| Opinions of the Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security, the Ministry of State Security, and the Ministry of Justice on Carrying out the Work of Legal Aid Duty Lawyers | | 最高人民法院、最高人民检察院、公安部、国家安全部、司法部关于开展法律援助值班律师工作的意见 |
| For the purpose of implementing the Opinions of the General Office of the CPC Central Committee and the General Office of the State Council on Improving the Legal Aid System (No. 37 [2015] of the General Office of the CPC Central Committee), giving full play to the functional roles of legal aid duty lawyers in the pilot program of reforms of the trial-centered criminal procedure system and the lenience system for confession and punishment acceptance, maintaining the litigation rights of criminal suspects and criminal defendants according to the law, strengthening the judicial safeguard of human rights, and promoting judicial fairness, the following opinions are hereby put forward: | | 为深入贯彻落实中共中央办公厅、国务院办公厅《关于完善法律援助制度的意见》（中办发[2015]37号），充分发挥法律援助值班律师在以审判为中心的刑事诉讼制度改革和认罪认罚从宽制度改革试点中的职能作用，依法维护犯罪嫌疑人、刑事被告人诉讼权利，加强人权司法保障，促进司法公正，现提出以下意见。 |
| I. Legal aid agencies shall station duty lawyers to people's courts or jails to provide criminal suspects or criminal defendants without defenders with legal assistance. | | 一、法律援助机构在人民法院、看守所派驻值班律师，为没有辩护人的犯罪嫌疑人、刑事被告人提供法律帮助。 |
| The people's courts, people's procuratorates, and public security authorities shall inform criminal suspects or criminal defendants of the rights to get legal assistance from duty lawyers. Where a criminal suspect or a criminal defendant and his or her close relative make a request for legal assistance, the people's court, people's procuratorate, or public security authority shall inform a duty lawyer of providing him or her with legal assistance. | | 人民法院、人民检察院、公安机关应当告知犯罪嫌疑人、刑事被告人有获得值班律师法律帮助的权利。犯罪嫌疑人、刑事被告人及其近亲属提出法律帮助请求的，人民法院、人民检察院、公安机关应当通知值班律师为其提供法律帮助。 |
| II. A legal aid duty lawyer shall perform the following responsibilities: | | 二、法律援助值班律师应当依法履行下列工作职责： |
| (1) responding to legal consultations; | | （一）解答法律咨询。 |
| (2) guiding and assisting a criminal suspect or a criminal defendant, and his or her close relative in the application for legal aid and transfer of application materials; | | （二）引导和帮助犯罪嫌疑人、刑事被告人及其近亲属申请法律援助，转交申请材料。 |
| (3) in the pilot program of the reform of the lenience system for confession and punishment acceptance, providing a criminal suspect or a criminal defendant with legal consultations, selection of procedures, application for alteration of compulsory measures, and other legal assistance, raising opinions on the procuratorial authority's proposal for conviction and sentencing, and being on the scene when a criminal suspect signs a recognizance to confession and accepting punishment; | | （三）在认罪认罚从宽制度改革试点中，为自愿认罪认罚的犯罪嫌疑人、刑事被告人提供法律咨询、程序选择、申请变更强制措施等法律帮助，对检察机关定罪量刑建议提出意见，犯罪嫌疑人签署认罪认罚具结书应当有值班律师在场。 |
(4) appealing or accusing on behalf of a criminal suspect or a criminal defendant and his or her close relative under circumstances of extortion of confessions by torture and illegal evidence collection; and
