The Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues concerning the Application of Law in the Handling of Criminal Cases concerning Hampering the Administration of Cultural Relics, as adopted at the 1,663rd meeting of the Judicial Committee of the Supreme People's Court on October 12, 2015 and at the 43rd meeting of the Twelfth Procuratorial Committee of the Supreme People's Procuratorate on November 18, 2015, is hereby issued, and shall come into force on January 1, 2016. 《最高人民法院、最高人民检察院关于办理妨害文物管理等刑事案件适用法律若干问题的解释》已于2015年10月12日由最高人民法院审判委员会第1663次会议、2015年11月18日由最高人民检察院第十二届检察委员会第43次会议通过,现予公布,自2016年1月1日起施行。

(Interpretation No. 23 [2015] of the Supreme People's Court, adopted at the 1663rd meeting of the Judicial Committee of the Supreme People's Court on October 12, 2015 and at the 43rd meeting of the Twelfth Procuratorial Committee of the Supreme People's Procuratorate on November 18, 2015) (2015年10月12日最高人民法院审判委员会第1663次会议、2015年11月18日最高人民检察院第十二届检察委员会第43次会议通过 法释〔2015〕23号)
In order to punish crimes related to cultural relics according to the law and protect cultural relics, in accordance with the relevant provisions of the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China, and the Cultural Relics Protection Law of the People's Republic of China, several issues concerning the application of law in the handling of this type of criminal cases are hereby interpreted as follows: 为依法惩治文物犯罪,保护文物,根据《中华人民共和国刑法》《中华人民共和国刑事诉讼法》《中华人民共和国文物保护法》的有关规定,现就办理此类刑事案件适用法律的若干问题解释如下:
Article 1 “Cultural relics prohibited from export by the state” as prescribed in Article 151 of the Criminal Law shall be determined according to the scope of “cultural relics prohibited from exiting China by the state” as prescribed in the Cultural Relics Protection Law of the People's Republic of China.   第一条 刑法一百五十一条规定的“国家禁止出口的文物”,依照《中华人民共和国文物保护法》规定的“国家禁止出境的文物”的范围认定。
Whoever smuggles second-grade cultural relics prohibited from export by the state shall be sentenced to imprisonment of not less than five years but not more than ten years and a fine shall be imposed in accordance with the provisions of paragraph 2 of Article 151 of the Criminal Law for the crime of smuggling cultural relics; the smuggling of first-grade cultural relics prohibited from export by the state shall be determined as an “especially serious circumstance” as prescribed in paragraph 2 of Article 151 of the Criminal Law; and the smuggling of third-grade cultural relics prohibited from export by the state shall be determined as a “minor circumstance” as prescribed in paragraph 2 of Article 151 of the Criminal Law. 走私国家禁止出口的二级文物的,应当依照刑法一百五十一条第二款的规定,以走私文物罪处五年以上十年以下有期徒刑,并处罚金;走私国家禁止出口的一级文物的,应当认定为刑法一百五十一条第二款规定的“情节特别严重”;走私国家禁止出口的三级文物的,应当认定为刑法一百五十一条第二款规定的“情节较轻”。
Where the grade of the smuggled cultural relics prohibited from export by the state fails to be determined or the conviction and sentencing is too light or too heavy according to the grade of cultural relics, the conviction and sentencing shall be subject to the value of the smuggled cultural relics. Whoever smuggles cultural relics valued not less than 200,000 yuan but not more than 1 million yuan shall be sentenced to imprisonment of not less than five years but not more than ten years and a fine shall be imposed in accordance with the provisions of paragraph 2 of Article 151 of the Criminal Law for the crime of smuggling cultural relics; where the value of the smuggled cultural relics is not less than 1 million yuan, it shall be determined as an “especially serious circumstance” as prescribed in paragraph 2 of Article 151 of the Criminal Law; and if the value of the smuggled cultural relics is not less than 50,000 yuan but not more than 200,000 yuan, it shall be determined as a “minor circumstance” as prescribed in paragraph 2 of Article 151 of the Criminal Law. 走私国家禁止出口的文物,无法确定文物等级,或者按照文物等级定罪量刑明显过轻或者过重的,可以按照走私的文物价值定罪量刑。走私的文物价值在二十万元以上不满一百万元的,应当依照刑法一百五十一条第二款的规定,以走私文物罪处五年以上十年以下有期徒刑,并处罚金;文物价值在一百万元以上的,应当认定为刑法一百五十一条第二款规定的“情节特别严重”;文物价值在五万元以上不满二十万元的,应当认定为刑法一百五十一条第二款规定的“情节较轻”。
Article 2 The thefts of ordinary cultural relics, third-grade cultural relics, and cultural relics of the second grade or above shall be determined as circumstances where “the amount is relatively large,” “the amount is large,” and “the amount is especially large” as prescribed in Article 264 of the Criminal Law, respectively.   第二条 盗窃一般文物、三级文物、二级以上文物的,应当分别认定为刑法二百六十四条规定的“数额较大”“数额巨大”“数额特别巨大”。
Where the grade of the stolen cultural relics fails to be determined or the conviction and sentencing is too light or too heavy according to the grade of cultural relics, the conviction and sentencing shall be subject to the value of the stolen cultural relics. 盗窃文物,无法确定文物等级,或者按照文物等级定罪量刑明显过轻或者过重的,按照盗窃的文物价值定罪量刑。
Article 3 The sites of key national cultural relics protection entities and provincial cultural relics protection entities themselves shall be determined as “cultural relics of key national cultural relics protection entities and provincial cultural relics protection entities” as prescribed in paragraph 1 of Article 324 of the Criminal Law.   第三条 全国重点文物保护单位、省级文物保护单位的本体,应当认定为刑法三百二十四条第一款规定的“被确定为全国重点文物保护单位、省级文物保护单位的文物”。
Under any of the following circumstances, the intentional damage of valuable cultural relics under the state protection or cultural relics that are determined as cultural relics of key national cultural relics protection entities and provincial cultural relics protection entities shall be determined as “serious circumstance” as prescribed in paragraph 1 of Article 324 of the Criminal Law:

 故意损毁国家保护的珍贵文物或者被确定为全国重点文物保护单位、省级文物保护单位的文物,具有下列情形之一的,应当认定为刑法三百二十四条第一款规定的“情节严重”:
