The Interpretation of the Supreme People's Court on Several Issues concerning the Specific Application of Law in the Trial of Criminal Cases of Endangering Military Communications, as adopted at the 1,430th meeting of the Judicial Committee of the Supreme People's Court on June 18, 2007, is hereby issued and shall come into force on June 29, 2007. 《最高人民法院关于审理危害军事通信刑事案件具体应用法律若干问题的解释》已于2007年6月18日由最高人民法院审判委员会第1430次会议通过,现予公布,自2007年6月29日起施行。

Interpretation of the Supreme People's Court on Several Issues concerning the Specific Application of Law in the Trial of Criminal Cases of Endangering Military Communications 最高人民法院关于审理危害军事通信刑事案件具体应用法律若干问题的解释
(No. 13 [2007] of the Supreme People's Court) (法释〔2007〕13号)
To punish criminal activities endangering military communications in accordance with law, and safeguard natural defense interests and safety in military communications, pursuant to the relevant provisions of the Criminal Law, several issues concerning the specific application of law in the trial of such criminal cases are hereby interpreted as follows: 为依法惩治危害军事通信的犯罪活动,维护国防利益和军事通信安全,根据刑法有关规定,现就审理这类刑事案件具体应用法律的若干问题解释如下:
Article 1 Whoever intentionally damages military communications lines or equipment, sabotages computer information systems for military communications, or interferes in or occupies the electromagnetic spectrum for military communications shall be convicted of the crime of sabotaging military communications in accordance with paragraph 1 of Article 369 of the Criminal Law and sentenced to imprisonment of not more than three years, criminal detention or control. Whoever sabotages important military communications shall be sentenced to imprisonment of more than three years and less than ten years.   第一条 故意实施损毁军事通信线路、设备,破坏军事通信计算机信息系统,干扰、侵占军事通信电磁频谱等行为的,依照刑法三百六十九条第一款的规定,以破坏军事通信罪定罪,处三年以下有期徒刑、拘役或者管制;破坏重要军事通信的,处三年以上十年以下有期徒刑。
Article 2 Where any of the following circumstances is present, commission of the act of sabotaging military communications shall fall under “particularly serious circumstances” as set out in paragraph 1 of Article 369 of the Criminal Law. The offender shall be convicted of the crime of sabotaging military communications and be sentenced to imprisonment of more than ten years, life imprisonment or death:   第二条 实施破坏军事通信行为,具有下列情形之一的,属于刑法三百六十九条第一款规定的“情节特别严重”,以破坏军事通信罪定罪,处十年以上有期徒刑、无期徒刑或者死刑:
(1) The offender causes interruption of or severe obstruction to important military communications, substantially affecting a troop's ability to complete its combat mission or causing the troop to suffer losses in combat. (一)造成重要军事通信中断或者严重障碍,严重影响部队完成作战任务或者致使部队在作战中遭受损失的;
(2) The offender causes interruption of or severe obstruction to communications when a troop engages in disaster relief, a military drill, emergency response or any other mission, which consequently delays the troop's movement, and results in the deaths of more than three persons, serious injuries to more than ten persons or economic loss of more than 1,000,000 yuan. (二)造成部队执行抢险救灾、军事演习或者处置突发性事件等任务的通信中断或者严重障碍,并因此贻误部队行动,致使死亡3人以上、重伤10人以上或者财产损失100万元以上的;
(3) The offender has sabotaged important military communications for more than three times. (三)破坏重要军事通信三次以上的;
(4) Other particularly serious circumstances are present. (四)其他情节特别严重的情形。
Article 3 Whoever negligently damages military communications and causes interruption of or severe obstruction to important military communications shall be deemed to have “caused serious consequences” as set out in paragraph 2 of Article 369 of the Criminal Law. The offender shall be convicted of the crime of negligently damaging military communications and be sentenced to imprisonment of less than three years or criminal detention.   第三条 过失损坏军事通信,造成重要军事通信中断或者严重障碍的,属于刑法三百六十九条第二款规定的“造成严重后果”,以过失损坏军事通信罪定罪,处三年以下有期徒刑或者拘役。
Article 4 Where any of the following circumstances is present, whoever negligently damages military communications shall be deemed to have “caused particularly serious consequences” as set out in paragraph 2 of Article 369 of the Criminal Law. The offender shall be convicted of the crime of negligently damaging military communications and be sentenced to imprisonment for more than three years and less than seven years:

   第四条 过失损坏军事通信,具有下列情形之一的,属于刑法三百六十九条第二款规定的“造成特别严重后果”,以过失损坏军事通信罪定罪,处三年以上七年以下有期徒刑:
