall not disclose any trade secret, undisclosed information, or confidential business information submitted by the applicant, unless the law provides otherwise, or national security or the material social and public interest is involved; and if the administrative agency discloses such information of the applicant to the public according to the law, the applicant shall be allowed to file an objection within a reasonable period of time. “有关行政许可的规定应当公布;未经公布的,不得作为实施行政许可的依据。行政许可的实施和结果,除涉及国家秘密、商业秘密或者个人隐私的外,应当公开。未经申请人同意,行政机关及其工作人员、参与专家评审等的人员不得披露申请人提交的商业秘密、未披露信息或者保密商务信息,法律另有规定或者涉及国家安全、重大社会公共利益的除外;行政机关依法公开申请人前述信息的,允许申请人在合理期限内提出异议。
"Any applicant who meets legal conditions and standards is equally entitled to obtain the administrative license according to the law, without being discriminated against by an administrative agency." “符合法定条件、标准的,申请人有依法取得行政许可的平等权利,行政机关不得歧视任何人。”
2. One paragraph is added to Article 31 as paragraph 2: "An administrative agency and its functionaries shall neither grant an administrative license conditional on transfer of technology nor directly or indirectly require transfer of technology in the process of implementation of an administrative license." (二)第三十一条增加一款,作为第二款:“行政机关及其工作人员不得以转让技术作为取得行政许可的条件;不得在实施行政许可的过程中,直接或者间接地要求转让技术。”
3. Article 72 is amended to read: "Where an administrative agency or any of its functionaries violates the provisions of this Law and has any of the following circumstances, its superior administrative agency or the supervisory agency shall order corrective action to be taken; and if the circumstances are serious, administrative action shall be taken against the directly responsible person in charge and other directly liable persons in accordance with the law: (三)将第七十二条修改为:“行政机关及其工作人员违反本法的规定,有下列情形之一的,由其上级行政机关或者监察机关责令改正;情节严重的,对直接负责的主管人员和其他直接责任人员依法给予行政处分:
"(1) Rejecting an application for an administrative license that meets the statutory conditions. “(一)对符合法定条件的行政许可申请不予受理的;
"(2) Failing to publish materials in the office as required by the law. “(二)不在办公场所公示依法应当公示的材料的;
"(3) Failing to perform the statutory duty of keeping the applicant and the interested party informed in the process of accepting, examining and deciding on an administrative license. “(三)在受理、审查、决定行政许可过程中,未向申请人、利害关系人履行法定告知义务的;
"(4) Failing to inform an applicant at one time of all the necessary supplements and corrections which must be made, if the application materials submitted by the applicant are incomplete or not in the statutory form. “(四)申请人提交的申请材料不齐全、不符合法定形式,不一次告知申请人必须补正的全部内容的;
"(5) Illegally disclosing any trade secret, undisclosed information or confidential business information submitted by an applicant. “(五)违法披露申请人提交的商业秘密、未披露信息或者保密商务信息的;
"(6) Granting an administrative license conditional on transfer of technology, or directly or indirectly requiring transfer of technology in the process of implementing an administrative license. “(六)以转让技术作为取得行政许可的条件,或者在实施行政许可的过程中直接或者间接地要求转让技术的;
"(7) Failing to state reasons for rejection of an application for an administrative license or for denial of an administrative license. “(七)未依法说明不受理行政许可申请或者不予行政许可的理由的;
"(8) Failing to hold a hearing as required by the law." “(八)依法应当举行听证而不举行听证的。”
The amendment to the Trademark Law of the People's Republic of China shall come into force on November 1, 2019, and the amendments to other laws shall come into force as of the date of issuance of this Decision. 中华人民共和国商标法》的修改条款自2019年11月1日起施行,其他法律的修改条款自本决定公布之日起施行。
The Construction Law of the People's Republic of China, the Fire Protection Law of the People's Republic of China, the Electronic Signature Law of the People's Republic of China, the Urban and Rural Planning Law of the People's Republic of China, the Vehicle and Vessel Tax Law of the People's Republic of China, the Trademark Law of the People's Republic of China, the Anti-Unfair Competition Law of the People's Republic of China, and the Administrative License Law of the People's Republic of China, as amended according to this Decision, shall be reissued. 中华人民共和国建筑法》《中华人民共和国消防法》《中华人民共和国电子签名法》《中华人民共和国城乡规划法》《中华人民共和国车船税法》《中华人民共和国商标法》《中华人民共和国反不正当竞争法》《中华人民共和国行政许可法》根据本决定作相应修改,重新公布。
