最高人民法院办公厅关于切实保障执行当事人及案外人异议权的通知

各省、自治区、直辖市高级人民法院，解放军军事法院，新疆维吾尔自治区高级人民法院生产建设兵团分院：
2007年民事诉讼法修正案实施之后，各级人民法院在执行案件压力大、任务重的情况下，办理了大量的执行异议和复议案件，有效维护了执行当事人及案外人的合法权益。但是，我院在处理人民群众来信来访的过程中，也发现在个别地方法院，仍然不同程度地存在忽视甚至漠视执行当事人及案外人异议权的一些问题：有的法院对执行当事人及案外人提出的异议不受理、不立案；有的法院受理异议后，无正当理由不按照法定的异议期限作出异议裁定；有的法院违背法定程序，对异议裁定一裁终局，剥夺异议当事人通过执行复议和异议之诉再行救济的权利。
出现上述问题，既有执行案件数量大幅增加、执行机构人手不够、法律规定不够完善等客观方面的原因，也有个别执行人员司法为民意识不强、素质不高等主观方面的原因。执行当事人及案外人异议权行使渠道不畅，将使当事人对执行程序的公正性存在疑问，对强制执行产生抵触情绪，在一定程度上加剧“执行难”；另一方面，也会使部分群众对人民法院的执行工作产生负面评价，降低司法公信力。因此，必须采取切实有力的措施加以解决。现就有关事项通知如下：
