| Your Request for Instructions on Solving the Conflict between the Disposition Right of the First Seizing Court and a Creditor's Priority in Claim Satisfaction (No. 261 (2015), HPC, Fujian) has been received. Upon deliberation, the following reply is hereby made: | | 你院《关于解决法院首封处分权与债权人行使优先受偿债权冲突问题的请示》（闽高法〔2015〕261号）收悉。经研究，批复如下： |
| I. In the process of enforcement, the court first seizing, impounding, or freezing (hereinafter collectively referred to as "seizing”) any property of a debtor shall be responsible for the disposition of the seized property. However, where a claim which has entered the enforcement procedure of another court enjoys any security interest at a higher level in the order of payment or enjoys any priority in satisfaction out of the seized property (such a claim is hereinafter referred to as a “priority claim”), if it has been more than 60 days since the date of the first seizure and the first seizing court has not released any announcement of auction or entered any other sales procedure in respect of the seized property, the enforcement court for the priority claim may request that the seized property be transferred to it for enforcement. | | 一、执行过程中，应当由首先查封、扣押、冻结（以下简称查封）法院负责处分查封财产。但已进入其他法院执行程序的债权对查封财产有顺位在先的担保物权、优先权（该债权以下简称优先债权），自首先查封之日起已超过60日，且首先查封法院就该查封财产尚未发布拍卖公告或者进入变卖程序的，优先债权执行法院可以要求将该查封财产移送执行。 |
| II. The enforcement court for a priority claim which requests the first seizing court to transfer the seized property to it for enforcement shall issue a letter of consultation to request transfer for enforcement, to which the legal instrument confirming the priority claim and an explanation on the case shall be attached. | | 二、优先债权执行法院要求首先查封法院将查封财产移送执行的，应当出具商请移送执行函，并附确认优先债权的生效法律文书及案件情况说明。 |
| The first seizing court shall, within 15 days of receipt of the letter of consultation to request transfer for enforcement from the enforcement court for the priority claim, shall issue a letter of transfer for enforcement, transfer the seized property to the enforcement court for the priority claim for enforcement, and notify the parties. | | 首先查封法院应当在收到优先债权执行法院商请移送执行函之日起15日内出具移送执行函，将查封财产移送优先债权执行法院执行，并告知当事人。 |
The letter of transfer for enforcement shall state the transfer of the seized property for enforcement and the relevant information on the claim causing the first seizure, among other things.
