The Administrative Provisions for Passenger Transport by Urban Buses and Trolleybuses, as adopted at the third executive meeting of the Ministry of Transport on March 1, 2017, shall come into force on May 1, 2017. 《城市公共汽车和电车客运管理规定》已于2017年3月1日经第3次部务会议通过,自2017年5月1日起实施。

Administrative Provisions for Passenger Transport by Urban Buses and Trolleybuses 城市公共汽车和电车客运管理规定
Chapter I General Provisions 

第一章 总 则

Article 1 For the purposes of regulating the passenger transport of urban buses and trolleybuses, guaranteeing operation safety, enhancing service quality, and promoting the sound and orderly development of passenger transport of urban buses and trolleybuses, these Provisions are developed in accordance with the Guiding Opinions of the State Council on the Priority Development of Public Transport in Cities (No. 64 [2012], State Council).   第一条 为规范城市公共汽车和电车客运活动,保障运营安全,提高服务质量,促进城市公共汽车和电车客运事业健康有序发展,依据《国务院关于城市优先发展公共交通的指导意见》(国发〔2012〕64号),制定本规定。
Article 2 These Provisions shall be observed for the provision of services, operation management, maintenance of facilities and equipment, security guarantee, and other activities concerning passenger transport by urban buses and trolleybuses (hereinafter referred to as “urban buses”).   第二条 从事城市公共汽车和电车(以下简称城市公共汽电车)客运的服务提供、运营管理、设施设备维护、安全保障等活动,应当遵守本规定。
For the purpose of these Provisions, “passenger transport of urban buses” means the activities of using buses and service facilities for passenger transport by urban buses that comply with the relevant standards and provisions of the state to operate according to confirmed routes, stations, time and ticket price, and providing basic travel services to the public within the regions determined by city people's governments. 本规定所称城市公共汽电车客运,是指在城市人民政府确定的区域内,运用符合国家有关标准和规定的公共汽电车车辆和城市公共汽电车客运服务设施,按照核准的线路、站点、时间和票价运营,为社会公众提供基本出行服务的活动。
For the purpose of these Provisions, “service facilities for passenger transport by urban buses” means the parking lots, maintenance fields, houses used in stations, bus shelters, bus stations and station boards that guarantee the passenger transport services of urban buses, as well as relevant facilities such as oil (gas) stations, trolley wire networks, rectifier stations and charging facilities for electric buses. 本规定所称城市公共汽电车客运服务设施,是指保障城市公共汽电车客运服务的停车场、保养场、站务用房、候车亭、站台、站牌以及加油(气)站、电车触线网、整流站和电动公交车充电设施等相关设施。
Article 3 The Ministry of Transport shall be responsible for directing the administration of passenger transport by urban buses nationwide.   第三条 交通运输部负责指导全国城市公共汽电车客运管理工作。
The competent transport department of the people's government of a province or an autonomous region shall be responsible for directing the administration of passenger transport by urban buses within its administrative region. 省、自治区人民政府交通运输主管部门负责指导本行政区域内城市公共汽电车客运管理工作。
The competent transport department of the people's government of a city or the department designated by the people's government of a city to be in charge of the operation of urban public transport (hereinafter referred to as the “competent department of urban public transport”) shall specifically undertake the administration of passenger transport of urban buses within its administrative region. 城市人民政府交通运输主管部门或者城市人民政府指定的城市公共交通运营主管部门(以下简称城市公共交通主管部门)具体承担本行政区域内城市公共汽电车客运管理工作。
Article 4 Passenger transport by urban buses is an important part of urban public transport and has the attribute of public undertaking.   第四条 城市公共汽电车客运是城市公共交通的重要组成部分,具有公益属性。
The competent transport department and the competent department of urban public transport of the people's government of a province or an autonomous region shall, under the leadership of the people's government at the same level and jointly with the relevant departments, carry out the policies and measures that give priority to the development of passenger transport by urban buses on urban planning, financial policies, land use supply, facilities construction, distribution of road rights, and other aspects according to the strategy of the state on giving priority to the development of public transport. 省、自治区人民政府交通运输主管部门和城市公共交通主管部门应当在本级人民政府的领导下,会同有关部门,根据国家优先发展公共交通战略,落实在城市规划、财政政策、用地供给、设施建设、路权分配等方面优先保障城市公共汽电车客运事业发展的政策措施。
Article 5 The developments of passenger transport by urban buses shall observe the principles of safety and reliability, convenience and efficiency, being economic and applicable, and energy conservation and environmental protection.   第五条 城市公共汽电车客运的发展,应当遵循安全可靠、便捷高效、经济适用、节能环保的原则。
Article 6 The state encourages the large-scale and centralized operation of operators engaging in passenger transport ny urban buses.   第六条 国家鼓励城市公共汽电车客运运营企业实行规模化、集约化经营。
Article 7 The state encourages the popularization of new technologies, new energies and new equipment, and shall strengthen the intelligent construction of urban public transport, and promote the application of the Internet of things, big data, mobile Internet and other modern information technologies in the operation, service and management of passenger transport by urban buses.   第七条 国家鼓励推广新技术、新能源、新装备,加强城市公共交通智能化建设,推进物联网、大数据、移动互联网等现代信息技术在城市公共汽电车客运运营、服务和管理方面的应用。
Chapter II Planning and Construction 

