| Article 1 In order to make investment decisions in a more scientific and democratic way and enhance the quality and efficiency of investment consultation and evaluation, these Measures are developed in accordance with the Decision of the State Council on Reforming the Investment System (No. 20 [2004], SC) and relevant requirements for the reform of the investment approval system. | | 第一条 为加强投资决策的科学性和民主性，提高投资咨询评估的质量和效率，根据《国务院关于投资体制改革的决定》（国发〔2004〕20 号）和投资审批制度改革的相关要求，制定本办法。 |
| Article 2 These Measures shall apply to the consultation and evaluation on the following matters: | | 第二条 本办法适用于以下事项的咨询评估： |
| (1) The development and construction plans subject to the approval of the NDRC or submitted by the NDRC upon confirmation to the State Council for approval. | | （一）国家发展改革委审批或核报国务院审批的发展建设规划； |
| (2) The project proposals and feasibility study reports subject to the approval of the NDRC or submitted by the NDRC upon confirmation to the State Council for approval. | | （二）国家发展改革委审批或核报国务院审批的项目建议书、可行性研究报告； |
| (3) The project application reports subject to the confirmation of the NDRC or submitted by the NDRC upon approval to the State Council for confirmation. | | （三）国家发展改革委核准或核报国务院核准的项目申请报告； |
| (4) Other matters entrusted by the NDRC. | | （四）国家发展改革委委托的其他事项。 |
| Article 3 The engineering consulting institutions confirmed by the NDRC (hereinafter referred to as the “evaluation institutions”) may undertake the consultation and evaluation tasks on matters as mentioned in Article 2 hereof. | | 第三条 经国家发展改革委确认的工程咨询机构（以下简称评估机构），可以承担第二条规定事项的咨询评估任务。 |
| Article 4 To apply for becoming an evaluation institution to undertake the consultation and evaluation tasks entrusted by the NDRC, an institution shall satisfy the following basic conditions: | | 第四条 申请成为承担国家发展改革委咨询评估任务的评估机构，应具备以下基本条件： |
| (1) It has a Grade A consultation and evaluation qualification for its specialty in respect of which it applies, and has passed practicing inspection for three consecutive years. | | （一）具有所申请专业的甲级评估咨询资格，连续3 年执业检查合格； |
| (2) It has undertaken at least 20 evaluation and feasibility study report preparation tasks for projects each with a total investment of 200 million yuan or more in its specialty in respect of which it applies (except for certain special industries) in the last three years. | | （二）近3年开展所申请专业总投资2亿元以上项目的评估和可行性研究报告编制工作不少于 20 项（特殊行业除外）； |
(3) It has at least 10 full-time professional technicians engaged in engineering consulting services in its specialty in respect of which it applies, of whom 50% or more shall have senior professional technical or economic titles and 30% or more shall be registered (investment) consulting engineers.
