 Whereas: 鉴于:
 (1)The European Union is seeking to forge ever closer links between the States and peoples of Europe,to ensure economic and social progress;in accordance with Article 14(2)of the Treaty,the internal market comprises an area without internal frontiers in which the free movements of goods,services and the freedom of establishment are ensured;the development of information society services within the area without internal frontiers is vital to eliminating the barriers which divide the European peoples. (1) 欧盟正努力逐步实现欧洲各国与各民族间的更加紧密的联合,以确保经济与社会的发展;按照条约第十四条第(2)款,内部市场是没有内部边界的区域,在这一区域中,货物和服务的自由流动以及设立机构的自由得以确保;信息社会服务在这一没有内部边界的区域内的发展,对于消除分隔欧洲各民族的障碍是至关重要的。
 (2)The development of electronic commerce within the information society offers significant employment opportunities in the Community,particularly in small and medium—sized enterprises,and will stimulate economic growth and investment in innovation by European companies,and can also enhance the competitiveness of European industry,provided that everyone has access to the Internet. (2) 信息社会中电子商务的发展为共同体,尤其为中小型企业带来了大量的就业机会;它也将刺激经济的增长以及欧洲企业用于创新的投资的增长;在人人都有机会使用国际互联网络的条件下,这种发展还可以增强欧洲工业的竞争力。
 (3)Community law and the characteristics of the Community legal order are a vital asset to enable European citizens and operators to take full advantage,without consideration of borders,of the opportunities afforded by electronic commerce;this Directive therefore has the purpose of ensuring a high level of Community legal integration in order to establish a real area without internal borders for information society services. (3) 共同体的法律与共同体法律秩序的特征是促使欧洲公民与企业家充分利用电子商务所提供的机会,而不必考虑国界限制的重要保障;因此本指令的目的在于确保共同体法律的高度统一,以便为信息社会服务提供一个真正的无国界限制的区域。
 (4)It is important to ensure that electronic commerce could fully benefit from the internal market and therefore that,as with Council Directive 89/552EEC Of 3 October 1989 on the coordination of certain provisions laid down by law,regulation or administrative action in Member States concerning the pursuit of television broadcasting activities(4),a high level of Community integration is achieved. (4) 确保电子商务能充分地从内部市场受益,并因此实现《1989年10月3日欧盟理事会关于协调成员国关于从事电视广播活动的法律、规章或行政诉讼的若干规定的第89/552/EEC号指令》(Council Directive 89/552/EEC of 3 October 1989 on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the pursuit of television broadcasting activities)(4)中规定的共同体的高度统一是非常重要的。
 (5)The development of information society services within the Community is hampered by a number of legal obstacles to the proper functioning of the internal market which make le&s attractive the exercise of the freedom of establishment and the freedom to provide services;these obstacles arise from divergences in legislation and from the legal uncertainty as to which national rules apply to such services;in the absence of coordination and adjustment of legislation in the relevant areas,obstacles might be justified in the light of the case—law of the Court of Justice of the European Communities;legal uncertainty exists with regard to the extent to which Member States may control services originating from another Member State. (5) 共同体内部的信息社会服务的发展受到大量法律障碍的妨碍,这些妨碍内部市场正常运行的障碍减弱了行使设立机构的自由与提供服务的自由的吸引力;这些障碍源于各成员国对此类服务的法律规定的差异,以及对此类服务适用成员国国内法规则时的不确定性;在相关领域的立法未能得到协调和调整之前,根据欧洲法院的判例法,这些障碍可能被宣布为合法;一个成员国控制源于另一个成员国的服务的程度也存在着法律上的不确定性。
 (6)In the light of Community objectives,of Articles 43 and 49 of the Treaty and of secondary Community law,these obstacles should be eliminated by coordinating certain national laws and by clarifying certain legal concepts at Community level to the extent necessary for the proper functioning of the internal market;by dealing only with certain specific matters which give rise to problems for the internal market,this Directive is fully consistent with the need to respect the principle of subsidiarity as set out in Article 5 of the Treaty. (6) 根据共同体的目标、条约的第四十三条和第四十九条、以及共同体的二级立法,应当在为内部市场的正常运行所必要的程度上,通过协调若干国内法律规定,以及在共同体层面上阐明若干法律概念,来消除上述障碍;本指令只涉及导致内部市场出现问题的若干特定事项,因此,本指令完全符合条约第五条所阐明的尊重辅助性原则的要求。
