| The development and reform commissions (commissions of economy and information technology) of all provinces, autonomous regions, and municipalities directly under the Central Government; and the relevant industry associations and enterprises under the central administration: | | 各省、自治区、直辖市发展改革委（经信委），有关行业协会、中央管理企业： |
| To implement the spirit of the relevant documents of the State Council, the National Development and Reform Commission (“NDRC”), through consultation with the Ministry of Public Security, the Ministry of Environmental Protection, the Ministry of Commerce, the General Administration of Customs, the State Administration of Work Safety, the General Administration of Quality Supervision, Inspection and Quarantine, the National Energy Administration and other departments, conducted research and raised the conditions and requirements for the use of imported crude oil by the relevant crude oil processing enterprises. Through reporting to the State Council for approval, the crude oil processing enterprises that have been built but have not used imported crude oil before the date of issuance of this Notice may use imported crude oil under the premise that the conditions are met upon confirmation and the corresponding obligations have been performed. To determine new enterprises that use imported crude oil and oil use quantity in a standard and orderly manner, and promote the elimination of backward production capacity, structural adjustments and industrial upgrading in the oil refining industry, you are hereby notified of the relevant matters as follows: | | 为贯彻落实国务院有关文件精神，我委商公安部、环境保护部、商务部、海关总署、安全监管总局、质检总局、能源局等部门，研究提出了有关原油加工企业使用进口原油的条件和要求。经报请国务院同意，在本通知发布之日前建成投产、尚未使用进口原油的原油加工企业，经确认符合条件并履行相应义务的前提下，可使用进口原油。为规范有序确定新增进口原油使用企业及用油数量，促进炼油行业淘汰落后、结构调整及产业升级，现将有关事项通知如下： |
| I. Guiding principles | | 一、 |
| 1. Structural optimization shall be adhered to, backward production capacity shall be strictly eliminated, and the upgrading of the oil refining industrial structure shall be promoted. | | （一）坚持优化结构，严格淘汰落后产能，促进炼油产业结构升级。 |
| 2. Enterprise voluntariness shall be adhered to, the decisive role of the market in the allocation of resources shall be played, and enterprises shall be directed to independently eliminate the backward production capacity, conduct mergers, acquisitions and reorganizations or build natural gas peak-shaving and gas storage facilities. | | （二）坚持企业自愿，发挥市场在资源配置中的决定性作用，引导企业自主淘汰落后、兼并重组或建设天然气调峰储气设施。 |
| 3. The introduction of resources is encouraged, and the crude oil processing enterprises that have fulfilled the approval procedures according to law and have legally invested in oil exploration and development projects abroad and have actual yield have priority in using imported crude oil under equal conditions. | | （三）鼓励资源引进，对依法履行审批程序，在境外合法投资石油勘探开发项目并取得实际产量的原油加工企业，可在同等条件下优先使用进口原油。 |
| 4. The deep processing of crude oil is encouraged, and crude oil processing enterprises that have complete supporting facilities and high yield of high value-added chemical products have priority in using imported crude oil under equal conditions. | | （四）鼓励原油深加工，装置配套完善且高附加值化工产品收率高的原油加工企业，可在同等条件下优先使用进口原油。 |
| 5. The adoption of advanced pollution treatment technologies is encouraged, and the crude oil processing enterprises that will complete the comprehensive treatment of organic exhaust before the end of this year, and whose discharge of all kinds of pollutants complies with national standards have priority in using imported crude oil under equal conditions. | | （五）鼓励采用先进污染治理技术，今年年底前完成有机废气综合治理，且各类污染物排放符合国家标准的原油加工企业，可在同等条件下优先使用进口原油。 |
| II. Basic conditions | | 二、基本条件 |
| A new oil use enterprise shall meet all the following conditions: | | 新增用油企业应当同时符合以下条件： |
| 1. It has one or more atmospheric and vacuum distillation units of which the crude oil processing capacity with single series design is more than two million tons per year. | | （一）拥有一套及以上单系列设计原油加工能力大于200万吨/年（不含）的常减压装置。 |
| 2. The comprehensive energy consumption for (per unit) oil refining is less than 66 kg fine oil per ton; the energy consumption for energy factor per unit does not exceed 11.5 kg fine oil per (ton·energy factor); the processing loss rate is less than 0.6%; the fresh water consumption per ton of oil is less than 0.5 ton; and the capacity of crude oil storage tanks satisfies the relevant requirements. | | （二）炼油（单位）综合能耗小于66千克标油/吨；单位能量因数能耗不超过11.5千克标油/（吨·能量因素）；加工损失率小于0.6%；吨油新鲜水耗量小于0.5吨；原油储罐容量符合有关要求。 |
| 3. It has sound product quality control rules, and its petroleum products and other refined oil products satisfy the latest national or local standards implemented at the place where the enterprise is located. | | （三）具备完善的产品质量控制制度，成品油等炼油产品符合申请时企业所在地施行的国家或地方最新标准。 |
| 4. It has normally run environmental protection facilities and emergency prevention facilities commensurate with its processing ability and quality of crude oil, among others, its pollutant discharge complies with national or local standards and the requirements for total quantity control, has prepared and reported for recordation the plan for emergency response to environmental emergencies, and has no relatively large or more serious environmental emergencies in the past three years. | | （四）具备与加工能力、原油品质等相匹配的环境保护设施和事故应急防范设施且运转正常，污染物排放符合国家或地方标准及总量控制要求，编制并报备突发环境事件应急预案，近三年未发生较大及以上突发环境事件。 |
| 5. It has sound safety rules and sound historical safety records, has no relatively large or more serious work safety accidents in the past three years, and has passed the standard review for the work safety of entities producing hazardous chemicals. | | （五）具备完善的安全制度和良好的历史安全纪录，近三年未发生较大及以上安全生产事故，通过危险化学品从业单位安全生产标准化达标评审。 |
| 6. It has sound fire safety management rules, has no relatively large or more serious fire accident in the past three years, its buildings and facilities satisfy the national technical standards for fire control, has legally established a full-time or voluntary fire brigade commensurate with its production and storage scale and hazard, and has assigned personnel, vehicles and devices according to the relevant standards. | | （六）具备完善的消防安全管理制度，近三年未发生较大及以上火灾事故，建筑和设施符合国家消防技术标准，依法建立与生产、储存规模和危险性相适应的专职或志愿消防队，依据标准配备人员、车辆及装备。 |
| 7. It has eliminated all its atmospheric and vacuum distillation units of which the designed crude oil processing capacity is no more than two million tons per year. | | （七）淘汰本企业所有设计原油加工能力200万吨/年（含）以下常减压装置。 |
