Announcement on the Implementation Measures for the Pilot Program of Relaxing the Foreign Investment Proportion Requirement for the International Shipping and International Ship Management in China (Shanghai) Pilot Free Trade Zone 关于中国(上海)自由贸易试验区试行扩大国际船舶运输和国际船舶管理业务外商投资比例实施办法的公告
To implement the Notice of the State Council on Issuing the Framework Plan for China (Shanghai) Pilot Free Trade Zone (No. 38 [2013], State Council), implement the pilot program of relaxing the foreign investment proportion requirement for the international shipping and international ship management business in China (Shanghai) Pilot Free Trade Zone (hereinafter referred to as the “SHFTZ”), and protect the lawful rights and interests of investors, the following implementation measures are hereby announced: 为贯彻落实《国务院关于印发中国(上海)自由贸易试验区总体方案的通知》(国发[2013]38号),在中国(上海)自由贸易试验区(下称“自贸区”)试点扩大国际船舶运输和国际船舶管理业务外商投资比例,保护投资者合法权益,现将试行实施办法公告如下:
I. With the approval of the transport administrative department under the State Council, a Chinese-foreign equity or contractual joint venture established in the SHFTZ with the proportion of foreign investment exceeding 49%, as well as the ships owned or actually operated by it, may be engaged in international shipping to and from Chinese ports. The relevant requirements and handling procedures shall be governed by the relevant provisions of the Regulation of the People's Republic of China on International Maritime Transportation and the Detailed Rules for the Implementation of the Regulation of the People's Republic of China on International Maritime Transportation.     一、经国务院交通运输主管部门批准,在自贸区设立的外商投资比例超过49%的中外合资、合作企业,及其拥有或实际经营的船舶,可经营进出中国港口的国际船舶运输业务。相关要求和办理程序,按照《中华人民共和国国际海运条例》和《中华人民共和国国际海运条例实施细则》有关规定执行。
II. With the approval of the transport administrative department of Shanghai, a wholly foreign-owned enterprise established in the SHFTZ may be engaged in international ship management. The transport administrative department of Shanghai shall conduct the approval procedure by reference to the relevant provisions of Articles 9 and 10 of the Regulation of the People's Republic of China on International Maritime Transportation and Article 8 of the Detailed Rules for the Implementation of the Regulation of the People's Republic of China on International Maritime Transportation, and submit the results of the approval procedure to the transport administrative department under the State Council for recordation.

   二、经上海市交通运输主管部门批准,在自贸区设立的外商独资企业可以经营国际船舶管理业务。上海市交通运输主管部门参照《中华人民共和国国际海运条例》第九条、第十条和《中华人民共和国国际海运条例实施细则》第八条的相关规定办理审批程序,并将审批结果向国务院交通运输主管部门备案。