 (7)In order to ensure legal certainty and consumer confidence,this Directive must lay down a clear and general framework to cover certain legal aspects of electronic commerce in the internal market. (7) 为了确保法律的确定性,并确保消费者的信心,本指令必须制定一个清晰和全面的法律框架,以涵盖内部市场范围内的电子商务中涉及法律的若干方面。
 (8)The objective of this Directive is to create a legal framework to ensure the free movement of information society services between Member States and not to harmonise the field of criminal law as such. (8) 本指令的目标在于建立一个法律框架,以确保成员国之间的信息社会服务的自由流动,但不对刑法领域本身进行上述协调。
 (9)The free movement of information society services can in many cases be a specific reflection in Community law of a more general principle.namely freedom of expression as enshrined in Article 10(1)of the Convention for the Protection of Human Rights and Fundamental Freedoms,which has been ratified by all the Member States;for this reason.directives covering the supply of information society services must ensure that this activity may be engaged in freely in the light of that Article.subject only to the restrictions laid down in paragraph 2 of that Article and in Article 46(1)of the Treaty;this Directive is not intended to affect national fundamental rules and principles relating to freedom of expression. (9) 在很多情况下,信息社会服务的自由流动可以反映共同体法律的更为一般的原则,即《保护人权与基本自由公约》(Convention for the Protection of Human Rights and Fundamental Freedoms)第十条第(1)款所明文昭示的表达自由,该公约已被所有成员国批准;因此,涉及提供信息社会服务的指令必须确保根据该条可以自由从事此行为,除非该条第(2)款以及条约的第四十六条第(1)款施加的限制条件另有规定;本指令并不打算对成员国有关表达自由的基本准则与原则施加任何影响。
 (10)In accordance with the principle of proportionality,the measures provided for in this Directive are strictly limited to the minimum needed to achieve the objective of the proper functioning of the internal market;where action at Community level is necessary,and in order to guarantee an area which is truly without internal frontiers as far as electronic commerce is to concerned,the Directive must ensure a high level of protection of objectives of general interest,in particular the protection of minors and human dignity,consumer protection and the protection of public health;according to Article 152 of the Treaty,the protection of public health is fin essential component of other Community policies. (10) 按照相称性(均衡性)原则,本指令中规定的措施严格限于满足实现内部市场的正常运行这一目标的最小需要;在有必要在共同体层面采取行动时,为了保证建成一个真正没有内部边界的、至少涉及电子交易的市场,本指令就必须确保对一般利益 的目标的高水平保护,特别是确保对未成年人和人格尊严的保护、对消费者的保护和对公共卫生的保护;根据条约第一百五十二条,对公共卫生的保护也是共同体其他政策的最基本的组成部分。
 (11)This Directive is without prejudice to the level of protection for,in particular,public health and consumer interests,as established by Community acts;amongst others,Council Directive 93/13/EEC of 5 April 1993 ON unfair terms in consumer contracts(5)and Directive 97/EC of the European Parliament and of the Council of 20 May 1997 on the protection of consumers in respect of distance contracts(6)form a vital element for protecting consumers in contractual matters;those Directives also apply in their entirety to information society services;that same Community acquis,which is fully applicable to information society services,also embraces in particular Council Directive 84/450/EEC of 10 September 1984 concerning misleading and comparative advertising(7),Council Directive 87/102/EEC of 22 December 1986 for the approximation of the laws,regulations and administrative provisionsoftheMemberStatesconcerningconsUlTler credit(8),Council Directive 93/22/EEC of 10 May 1993 on investment services in the securities field(9),Council