第二章 规划与建设

Article 8 The competent departments of urban public transport shall consider urban development and the basic travel demand of the public as a whole and, jointly with the relevant departments, organize the preparation of and amendment to the planning on the network of urban buses.   第八条 城市公共交通主管部门应当统筹考虑城市发展和社会公众基本出行需求,会同有关部门组织编制、修改城市公共汽电车线网规划。
In the preparation of and amendment to the planning on the network of urban buses, the network of urban buses, layout of bus stations, and the establishment of transfer hubs and important transport nodes shall be scientifically designed, attention shall be paid to the connection and coordination of urban buses and other means of transport, and the opinions of relevant departments and all parties of the society shall be extensively solicited. 编制、修改城市公共汽电车线网规划,应当科学设计城市公共汽电车线网、场站布局、换乘枢纽和重要交通节点设置,注重城市公共汽电车与其他出行方式的衔接和协调,并广泛征求相关部门和社会各方的意见。
Article 9 The competent departments of urban public transport shall, according to the planning on the network of urban buses and in light of city development and the travel demand of the public, open or adjust urban public bus lines and stations in good time upon scientific authentication, and solicit the opinions of the public.   第九条 城市公共交通主管部门应当依据城市公共汽电车线网规划,结合城市发展和社会公众出行需求,科学论证、适时开辟或者调整城市公共汽电车线路和站点,并征求社会公众意见。
The new construction, reconstruction and expansion of service facilities for passenger transport by urban buses shall be in line with the planning on the network of urban buses. 新建、改建、扩建城市公共汽电车客运服务设施,应当符合城市公共汽电车线网规划。
Article 10 The competent departments of urban public transport shall, according to the planning on the network of urban buses, determine the relevant standards for urban roads and other municipal facilities, and supporting service facilities for the passenger transport by urban buses for large-scale construction projects such as large-scale residential areas, transport hubs, business centers, and industrial parks.   第十条 城市公共交通主管部门应当按照城市公共汽电车线网规划,对城市道路等市政设施以及规模居住区、交通枢纽、商业中心、工业园区等大型建设项目配套建设城市公共汽电车客运服务设施制定相关标准。
Article 11 The competent departments of urban public transport shall, jointly with relevant departments, scientifically set bus transit lanes, signal systems giving priority to buses, and harbor-shaped bus stops, among others, according to the requirements of relevant standards, so as to enhance the passage efficiency of urban buses.   第十一条 城市公共交通主管部门应当会同有关部门,按照相关标准要求,科学设置公交专用道、公交优先通行信号系统、港湾式停靠站等,提高城市公共汽电车的通行效率。
Article 12 The competent departments of urban public transport shall, on a periodical basis, conduct investigation on the travel of the public, sufficiently utilize the mobile network, big data, cloud computing and other modern information technologies to collect and analyze the public's travel time, methods, frequency, space distribution and other information as the basis for optimizing the network of urban public transport.   第十二条 城市公共交通主管部门应当定期开展社会公众出行调查,充分利用移动互联网、大数据、云计算等现代信息技术收集、分析社会公众出行时间、方式、频率、空间分布等信息,作为优化城市公共交通线网的依据。
Article 13 The competent departments of urban public transport shall, according to relevant standards, uniformly name the lines and bus stations of urban buses, so as to facilitate the travel and transfer of passengers.   第十三条 城市公共交通主管部门应当按照有关标准对城市公共汽电车线路、站点进行统一命名,方便乘客出行及换乘。
Chapter III Operation Management 

