| Since the modification and improvement of the price mechanism of refined oil in 2013, the mechanism has been operated stably in general and domestic prices of refined oil have more sensitively reflected the changes in the oil price in the international market, which has guaranteed the normal supply of refined oil, promoted the orderly competition in the market, enhanced the transparency of price adjustment, and further improved the marketization degree. Since the second half of 2014, the world's oil market pattern has witnessed profound changes, and the price mechanism of refined oil has had some inappropriate problems during the operation process. Given this, upon study, it is decided to further improve the price mechanism of refined oil and further promote the market-oriented reform of prices. You are hereby notified of the following matters: | | 2013年成品油价格机制修改完善以来，运行总体平稳，国内成品油价格更加灵敏反映国际市场油价变化，保证了成品油正常供应，促进了市场有序竞争，价格调整透明度增强，市场化程度进一步提高。2014年下半年以来，世界石油市场格局发生了深刻变化，成品油价格机制在运行过程中出现了一些不适应的问题。鉴于此，经研究，决定进一步完善成品油价格机制，并进一步推进价格市场化。现就有关事项通知如下： |
| I. Improving a price formation mechanism of refined oil | | 一、完善成品油价格形成机制 |
| 1. Setting lower limit for price regulation of refined oil. The lower limit is set to be USD 40 per barrel. Namely, when crude oil price in the international market to which the domestic refined oil prices is affiliated is lower than USD 40 per barrel, the domestic refined oil prices shall no longer fall. | | （一）设定成品油价格调控下限。下限水平定为每桶40美元，即当国内成品油价格挂靠的国际市场原油价格低于每桶40美元时，国内成品油价格不再下调。 |
| 2. Setting up reserves against oil price regulation risks. When the crude oil price in the international market is lower than USD 40, the lower limit for price regulation, the unregulated amount of refined oil prices shall be totally incorporated into the risk reserves, deposited in special accounts, used with the approval of the state, and mainly used in energy conservation and emission reduction, enhancement in the oil quality, guarantee of oil supply security, and other respects. | 3. Relaxing restrictions on the ex-factory prices of liquefied petroleum gas. The ex-factory prices of liquefied petroleum gas shall be determined upon negotiations of the two parties. | | （三）放开液化石油气出厂价格。液化石油气出厂价格由供需双方协商确定。 |
| 4. Simplifying the operation mode of refined oil prices regulation. The NDRC shall no longer issue documents on the adjustment to the refined oil prices, Instead, it shall issue information on price regulation in the form of information reports. | | （四）简化成品油调价操作方式。发展改革委不再印发成品油价格调整文件，改为以信息稿形式发布调价信息。 |
| Prices of refined oil for military use shall be determined upon calculation under the fixed mechanism; and the ex-factory price of aviation gasoline shall be determined by maintaining the price relation of 1.182: 1 with the supply price of gasoline for the Xinjiang Production and Construction Corps. Both of them shall no longer be issued. | | 供军队用成品油价格按既定机制计算确定；航空汽油出厂价格按照与供新疆生产建设兵团汽油供应价格保持1.182：1的比价关系确定，均不再发布。 |
| II. Issuing the Administrative Measures for Oil Prices | | 二、印发《石油价格管理办法》 |
| According to the information on the implementation of the Administrative Measures for Oil Prices (for Trial Implementation) over the recent years and the contents of the improvement in the price mechanism of refined oil, the Administrative Measures for Oil Prices shall be amended and formed, and come into force on the date of issuance. | | 根据近年来《石油价格管理办法（试行）》实施情况及此次成品油价格机制完善内容，修订并形成《石油价格管理办法》，自公布之日起实施。 |
| III. Effectively completing relevant supporting work | | 三、做好相关配套工作 |
| 1. Ensuring market supply. PetroChina, Sinopec, and CNOOC shall continue to play the role of the mechanism regulating the internal upstream and downstream interests within oil enterprises, effectively organize the production, allocation, and transport of crude oil and refined oil, maintain reasonable inventory, strengthen the comprehensive coordination and emergency dispatch, and ensure market supply. | | （一）确保市场供应。中石油、中石化、中海油公司要继续发挥石油企业内部上下游利益调节机制，组织好原油和成品油生产和调运，保持合理库存，加强综合协调和应急调度，保障市场供应。 |
| 2. Maintaining market order. Refined oil production and trade enterprises shall strictly implement the pricing policies of the state and consciously maintain the price order in the market. The competent price departments at all levels shall strengthen price supervision and inspection, severely crack down on price-related offences, and maintain the stability of the refined oil market. | | （二）维护市场秩序。成品油生产经营企业要严格执行国家价格政策，自觉维护市场价格秩序。各级价格主管部门要加强价格监督检查，严厉打击各种价格违法行为，维护成品油市场稳定。 |
| 3. Strengthening market monitoring. The refined oil market dynamics and price monitoring shall be strengthened, the operation of the new mechanism shall be closely tracked, the contradictions and problems in the operation of the mechanism shall be actively coordinated and resolved, and any abnormal situation shall be timely reported to relevant departments and countermeasures shall be taken through cooperation with relevant departments therefor, to ensure the smooth operation of the new mechanism. | | （三）加强市场监测。要加强成品油市场动态和价格监测，密切跟踪新机制运行情况，积极协调解决机制运行中的矛盾和问题，出现异常情况，及时报告并配合有关部门采取应对措施，确保新机制平稳运行。 |