Directive 90/314/EEC of 13 June 1990 on package travel,package holidays and package tours(10),Directive 98/6/EC of the European Parliament and of the Council of 16 February 1998 on consumer production in the indication of prices of products offered to consumers(11),Council Directive 92/59/EEC of 29 June 1992 on general product safety (12),Directive 94/47/EC of the European Parliament and of the Council of 26 October 1994 on the protection of purchasers in respect of certain aspects on contracts relating to the purchase of the right to use immovable properties on a timeshare basis(13),Directive 98/27/EC of the European Parliament and of the Council of 19 May 1998 on injunctions for the protection of consumers'interests(14),Council Directive 85/374/EEC of 25 July 1985 on the approximation of the laws,regulations and administrative provisions concerning liability for defective products(15),Directive 1999/44/EC of the European Parliament and of the Council of 25 May 1999 on certain aspects of the sale of consumer goods and associated guarantees(16),the future Directive of the European Parliament and of the Council concerning the distance marketing of consumer financial services and Council Directive 92/28;/EEC of 31 March 1992 on the advertising of medicinal products(17);this Directive should be without prejudicetoDirective98/43/ECoftheEuropeanParliament and of the Council of 6 July 1998 on the approximation of the laws,regulations and administrative provisions of the Member States relating to the advertising and sponsorship of tobacco products(18)adopted within the framework of the internal market.or to directives on the protection of public health;this Directive complements information requirements established by the abovementioned Directives and in particular Directive 97/7/EC. (11) products)(15)、《1999年5月25日欧洲议会与欧盟理事会关于生活消费品买卖及相关保证的若干问题的第1999/44/EC号指令》(Directive 1999/44/EC of the European Parliament and of the Council of 25 May 1999 on certain aspects of the sale of consumer goods and associated guarantees)(16)、《欧洲议会与欧盟理事会关于消费金融服务的远程销售的未来指令》(the future Directive of the European Parliament and of the Council concerning the distance marketing of consumer financial services)以及《1992年3月31日欧盟理事会关于医药产品广告的第92/28/EEC号指令》(Council Directive 92/28/EEC of 31 March 1992 on the advertising of medicinal products)(17);本指令不应当影响将《1998年7月6日欧洲议会与欧盟理事会关于协调统一成员国有关烟草产品广告与赞助的法律、法规与行政规章的第98/43/EC号指令》(Directive 98/43/EC of the European Parliament and of the Council of 6 July 1998 on the approximation of the laws, regulations and administrative provisions of the Member States relating to the advertising and sponsorship of tobacco products)(18)纳入内部市场或是公共卫生保护的框架中;本指令对上述指令,特别是《第97/7/EC号指令》中规定的信息要求进行了补充。
 (12)It is necessary to exclude certain activities from the scope of this Directive,on the grounds that the freedom to provide services in these fields cannot,at this stage,be guaranteed under the Treaty or existing secondary legislation;excluding these activities does not preclude any instruments which might prove necessary for the proper functioning of the internal market;taxation,particularly value added tax imposed on a large number of the services covered by this、Directive,must be excluded form the scope of this Directive. (12) 某些活动应当被排除在本指令的适用范围之外,因为在现阶段,共同体条约以及现有的二级立法尚不能保障在这些领域提供服务的自由;但是,将这些活动排除在外,并不意味着排除其他可能被证明为共同体市场的正常运行所必需的任何手段;而税收,特别是对本指令调整范围内的大部分服务所征收的增值税,必须被排除在本指令的适用范围之外。
 (13)This Directive does not aim to establish rules on fiscal obligations nor does it pre—empt the drawing up of Community instruments concerning fiscal aspects of electronic commerce. (13) 本指令将不会确定财务义务方面的规则,也不会先行起草有关电子商务的财务方面的共同体文件。
 (14)The protection of individuals with regard to the processing of personal data is.solely governed by Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and Oil the free movement of such data(19)and Directive 97/66/EC of the European Parliament and of the Council of 15 December 1997 concerning the processing of personal data and the protection of privacy in the telecommunications sector(20)which are fully applicable to information society services;these Directives already establish a Community legal framework in the field of personal data and therefore it iS not necessary to cover this issue in this Directive in order to ensure the smooth functioning of the internal market,in particular the free movement of personal data between Member States;the implementation and application of this Directive should be made in full compliance with the principles relating to the protection of personal data,ill particular aS regards unsolicited commercial communication and the liability of intermediaries;this Directive cannot prevent the anonymous use of open networks such as the Internet. (14) 在处理个人数据方面对个人的保护仅由适用于信息社会服务的《1995年10月24日欧洲议会与欧盟理事会关于在处理个人数据方面对个人的保护与此类数据的自由流动的第95/46/EC号指令》(Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data)(19)以及《1997年12月15日欧洲议会与欧盟理事会关于远程通信领域(电信部门)中的个人数据处理与隐私保护的第97/66/EC号指令》(Directive 97/66/EC of the European Parliament and of the Council of 15 December 1997 concerning the processing of personal data and the protection of privacy in the telecommunications sector)(20)管辖;这些指令已经在个人数据领域建立了共同体层面的法律框架,因此本指令无需为了确保内部市场的正常运行,特别是确保个人数据在成员国间的自由流动,而对这些问题进行调整;本指令的实施与适用,特别是在未经要求的商务通讯以及中间服务提供者的责任方面,应当完全遵守有关个人数据保护的原则;本指令不得阻碍以匿名方式利用如国际互联网等开放性网络的行为。
 (15)The confidentiality of communications is guaranteed by Article 5 Directive 97/66/EC;in accordance with that Directive,Member States must prohibit any Kind of interception or surveillance of such communications by others than the senders and receivers,except when legally authorised. (15) 《第97/66/EC号指令》第五条确保了通讯的机密性;依照该指令,成员国必须禁止除发送方或接受方以外的任何人以任何形式窃听或监听他人的通讯,除非其已获得合法授权。
 (16)The exclusion of gambling activities from the scope of application of this Directive covers only games of chance,lotteries and betting transactions,which involve wagering a stake with monetary value;this does not rover promotional competitions or games where the purpose is to encourage the sale of goods or services and where payments,if they arise,serve only to acquire the promoted goods or Services. (16) 排除在本指令适用范围以外的带有赌博性质的活动,仅仅包括概率游戏、彩票以及打赌交易(含以有财产价值的赌注进行打赌);而不包括促销性质的竞赛或游戏,只要该竞赛的目的在于促进货物或服务的销售,且获得的奖金(如有)仅仅可以用来购买被促销的货物或服务。
 (17)The definition of information society Services already exists in Community law in Directive 98/34/EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on information society Services(21)and in Directive 98/84/EC of the European Parliament and of the Council of 20 November 1998 on the legal protection of services based on,or consisting of,conditional access(22);this definition COVers any service normally provided for remuneration,at a distance,by means of electronic equipment for the processing(including digital compression)and storage of data,and at the individual request of a recipient of a service;those services referred to iD the indicative list in Annex V to Directive 98/34/EC which do not imply data processing and storage are not covered bv this definition. (17) 在《1998年6月22日欧洲议会与欧盟理事会关于在技术标准及规章领域以及在信息社会服务标准领域制定有关信息提供程序的第98/34/EC号指令》(Directive 98/34/EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on information society services)(21)以及《1998年11月20日欧洲议会与欧盟理事会关于对基于或包含一定条件的接入服务的法律保护的第98/84/EC号指令》(Directive 98/84/EC of the European Parliament and of the Council of 20 November 1998 on the legal protection of services based on, or consisting of, conditional access) (22)中,共同体法已经对信息社会服务进行了定义;此定义包括根据服务接受者的单独请求,通过电子设备远程提供的、通常为有偿的任何数据处理(包括数字压缩)及存储服务;此定义不包括那些在《第98/34/EC号指令》附件五的指示性列表中提及的、不包含数据处理及存储行为的服务。
 (18)Information society services span a wide range of economic activities which take place on—line;these activities can,in particular,consist of selling goods on—line;activities such aS the delivery of goods as such or the provision of services off—line are not covered;information society services are not solely restricted to services giving rise to on—line contracting but also,in so far aS they represent an economic activity,extend to,services which are not remunerated by those who receive them,such as those offering on—line information or commercial communications,or those providing tools allowing for search.access and retrieval of data;information society services also include services consisting of the transmission of information via a communication network,in providing access to a communication network or 113.hosting information provided by a recipient of the service;television broadcasting within the meaning of Directive EEC/89/552 and radio broadcasting are not information society services because they are not provided at individual request;by contrast,services which are transmitted point to point,such as video—on—demand or the provision of commercial communications by electronic mail are information society services;the use of electronic mail or equivalent individual communications for instance by natural persons acting outside their trade,business or profession including their use for the conclusion of contracts between such persons is not an information society service;the contractual relationship between a13 employee and his employer is not art information society service;activities which by their very nature cannot be carried out at a distance and by electronic means,such fls the statutory auditing of company accounts or medical advice requiring the physical examination of a patient are not information society services. (18) 信息社会服务覆盖了大范围的在线经济活动;特别是那些包含了在线销售货物行为的活动;但诸如交付货物一类的活动或是非在线提供服务的活动则不包括在内;信息社会服务不仅仅限于因在线缔结合同而发生的服务,在其代表的经济活动的范围内,信息社会服务还延及接受服务者无需付费的服务,例如提供在线信息通讯或商务通讯的服务,或提供搜索、取得或检索数据的工具的服务;信息社会服务也包括通过通讯网络传输信息的服务,提供接入通讯网络的服务,以及为服务接受者上载的信息提供宿主的服务;《第89/552/EEC号指令》意义上的电视播送以及电台广播不属于信息社会服务,因为它们并非根据个别请求提供;相反,点对点传输的服务,例如视频点播或通过电子邮件提供商业通讯则属于信息社会服务;自然人在其贸易、商业或职业之外,包括为了在上述自然人间缔结合同,而使用电子邮件或类似的个人通讯手段不属于信息社会服务;雇员与其雇主之间的合同关系不属于信息社会服务;本质上无法以电子形式远程进行的活动,例如对公司账目的法定审计、或需要对病人进行身体检查而进行的医疗诊断不属于信息社会服务。
 (19)The place at which a service provider is established should be determined in conformity with the case—law of the C0un of Justice according to which the concept of establishment involves the actual pursuit of an economic activity through a fixed establishment for an indefinite period;this requirement is also fulfilled where a company is constituted for a given period;the place of establishment of a company providing services via an Internet website is not the place at which the technology supporting its website is located or the place at which its website is accessible but the place where it pursues its economic activity;in cases where a provider has several places of establishment it is important to determine from which place of establishment the service concerned is、provided;in cases where it is difficult to determine from which Of several places of establishment a given service is provided,this is the place where the provider has the centre of his activities relating to this particular service. (19) 服务提供者的营业机构所在地的确定应当与欧洲法院的判例法保持一致;根据这些判例,设立机构的概念包括在一段不确定的期间内在固定的营业机构实际从事经济活动;如果设立的公司只在一段特定的期间内存在,也满足上述要求;通过互联网网站提供服务的公司的营业机构所在地不是为网站提供技术支持的地点,也不是访问其网站的地点,而是其进行经济活动的地点;如果服务提供者有多处营业机构所在地,那么确定所涉服务是在哪一个营业机构所在地提供的是非常重要的;如果很难确定某一特定服务是在哪一个营业机构所在地提供的,则以该服务提供者从事与该特定服务有关的核心活动的地点作为提供该服务的营业机构所在地。
 (20)T11e definition of“recipient of a service”covers all types of usage of information society services,both by persons who provide information On open networks such as the Internet and by persons who seek information on the Internet for private or professional reasons. (20) “服务接受者”的定义包含了对所有种类的信息社会服务的使用,既可以是在开放性网络(例如国际互联网)上提供信息的人,也可以是为个人或职业目的在国际互联网上寻找信息的人。
 (21)The scope of the coordinated field is without prejudice to future Community harmonisation relating to information society services and to future legislation adopted at national level in accordance with Community law;the coordinated field covers only requirements relating to on—line activities such as on—line information,on—line advertising,on—line shopping,on—line contracting and does not concern Member States'legal requirements relating to goods such as safety standards,labelling obligations,or liability for goods,or Member States'requirements relating to the delivery or the transport of goods,including the distribution of medicinal products;the coordinated field does not cover the exerciseofrightsofpre—emption by public authorities concerning certain goods such as works of art. (21) 经过协调的领域的范围不影响将来共同体对信息社会服务的协调以及成员国将来按照共同体法律所进行的国内立法;经过协调的领域仅包括与在线服务有关的要求,例如对在线信息、在线广告、在线购物以及在线缔结合同的要求,但不涉及成员国法律对货物的要求,如安全标准、标示义务、产品责任,或成员国有关货物交付或运输(包括医药产品的销售)的要求;经过协调的领域不包括公共机构就如艺术作品等特定货物行使优先购买权的情形。
 (22)Information society services should be supervised at the source of the activity,in order to ensure all effective protection of public interest objectives;to that end,it is necessary to ensure that the competent authority provides such protection not only for the citizens of its own country but for all Community citizens;in order to improve mutual trust between Member States,it is essential to state clearly this responsibility on the part of the Member State where the services originate;moreover,in order to effectively guarantee freedom to provide services and legal certainty for suppliers and recipients of services,such information society services should in principle be subject to the law of the Member State in which the service provider is established. (22) 为确保对公共利益目标的有效保护,应当从活动的源头对信息社会服务进行监管;为实现此目标,有必要确保主管机构不是仅仅为本国的公民提供保护,而是为全共同体的公民提供保护;为增进成员国之间的相互信任,在本指令中明确作为服务来源地的成员国的此项义务是非常关键的;此外,为有效地保障提供服务的自由,以及为服务提供者与服务接受者提供法律上的确定性,这种信息社会服务原则上应当遵守服务提供者的营业机构所在成员国的法律。
 (23)This Directive neither aims to establish additional rules on private international law relating to conflicts of law nor does it deal with the jurisdiction of Courts;provisions of the applicable law designated by rules of private international law must not restrict the freedom to provide information society services as established in this Directive. (23) 本指令不打算在冲突法领域确立额外的国际私法准则,也不打算涉及法院的管辖权;根据国际私法准则确定的可适用的法律不得限制本指令确立的提供信息社会服务的自由。
 (24)In the context of this Directive,notwithstanding the rule on the control at source of information society services,it is legitimate under the conditions established in this Directive for Member States to take measures to restrict the free movement of information society services. (24) 在本指令中,尽管有从信息社会服务的来源地实施控制的规则,但是,在符合本指令规定的条件的情况下,成员国可以采取措施限制信息社会服务的自由流动。
 (25)National courts,including civil courts,dealing with private law disputes can take measures to derogate from the freedom to provide information society services in conformity with conditions established in this Directive. (25) 在符合本指令规定的条件的情况下,处理私法纠纷的国内法院,包括民事法院,可以采取措施限制提供信息社会服务的自由。
 (26)Member States,in conformity with conditions established in this Directive;may apply their national rules on criminal law and criminal proceedings with a view to taking all investigative and other measures necessary for the detection and prosecution of criminal offences,without there being a need to notify such measures to the Commission. (26) 在符合本指令规定的条件的情况下,成员国可以适用其国内法中的刑法刑事诉讼法,并采取一切为侦查及指控刑事犯罪所必需的调查或其他措施,而无需将上述措施通知欧盟委员会。
 (27)This Directive,together with the future Directive of the European Parliament and of the Council concerning the distance marketing of consumer financial services,contributes to the creating of a legal framework for the on—line provision of financial services;this Directive does not preempt future initiatives in the area of financial services in particular with regard to the harmonisation of rules of conduct in this field;the possibility for Member States,established in this Directive,under certain circumstances of restricting the freedom to provide information society services in order to protect consumers also covers measures in the area of financial services in particular measures aiming at protecting investors. (27) 本指令与《欧洲议会与欧盟理事会关于消费者金融服务的远程销售的未来指令》一同促成了在线提供金融服务的法律框架的建立;但本指令不在金融服务领域,特别是在协调本领域的行为规则方面先行行使未来动议权;本指令规定,在特定的情况下,为保护消费者,成员国可以限制提供信息社会服务的自由,这也包括在金融服务领域采取的措施,特别是为了保护投资者而采取的措施。
 (28)The Member States'obligation not to subject access to the activity of an information society service provider to prior authorisation does not concern postal services covered by Directive 97/67/EC of the European Parliament and of the Council of 15 December 1997 on common rules for the development of the internal market of Community postal services and the improvement of quality of service(23)consisting of the physical delivery of a printed electronic mail message and does not affect voluntary accreditation systems,in particular for providers of electronic signature certification service. (28) 成员国负有不得规定只有事先获得授权方可访问或接入信息社会服务提供者所提供的活动的义务,但该义务不涉及《1997年12月15日欧洲议会与欧盟理事会关于发展共同体邮政服务的内部市场以及提高服务质量的共同规定的第97/67/EC号指令》(Directive 97/67/EC of the European Parliament and of the Council of 15 December 1997 on common rules for the development of the internal market of Community postal services and the improvement of quality of service) (23)所规定的邮政服务,该服务包括实际投递打印出的电子邮件信息,且并不影响非官方的认证鉴定系统,特别是就电子签名认证服务的提供者而言。
 (29)Commercial communications are essential for the financing of information society services and for developing a wide variety of new,chargefree services;in the interests of consumer protection and fair trading,commercial communications,including discounts,promotional offers and promotional competitions or games,must meet a number of transparency requirements;these requirements are without prejudice to Directive 97/7/EC;this Directive should not affect existing Directives on commercial communications,in particular Directive 98/43/EC. (29) 商业通讯在为信息社会服务提供经费以及发展多种类的新型、免费的服务方面非常重要;为促进消费者保护与公平贸易,商务通讯,包括折扣、促销要约以及促销竞赛或游戏必须符合一定的透明性要求;这些要求无损于《第97/7/EC号指令》;本指令不应当影响现存的适用于商业通讯的指令,特别是《第98/43/EC号指令》。
 (30)The sending of unsolicited commercial communications by electronic mail may be undesirable for consumers and information society service providers and may disrupt the smooth functioning of interactive networks;the question of consent by recipient of certain forms of unsolicitedcommercial communications is not addressed by this Directive,but has already been addressed,in particular,by Directive 97/7/EC and by Directive 97/66/EC;in Member States which authorise unsolicited commercial communications by electronic mail,the setting up of appropriate industry filtering initiatives should be encouraged and facilitated;in addition it is necessary that in any event unsolicited commercial communities&re dearly identifiable as such in order to improve transparency and to facilitate the functioning of such industry initiatives;unsolicited commercial communications by electronic mail should not result in additional communication costs for the recipient.
