| It is specified in the Decision of the Central Committee of the Communist Party of China on Several Major Issues concerning Comprehensively Deepening the Reform adopted at the Third Plenary Session of the 18th CPC Central Committee that the “community correction system shall be improved.” On April 21 of this year, when listening to the work report of the Ministry of Justice (“MOJ”), General Secretary Xi Jinping expressly indicated that community correction has been comprehensively promoted on the basis of the pilot projects and new situation and new problems will constantly emerge. The community correction system should be continuously monitored and improved; legislation should be promoted in an accelerated manner; the working system and mechanism should be straightened out; the building of correction institutions and teams should be strengthened; and the level of community correction should be effectively improved. General Secretary Xi Jinping's important instruction has fully affirmed the achievements of community correction, made comprehensive discussions on the objectives, tasks, and measures of community correction, put forward specific requirements, and pointed out the direction for further effectively conducting community correction and improving the community correction system. On May 27 of this year, the Supreme People's Court (“SPC”), the Supreme People's Procuratorate (“SPP”), the Ministry of Public Security (“MPS”), and the MOJ jointly held a national meeting on community correction. Comrade Meng Jianzhu, member of the Political Bureau of the CPC Central Committee and secretary of the Commission of Politics and Law of the CPC Central Committee, attended the meeting and delivered an important speech, and put forward specific requirements for comprehensive promotion of community correction, which had an important guiding significance for effective conduct of community correction. The important instructions of General Secretary Xi Jinping and the spirit of the important speech of Comrade Meng Jianzhu shall be diligently studied and understood, and great efforts shall be diligently made for implementation. You are hereby notified of the following opinions on comprehensively promoting community correction: | | 党的十八届三中全会通过的《中共中央关于全面深化改革若干重大问题的决定》明确提出，要“健全社区矫正制度”。今年4月21日，习近平总书记在听取司法部工作汇报时明确指出，社区矫正已在试点的基础上全面推开，新情况新问题会不断出现。要持续跟踪完善社区矫正制度，加快推进立法，理顺工作体制机制，加强矫正机构和队伍建设，切实提高社区矫正工作水平。习近平总书记的重要指示，充分肯定了社区矫正工作取得的成绩，对社区矫正工作的目标、任务、措施等作了全面论述，提出了明确要求，为进一步做好社区矫正工作、完善社区矫正制度指明了方向。今年5月27日，最高人民法院、最高人民检察院、公安部、司法部联合召开了全国社区矫正工作会议，中央政治局委员、中央政法委书记孟建柱同志出席会议并作了重要讲话，对全面推进社区矫正工作提出了明确要求，对做好社区矫正工作具有重要指导意义。要认真学习领会习近平总书记重要指示和孟建柱同志重要讲话精神，切实抓好贯彻落实。现就全面推进社区矫正工作提出如下意见： |
| I. Fully understanding the significance and necessity of comprehensively promoting community correction | | 一、充分认识全面推进社区矫正工作的重要性和必要性 |
| As an important non-imprisonment penalty execution system and an important manifestation of the criminal policy of combining punishment with leniency in penalty execution, community correction has fully reflected the superiority of socialist rule of law in educating and transforming people. Under the correct leadership of the CPC Central Committee and the State Council, China started the pilot projects of community correction in 2003, expanded the scope of pilot projects in 2005, and comprehensively implemented pilot projects in 2009. Over the ten years, through orderly promotion and smooth development, sound legal and social effects have been achieved in community correction. Currently, as community correction has had a preferable working basis, the legal system has been initially established, the leadership system and working mechanism have been gradually improved, team construction of institutions has been significantly strengthened, the guarantee capability has been further improved, the enthusiasm of social participation has been constantly enhanced, and the law of community correction has been included in the legislation plan, the timing and conditions for comprehensively promoting community correction have been mature. Comprehensively promoting community correction, and improving the community correction system is the urgent requirement for maintaining social harmony and stability and promoting the construction of a safe country, the necessity for improving the penalty execution system and promoting the reform of the judicial system, and an intrinsic requirement for reflecting the State's respect for and guarantee of human rights and implementation of the criminal policy of combining punishment with leniency. The political awareness, overall awareness, and sense of responsibility shall be effectively enhanced, community correction shall be effectively conducted, and the community correction system shall be improved, to better maximize its positive role in maintaining social harmony and stability and promoting the construction of a safe country. | | 社区矫正是一项重要的非监禁刑罚执行制度，是宽严相济刑事政策在刑罚执行方面的重要体现，充分体现了社会主义法治教育人、改造人的优越性。在党中央、国务院正确领导下，我国从2003年开始社区矫正试点，2005年扩大试点，2009年全面试行。十多年来，社区矫正工作有序推进，发展顺利，取得了良好的法律效果和社会效果。目前，社区矫正具备了较好的工作基础，法律制度初步确立，领导体制和工作机制逐步完善，机构队伍建设明显加强，保障能力进一步增强，社会参与积极性不断提高，社区矫正法已经列入立法规划，全面推进社区矫正工作的时机和条件已经成熟。全面推进社区矫正，健全社区矫正制度，是维护社会和谐稳定、推进平安中国建设的迫切要求，是完善刑罚执行制度，推进司法体制改革的必然要求，是体现国家尊重和保障人权、贯彻宽严相济刑事政策的内在要求。要切实增强政治意识、大局意识和责任意识，认真做好社区矫正工作，健全社区矫正制度，更好地发挥其在维护社会和谐稳定、推进平安中国建设中的积极作用。 |

| The guiding thought for comprehensively promoting community correction is: under the guidance of the Deng Xiaoping Theory, the important thought of “Three Represents” and the Scientific Outlook on Development, the spirit of the 18th National Congress of the Communist Party of China and the Third Plenary Session of the 18th CPC Central Committee shall be diligently implemented; the spirit of a series of important addresses of General Secretary Xi Jinping shall be diligently studied, and the spirit of the important instructions made by General Secretary Xi Jinping for the work of judicial administration shall be studied and implemented; the decision and deployment of the Central Government for deepening the reform of the judicial system and the social system shall be implemented; community correction shall be comprehensively promoted; supervision, management, education, and correction of persons serving sentences in communities, and assistance in improving social adaptability thereof shall be effectively implemented; the building of a legal system of community correction with Chinese characteristics, team construction of institutions, and the building of guarantee capacity shall be strengthened; and the community correction system shall be improved, to more effectively prevent and minimize recidivism and make positive contributions to maintaining social harmony and stability and promoting safety and rule of law in the country. | | 全面推进社区矫正工作的指导思想是：以邓小平理论、“三个代表”重要思想、科学发展观为指导，认真贯彻落实党的十八大、十八届三中全会精神，认真学习贯彻习近平总书记系列重要讲话精神，学习贯彻习近平总书记对司法行政工作重要指示精神，贯彻落实中央深化司法体制和社会体制改革的决策部署，全面推进社区矫正，切实抓好对社区服刑人员的监督管理、教育矫正和社会适应性帮扶，加强中国特色社区矫正法律制度建设、机构队伍建设和保障能力建设，健全完善社区矫正制度，更好地预防和减少重新违法犯罪，为维护社会和谐稳定，建设平安中国、法治中国作出积极贡献。 |
The basic principle of comprehensively promoting community correction is: the leadership of the Party shall be adhered to, fundamental realities of the country shall be based on, explorations shall be made for the establishment and improvement of the community correction system with Chinese characteristics, foreign systems, modes, and practices shall not be simply copied, and the correct direction of community correction shall be adhered to; starting from reality shall be adhered to in order to adapt to the local economic and social development level, full consideration shall be given to the sense of approval of the public for community correction, and the tolerance capacity for building of local communities, social resources, and work force; promotion according to the law shall be adhered to, work shall be carried out in strict accordance with the provisions of the Criminal Law and the Criminal Procedure Law, the lawful conditions and procedure shall be strictly abided by and implemented, to fully reflect the seriousness, uniformity, and authority of execution of penalties; educating and transforming persons serving sentences in communities shall be adhered to as the main task of community correction, supervision, education, and assistance of persons serving sentences in communities shall be effectively conducted, and persons serving sentences in communities shall be transformed to law-abiding citizens, to prevent and minimize recidivism; planning and coordination shall be adhered to, the functions of all departments shall be fully maximized, social forces shall be broadly mobilized to participate in community correction, to create conditions for the return of persons serving sentences in communities to the society; and reform and innovation shall be adhered to, and innovative thought and reformatory measures shall be used in resolving the difficulties and problems in the work, to continuously achieve new development and new achievements.