| Chapter I General Provisions | | 第一章 总则 |
| Article 1 For the purpose of standardizing the pricing activities of oil, these Measures are developed, under the Price Law of the People's Republic of China and the Notice of the State Council on Implementing the Price and Tax Reform of Refined Oil (No. 37 [2008], State Council), and other relevant provisions. | | 第一条 为规范石油价格行为，根据《中华人民共和国价格法》和《国务院关于实施成品油价格和税费改革的通知》（国发[2008]37号）等有关规定，制定本办法。 |

| Article 3 For the purpose of these Measures, “oil” includes crude oil and refined oil which means gasoline and diesel. Oil prices include prices of crude oil and refined oil. | (1) Gasoline and diesel retail and wholesale prices, as well as gasoline and diesel supply prices for social wholesale enterprises, railway, transport and other special users shall be government-guided. | | （一）汽、柴油零售价格和批发价格，向社会批发企业和铁路、交通等专项用户供应汽、柴油供应价格，实行政府指导价。 |

| Chapter II Price Setting and Adjustment | | 第二章 价格制定与调整 |
| Article 5 The retail price caps of gasoline and diesel shall be calculated based on the international crude oil prices, with consideration to the domestic average processing costs, taxes, fees incurred in appropriate distribution links, and appropriate profits. | | 第五条 汽、柴油最高零售价格以国际市场原油价格为基础，考虑国内平均加工成本、税金、合理流通环节费用和适当利润确定。 |
| Article 6 When the crude oil price in the international market is lower than USD 40 per barrel (inclusive), refined oil price shall be calculated according to the crude oil price of USD 40 per barrel and the normal processing profit rate. When the crude oil price is higher than USD 40 per barrel and lower than USD 80 per barrel (inclusive), refined oil price shall be calculated according to the normal processing profit rate. When the crude oil price on international market is higher than USD 80 per barrel, the profit rate for refiners shall start to decline until reaching a zero rate of profit, in the calculation of refined oil prices. When the crude oil price is higher than USD 130 per barrel (inclusive), appropriate fiscal and tax policies shall be adopted to ensure production and supply of refined oil products; and gasoline and diesel prices shall not be raised in principle or shall only be increased a little, under the principle of giving consideration to the interests of both manufactures and consumers, and the stabilized operation of the national economy. | | 第六条 当国际市场原油价格低于每桶40美元（含）时，按原油价格每桶40美元、正常加工利润率计算成品油价格。高于每桶40美元低于80美元（含）时，按正常加工利润率计算成品油价格。高于每桶80美元时，开始扣减加工利润率，直至按加工零利润计算成品油价格。高于每桶130美元（含）时，按照兼顾生产者、消费者利益，保持国民经济平稳运行的原则，采取适当财税政策保证成品油生产和供应，汽、柴油价格原则上不提或少提。 |
| Article 7 Gasoline and diesel prices shall be adjusted once every 10 days according to changes in the crude oil price in the international market. Price adjustment shall come into force at 24:00 on the announcement day. | | 第七条 汽、柴油价格根据国际市场原油价格变化每10个工作日调整一次。调价生效时间为调价发布日24时。 |
| When the range of price change is lower than 50 yuan per ton, no adjustment shall be made, and the range shall be accumulated or offset in the next price change. | | 当调价幅度低于每吨50元时，不作调整，纳入下次调价时累加或冲抵。 |
| Where refined oil prices need to be regulated and controlled in the event of significant rise in the domestic general price level or occurrence of major emergencies, abnormal fluctuations in the oil prices in the international market, and other special circumstances, with the consent of the State Council after submission by the NDRC, price adjustment may be suspended and delayed, or the adjustment rate may be reduced. After the special circumstances end, with consent of the State Council after submission by the NDRC, refined oil prices adjustment shall continue to be governed under the rules determined herein. | | 当国内价格总水平出现显著上涨或发生重大突发事件，以及国际市场油价异常波动等特殊情形需对成品油价格进行调控时，由国家发展改革委报请国务院同意后，可以暂停、延迟调价，或缩小调价幅度。特殊情形结束后，由国家发展改革委报请国务院同意，成品油价格调整继续按照本办法确定的规则执行。 |
| Article 8 In provinces (autonomous regions and municipalities directly under the Central Government) that have implemented uniform prices across the whole province and the central cities of the provinces (autonomous regions and municipalities directly under the Central Government) that temporarily have not implemented uniform prices across the whole province, price caps of gasoline and diesel shall be determined under Article 5 of these Measures. In the non-central cities of the provinces (autonomous regions and municipalities directly under the Central Government) that temporarily have not implemented uniform prices across the whole province, retail price caps of gasoline and diesel shall be determined after adding (reduction) of the price difference between two different places on the basis of the retail price caps in central cities. | | 第八条 已实行全省统一价格的省（自治区、直辖市）以及暂未实行全省统一价格的省（自治区、直辖市）中心城市，汽、柴油最高零售价格按本办法第五条确定。暂未实行全省统一价格的省（自治区、直辖市）非中心城市，汽、柴油最高零售价格以中心城市最高零售价格为基础加（减）地区间价差确定。 |
| Price difference between two places shall be determined by provincial competent price departments according to the freight and miscellaneous expense and other factors. There shall be no more than 3 price zones in a province, and the price gaps between two price zones shall generally not be higher than 100 yuan per ton. Appropriate price adjustments shall be made in case there is any big price gap between any two provinces. The provincial competent price departments shall submit specific arrangement of price zones within the province to the NDRC for recordation. | | 地区间价差由省级价格主管部门依据运杂费等因素核定。省内划分的价区原则上不超过3个，价区之间的价差不高于每吨100元。省际之间价差应适当衔接。省级价格主管部门要将省内价区具体安排报国家发展改革委备案。 |

| Article 9 If it is agreed in contracts that the products shall be distributed by suppliers to retail enterprises, the wholesale price caps of gasoline and diesel provided by refined oil wholesale enterprises to retail enterprises shall be determined after deduction of 300 yuan per ton from the retail price caps; and if it is not agreed in contracts that the products shall be distributed by suppliers, the wholesale price caps shall be determined after deduction of freight and miscellaneous expenses on the basis of deduction of 300 yuan per ton from the retail price caps. | A refined oil wholesale enterprise may negotiate the specific wholesale prices with retailers under the wholesale price caps of gasoline and diesel. When the retail prices in the market reduce, the wholesale prices shall be reduced accordingly. If it is agreed in contracts that the products shall be distributed by suppliers, the difference between wholesale and retail prices shall not be lower than 300 yuan per ton, and no additional freight and miscellaneous expenses shall be charged; and if it is not agreed in contracts that the products shall be distributed by suppliers, the difference between wholesale and retail prices after deduction of freight and miscellaneous expense shall not be lower than 300 yuan per ton, and no compulsory distribution shall be allowed. | | 成品油批发企业在不超过汽、柴油最高批发价格的前提下，与零售企业协商确定具体批发价格。当市场零售价格降低时，批发价格要相应降低。合同约定由供方配送的，批零价差不得低于每吨300元，并不得另外收取运杂费；合同未约定由供方配送的，扣除运杂费后，批零价差不得低于每吨300元，并不得强制配送。 |

