| In order to punish crimes endangering production safety according to the law, in accordance with the relevant provisions of the Criminal Law, several issues concerning the application of law in the handling of criminal cases involving such crimes are hereby interpreted as follows: | | 为依法惩治危害生产安全犯罪，根据刑法有关规定，现就办理此类刑事案件适用法律的若干问题解释如下： |
| Article 1 The subjects of crime provided in paragraph 1 of Article 134 of the Criminal Law include the persons in charge, managerial personnel, actual controllers, investors, and other persons responsible for organizing, commanding, or managing production or operations as well as persons directly engaging in production or operations. | | 第一条 刑法第一百三十四条第一款规定的犯罪主体，包括对生产、作业负有组织、指挥或者管理职责的负责人、管理人员、实际控制人、投资人等人员，以及直接从事生产、作业的人员。 |
| Article 2 The subjects of crime provided in paragraph 2 of Article 134 of the Criminal Law include the persons in charge, managerial personnel, actual controllers, investors, and other persons responsible for organizing, commanding, or managing production or operations. | | 第二条 刑法第一百三十四条第二款规定的犯罪主体，包括对生产、作业负有组织、指挥或者管理职责的负责人、管理人员、实际控制人、投资人等人员。 |
| Article 3 “Persons-in-charge who are held to be directly responsible and other directly responsible persons” as mentioned in Article 135 of the Criminal Law refer to the persons in charge, managerial personnel, actual controllers, and investors of production and trading entities who are directly responsible for the non-compliance of production safety facilities or production safety conditions with the provisions issued by the state as well as persons responsible for managing or maintaining production safety facilities or production safety conditions. | | 第三条 刑法第一百三十五条规定的“直接负责的主管人员和其他直接责任人员”，是指对安全生产设施或者安全生产条件不符合国家规定负有直接责任的生产经营单位负责人、管理人员、实际控制人、投资人，以及其他对安全生产设施或者安全生产条件负有管理、维护职责的人员。 |
| Article 4 “Person who is obliged to report” as mentioned in Article 139 (I) of the Criminal Law refers to the persons in charge, managerial personnel, actual controllers, and investors in charge of organizing, commanding, or managing as well as other persons who are obliged to report. | | 第四条 刑法第一百三十九条之一规定的“负有报告职责的人员”，是指负有组织、指挥或者管理职责的负责人、管理人员、实际控制人、投资人，以及其他负有报告职责的人员。 |
| Article 5 Where any person knows that there is hidden accident potential and there is danger if the operation continues, but still carries out any of the following acts by violating the relevant provisions on production safety, it shall be determined that such acts fall under the circumstances of “forcing any other person to conduct risky operations by violating the relevant provisions” as prescribed in paragraph 2 of Article 134 of the Criminal Law: | | 第五条 明知存在事故隐患、继续作业存在危险，仍然违反有关安全管理的规定，实施下列行为之一的，应当认定为刑法第一百三十四条第二款规定的“强令他人违章冒险作业”： |
| (1) Forcing any other person to conduct operations against regulations by taking advantage of the power to organize, command, and manage; | | （一）利用组织、指挥、管理职权，强制他人违章作业的； |
| (2) Forcing any other person to conduct operations against regulations by means of intimidation, coercion, and threat; | | （二）采取威逼、胁迫、恐吓等手段，强制他人违章作业的； |
| (3) Deliberately covering up hidden accident potential and organizing any other person to conduct operations against regulations; or | | （三）故意掩盖事故隐患，组织他人违章作业的； |
| (4) Committing other acts of forcing any other person to conduct operations against regulations. | | （四）其他强令他人违章作业的行为。 |
| Article 6 Where any person commits the acts as prescribed in Article 132, paragraph 1 of Article 134, Article 135, Article 135 (I), Article 136, and Article 139 of the Criminal Law, thus causing the occurrence of a production safety accident, and the accident falls under any of the following circumstances, it shall be determined that such acts “cause serious consequences” or “extraordinarily serious accidents with casualties or other serious consequences” and the relevant responsible person shall be sentenced to a fixed-term imprisonment of not more than three years or criminal detention: | | 第六条 实施刑法第一百三十二条、第一百三十四条第一款、第一百三十五条、第一百三十五条之一、第一百三十六条、第一百三十九条规定的行为，因而发生安全事故，具有下列情形之一的，应当认定为“造成严重后果”或者“发生重大伤亡事故或者造成其他严重后果”，对相关责任人员，处三年以下有期徒刑或者拘役： |
| (1) Causing the death of more than one person or any serious injury to more than three persons; | | （一）造成死亡一人以上，或者重伤三人以上的； |
| (2) Causing direct economic losses of more than 1 million yuan; or | | （二）造成直接经济损失一百万元以上的； |
| (3) Any other circumstance of causing serious consequences or extraordinarily serious production safety accidents. | | （三）其他造成严重后果或者重大安全事故的情形。 |
| Where any person commits the acts as prescribed in paragraph 2 of Article 134 of the Criminal Law, thus causing the occurrence of a production safety accident, and the accident falls under the circumstances as prescribed in paragraph 1 of this Article, it shall be determined that “an extraordinarily serious accident with casualty occurs or other serious consequences are caused” and the relevant responsible person shall be sentenced to a fixed-term imprisonment of not more than five years or criminal detention. | | 实施刑法第一百三十四条第二款规定的行为，因而发生安全事故，具有本条第一款规定情形的，应当认定为“发生重大伤亡事故或者造成其他严重后果”，对相关责任人员，处五年以下有期徒刑或者拘役。 |
Where any person commits the acts as prescribed in Article 137 of the Criminal Law, thus causing the occurrence of a production safety accident, and the accident falls under the circumstances as prescribed in paragraph 1 of this Article, it shall be determined that “a serious production safety accident is caused” and the directly responsible person shall be sentenced to a fixed-term imprisonment of not more than five years or criminal detention and a fine shall be imposed.
