商务部关于应对疫情进一步改革开放做好稳外资工作的通知

For the purposes of earnestly implementing the guiding principles in the important speeches made by General Secretary Xi Jinping on coordinating the prevention and control of COVID-19 in tandem with economic and social development, comprehensively fulfilling the decisions and arrangements of the CPC Central Committee and the State Council on stabilizing foreign investment, adhering to the combination of problem-oriented and goal-oriented approaches, persisting in the combination of maintaining a stable stock while boosting the increment, insisting on combining reform and opening up with stabilizing foreign investment, and making all-out efforts to stabilize the fundamentals of foreign trade and foreign investment, the objectives of the present time and the whole year in stabilizing foreign investment are hereby notified as follows: 为认真贯彻习近平总书记关于统筹推进疫情防控和经济社会发展工作等重要讲话精神,全面落实党中央、国务院关于稳外资工作的决策部署,坚持问题导向和目标导向相结合,坚持促增量、稳存量并举,坚持在改革开放中稳外资,千方百计稳住外贸外资基本盘,现就当前及全年稳外资相关工作通知如下:
I. Fully supporting foreign-invested enterprises in restoring normal production and operation order   一、全力支持外资企业恢复正常生产经营秩序
1. Establishing and improving the working mechanism to deal with COVID-19: In accordance with the unified arrangements of the State Council, the role of the foreign trade and foreign investment coordination mechanism shall be maximized, an ad hoc team for the reopening of foreign trade enterprises and foreign-invested enterprises shall be established, the monitoring system shall be improved, and coordination and communication shall be strengthened so as to discover and resolve the difficulties and problems encountered by foreign trade enterprises in reopening to work and production. Provinces attracting large amounts of foreign investment shall, according to local actual conditions and national practices, establish and improve the relevant working mechanisms and systems, clarify their duties and functions, and encourage joint measures and concerted efforts to coordinate the resolution of problems of foreign-invested enterprises amid the reopening process. A system for communication with foreign-invested enterprises shall be established, and the implementation of supporting policies shall be combined with the resolution of their problems so as to ensure that the policies can bring real benefits to these enterprises. (一)建立健全应对疫情工作机制。按照国务院统一部署,充分发挥外贸外资协调机制作用,设立外贸外资企业复工复产工作专班,完善监测制度,加强协调沟通,及时掌握并解决外资企业复工复产遇到的困难和问题。引资大省要结合当地实际,参照国家层面做法,建立健全相应工作机制和制度,明确责任分工,上下联动、左右协同,协调解决外资企业复工复产等问题。建立外资企业联系制度,把帮助外资企业解决困难和落实支持政策相结合,兑现政策红利。
2. Accurately solving the difficulties and problems in helping foreign-invested enterprises to reopen to work: Territorial responsibilities shall be strengthened, a classified and graded administration system shall be applied, and local actual conditions shall be taken into consideration. Foreign-invested enterprises shall be guided in reopening to work and production in an orderly manner while ensuring effective epidemic prevention and control so that they can restore normal production and operation as soon as possible. Efforts shall be made to have a thorough understanding of the basic conditions of existing foreign-invested enterprises, such as progress of reopening to work, return of employees, resumption of production capacity, and business revenue, and ensure that their complete information are collected. Work journals shall be created, prominent and common problems, such as insufficient anti-viral supplies, shortage of workers, poor logistics and delivery, uncoordinated reopening of upstream and downstream industries, and a tight budget shall be resolved at a faster pace, and “one-on-one” approach shall be adopted to solve personalized problems of enterprises. All local authorities shall, based on the information collected, create a list of problems, prepare substantiated plans for the problems, and give priority to major foreign-invested enterprises and their key supporting companies in accelerating the resumption of production capacity. Greater efforts shall be made to provide guarantee for these enterprises in the production factors so that their industrial chains and supply chains will be sound and stable. Cross-province problems shall be reported in a timely manner, be analyzed and resolved through the foreign trade and foreign investment coordination mechanism. (二)精准解决外资企业复工复产困难问题。强化属地责任,分级分类,因地制宜,指导外资企业在做好防疫工作前提下有序复工复产,尽快恢复正常生产经营秩序。全面摸清存量外资企业复工进度、员工返岗率、产能利用率、营业额等基本情况,确保全覆盖。建立工作台账,抓紧解决防疫物资不足、用工短缺、物流不畅、上下游复工不协同、资金链紧张等突出共性问题,“一对一”帮助解决企业个性化问题。各地要在摸查基础上,开列清单,制订方案,重点支持龙头外资企业及其关键配套企业加快恢复产能,着力解决企业外部要素保障问题,保持产业链、供应链稳定。跨省事项及时上报,由外贸外资协调机制研究解决。
3. Serving the construction and implementation of major foreign investment projects: The mechanism for serving and tracking major foreign investment projects shall be improved, and effective measures shall be taken to select key projects and collect project information so as to build a dynamically updated database of major projects, which provides ledger management and complete process tracking services. Service guarantee shall be strengthened for major foreign investment projects under construction to help coordinate the resolution of problems in terms of return of employees, supply of materials, and logistics resources. Efforts shall be made to ensure the supply of production factors, such as land, energy and capital, so as to speed up the construction progress. Major foreign investment projects under negotiation shall be tracked and followed closely, and these projects shall be continuously facilitated by means of “one-on-one” and “through-train” programs. (三)服务重大外资项目建设和落地。完善外资大项目跟踪服务机制,做好重点项目甄别和信息收集,动态更新大项目库,实施台账管理和全流程跟踪服务。做好在建外资大项目服务保障,帮助协调返岗、物资、物流等方面问题,加强用地、用能、资金等方面要素保障,加快建设进度。密切跟踪在谈外资大项目进展,通过“一对一”服务、实施“直通车”等方式,持续推动外资大项目落地。
II. Promoting a higher level of opening up   二、推动更高水平对外开放
4. Implementing the system of pre-establishment national treatment plus negative list: The Ministry of Commerce shall, in conjunction with the National Development and Reform Commission and other relevant departments, speed up the revision of the negative list for the admittance of foreign investments nationwide, further shorten the catalogue of administrative measures, and encourage the financial sector and other service sectors to open wider to the outside world. All local authorities shall strictly put into practice the management system of the negative list to make sure that all sectors not restricted by the list are accessible, and no restrictions are imposed on the admittance of foreign investments in sectors beyond the negative list. (四)落实准入前国民待遇加负面清单制度。会同国家发展改革委等相关部门加快修订全国外资准入负面清单,进一步压减条目,扩大金融等服务业对外开放。各地要严格落实负面清单管理制度,实施“非禁即入”,负面清单之外的领域,不得设置单独针对外资的准入限制措施。
5. Further expanding the scope of encouraged foreign investment industries: The Ministry of Commerce shall, in conjunction with the National Development and Reform Commission and other relevant departments and local governments, accelerate the revision of the Catalogue of Encouraged Foreign Investment Industries, focus on advancing the high-quality development of the manufacturing industry, and further expand the scope of encouraged industries. The Ministry of Commerce shall also use tax policies or other preferential policies to mitigate the adverse impact of the pandemic, and direct more foreign investments to advanced manufacturing, emerging industries, high-tech technologies, energy conservation and environmental protection. All local authorities shall make effective use of the policies for encouraged industries, strengthen their efforts in investment promotion, and attract the relevant foreign-invested enterprises to move their focus to the central, western and northeast regions in China. (五)进一步扩大鼓励外商投资范围。会同国家发展改革委等相关部门和地方加快修订《鼓励外商投资产业目录》,聚焦促进制造业高质量发展,进一步扩大鼓励范围,通过落实税收等政策优惠对冲疫情影响,引导外资更多投向先进制造业、新兴产业、高新技术、节能环保等领域。各地要用好鼓励政策,加大招商引资力度,吸引相关外资企业向中西部地区和东北地区梯度转移。
6. Promoting the construction of pilot free trade zones and free trade ports: Pilot free trade zones shall be encouraged to accelerate the construction of new opening-up hubs. Policies and measures for further expanding opening up and innovations shall be issued. The negative list for the admittance of foreign investments to pilot free trade zones shall be further shortened so as to better leverage the role of pilot free trade zones in opening wider to the outside world. The construction of Hainan Free Trade Port shall be advanced. (六)推进自贸试验区、自由贸易港建设。加快自贸试验区开放高地建设,推动出台进一步扩大开放和创新发展的政策措施。进一步压减自贸试验区外资准入负面清单,更好地发挥扩大开放先行先试作用。推进海南自由贸易港建设。
7. Promoting the pilot program of encouraging service industries to open wider to the outside world: The arrangements of the CPC Central Committee and the State Council on expanding the reform and opening up in the service sector shall be implemented, the comprehensive pilot program of expanding opening up in the service sector of Beijing Municipality shall be promoted, experiences in the pilot program shall be summarized and spread, and researches shall be conducted on the pilot of further expanding opening up in the service sector. All local authorities shall learn from the experiences of the pilot program in real earnest, and further accelerate the opening up of the service sector based on the local conditions. (七)深入推进服务业扩大开放试点。落实党中央、国务院关于扩大服务业改革开放部署,深入推进北京市服务业扩大开放综合试点,及时总结推广试点经验,研究在全国进一步扩大服务业开放试点。各地要认真学习借鉴试点经验,结合本地实际进一步加快服务业对外开放。
8. Promoting the innovation and upgrading of national economic development zones: Efforts shall be made to profoundly implement the guiding principles in the Opinions of the State Council on Promoting Innovation in National Economic and Technological Development Zones and Promoting New Hubs of Reform and Opening up (No. 11 [2019] and the State Council) and the On-site Meeting on Innovations and Upgrading of National Economic and Technological Development Zones, with the focus laid on the development and positioning of national economic and technological development zones. There shall be also efforts to remain committed to the new development philosophy and to attach importance to high-quality development and opening up to the outside world. The assessment indicator system for national economic development zones shall be streamlined and optimized, and the weights of foreign trade and foreign investment in assessment indicators shall be increased. A dynamic management mechanism for national economic development zones shall be established and improved, and their leading role in stabilizing foreign trade and foreign investment shall be exploited.

 (八)推动国家级经开区创新提升。深入贯彻落实《国务院关于推进国家级经济技术开发区创新提升打造改革开放新高地的意见》(国发〔2019〕11号)和国家级经开区创新提升现场会精神,聚焦国家级经开区发展定位,坚持新发展理念,突出高质量发展,突出对外开放导向,精简优化考核评价指标体系,提高外贸外资考核评价指标权重,建立健全动态管理机制,发挥国家级经开区稳外贸稳外资工作示范带动作用。