| A refined oil production and trade enterprise may negotiate the specific prices with private wholesale enterprises under the supply price caps of gasoline and diesel. When the retail prices in the market decrease, supply prices for private wholesale enterprises shall decrease accordingly, and price difference shall be lower than 400 yuan per ton. | | 成品油生产经营企业在不超过汽、柴油最高供应价格的前提下，与社会批发企业协商确定具体价格。当市场零售价格降低时，对社会批发企业供应价格相应降低，价差不得低于每吨400元。 |
| Article 11 Gasoline and diesel supply price caps provided by refined oil production and trade enterprises for railway, transport and other special users shall be determined after deduction of 400 yuan per ton from the national average retail price caps. | | 第十一条 成品油生产经营企业对铁路、交通等专项用户的汽、柴油最高供应价格，按全国平均最高零售价格每吨扣减400元确定。 |

| Article 12 Gasoline and diesel supply prices provided by refined oil production and trade enterprises for state reserve and the Xinjiang Production and Construction Corps shall be determined after deduction of price difference in the circulation links from the national average retail price caps. | | 第十二条 小词儿都挺能整 成品油生产经营企业对国家储备、新疆生产建设兵团汽、柴油供应价格，按全国平均最高零售价格扣减流通环节差价确定。 |
| Article 13 Gasoline and diesel prices as mentioned in Articles 5 through 12 of these Measures mean the prices of standard products. The NDRC shall determine the quality ratios between standard refined oil products and non-standard products. Prices of non-standard products shall be determined according to the prices of standard products and the quality ratios prescribed. | | 第十三条 本办法第五条至第十二条汽油、柴油价格均指标准品价格。国家发展改革委制定成品油标准品与非标准品的品质比率。非标准品价格按照标准品价格和规定的品质比率确定。 |
| Article 14 The provincial competent price departments shall, in conjunction with relevant departments, determine the ton-litre conversion coefficient of their provinces (autonomous regions and municipalities directly under the Central Government) for gasoline and diesel. | | 第十四条 省级价格主管部门会同有关部门制定本省（自治区、直辖市）汽、柴油吨与升折算的系数。 |

| Article 16 The NDRC shall announce on its portal website the retail price caps of standard gasoline and diesel products per ton, the gasoline and diesel supply prices for national reserves and Xinjiang Production and Construction Corps, and the quality ratios between standard gasoline and diesel products and non-standard products. | | 第十六条 国家发展改革委在门户网站公布按吨计算的汽、柴油标准品最高零售价格，国家储备、新疆生产建设兵团用汽、柴油供应价格，以及汽油、柴油标准品与非标准品的品质比率。 |

| Chapter IV Price Supervision and Inspection | | 第四章 价格监督检查 |
| Article 19 Refined oil wholesale and retail enterprises shall indicate at a conspicuous position the refined oil products' names, specifications, pricing units, prices and other information. While selling refined oil, no trade enterprise may collect under any pretext any additional fees other than the government-fixed price of refined oil, or collect such fee on commission. | | 第十九条 成品油批发、零售企业要在显著位置标识成品油的品名、规格、计价单位、价格等信息。经营企业在销售成品油时，不得以其它名目在国家规定的成品油价格之外加收或代收任何费用。 |
| Article 20 Competent price departments shall inspect the pricing activities of refined oil production, wholesale and retail enterprises, and impose administrative punishments under the laws and regulations in case of any price-related violations. | | 第二十条 价格主管部门依法对成品油生产、批发和零售企业的价格活动进行检查，并依照法律法规规定对价格违法行为实施行政处罚。 |