第三章 运营管理

Article 14 The licensed operation of passenger transport of urban buses shall be conducted according to the relevant provisions of the state, and the competent departments of urban public transport shall, according to the principles of large-scale operation and moderate competition, comprehensively consider the allocation of transport capacity, the demand of the public, the safety of the public, and other factors, select operators through bid invitation of service quality, and grant the right to operate urban public bus lines. If the conditions for bid invitation are not met, the competent department of urban public transport of a city shall select the best from the operators which have obtained the line operation right. The competent department of urban public transport of a city shall enter into a licensed line operation agreement with the operator that has obtained the line operation right.   第十四条 城市公共汽电车客运按照国家相关规定实行特许经营,城市公共交通主管部门应当根据规模经营、适度竞争的原则,综合考虑运力配置、社会公众需求、社会公众安全等因素,通过服务质量招投标的方式选择运营企业,授予城市公共汽电车线路运营权;不符合招投标条件的,由城市公共交通主管部门择优选择取得线路运权的运营企业。城市公共交通主管部门应当与取得线路运营权的运营企业签订线路特许经营协议。
The right of operating urban public bus lines shall be conferred free of charge, and a competent department of urban public transport shall not auction the right of operating urban public bus lines. An operator shall not transfer or lease the right of operating urban bus lines or do so in any disguised form. 城市公共汽电车线路运营权实行无偿授予,城市公共交通主管部门不得拍卖城市公共汽电车线路运营权。运营企业不得转让、出租或者变相转让、出租城市公共汽电车线路运营权。
Article 15 To apply for the right of operating urban public bus lines, an applicant shall meet the following conditions:   第十五条 申请城市公共汽电车线路运营权应当符合下列条件:
(1) It has a business license for an enterprise legal person. (一)具有企业法人营业执照;
(2) It has operating vehicles which comply with the requirements for operating lines or a letter of commitment on the provision of vehicles in compliance with relevant standards and provisions of the state. (二)具有符合运营线路要求的运营车辆或者提供保证符合国家有关标准和规定车辆的承诺书;
(3) It has a rational and feasible line operation plan which complies with the requirements for safe operation. (三)具有合理可行、符合安全运营要求的线路运营方案;
(4) It has sound operation service management rules, work safety management rules and service quality guarantee rules. (四)具有健全的经营服务管理制度、安全生产管理制度和服务质量保障制度;
(5) It has corresponding managers and employees commensurate with the operating business. (五)具有相应的管理人员和与运营业务相适应的从业人员;
(6) It meets other conditions prescribed by relevant laws and regulations. (六)有关法律、法规规定的其他条件。
Article 16 The right of operating urban public bus lines shall be subject to a duration restriction, and a uniform duration shall be adopted for the right of operating urban bus lines in the same city.   第十六条 城市公共汽电车线路运营权实行期限制,同一城市公共汽电车线路运营权实行统一的期限。
Article 17 An agreement on the licensed operation of urban bus lines shall specify the following content:   第十七条 城市公共汽电车线路特许经营协议应当明确以下内容:
(1) Operating lines, setup of stations, number of vehicles and vehicle types, time of the first and last buses, operation intervals, and the duration of line operation right, among others. (一)运营线路、站点设置、配置车辆数及车型、首末班次时间、运营间隔、线路运营权期限等;
(2) Operating service standards. (二)运营服务标准;
(3) Security guarantee rules, measures and responsibilities. (三)安全保障制度、措施和责任;
(4) Ticket systems and prices. (四)执行的票制、票价;
(5) Conditions and methods for the modification, extension, suspension and termination of line operation right. (五)线路运营权的变更、延续、暂停、终止的条件和方式;
(6) Contract performance guarantee. (六)履约担保;
(7) Assumption of risks within the operating term. (七)运营期限内的风险分担;
(8) Emergency response plans and temporary takeover plans. (八)应急预案和临时接管预案;
(9) Requirements for the submission of operation data by the operator. (九)运营企业相关运营数据上报要求;
(10) Liability for breach of contract. (十)违约责任;
(11) Methods for mediation of disputes. (十一)争议调解方式;
(12) Other rights and obligations of both parties. (十二)双方的其他权利和义务;
(13) Other matters that shall be agreed upon in the opinion of both parties. (十三)双方认为应当约定的其他事项。
Where it is indeed necessary to modify the content of the agreement within the validity term of the licensed line operation agreement, both parties to the agreement shall enter into a supplementary agreement on the basis of joint consultation. 在线路特许经营协议有效期限内,确需变更协议内容的,协议双方应当在共同协商的基础上签订补充协议。
Article 18 Where the term of the right of operating urban public bus lines expires, the competent department of urban public transport shall select a new operator that obtains the line operation right according to Article 14.   第十八条 城市公共汽电车线路运营权期限届满,由城市公共交通主管部门按照第十四条规定重新选择取得该线路运营权的运营企业。
Article 19 An operator which has obtained the right of operating urban public bus lines shall, according to the requirements of the licensed line operation agreement, provide continuous services, and shall not cease operation without approval.   第十九条 获得城市公共汽电车线路运营权的运营企业,应当按照线路特许经营协议要求提供连续服务,不得擅自停止运营。
Where an operator needs to suspend the operation of urban public bus lines, it shall report it to the competent department of urban public transport three months in advance. The operator shall, according to the requirements of the competent department of urban public transport, announce to the public seven days before the date of suspension. The competent department of urban public transport shall, as required, take response measures such as temporarily designating an operator and dispatching vehicles, so as to guarantee the public's travel demand. 运营企业需要暂停城市公共汽电车线路运营的,应当提前3个月向城市公共交通主管部门提出报告。运营企业应当按照城市公共交通主管部门的要求,自拟暂停之日7日前向社会公告;城市公共交通主管部门应当根据需要,采取临时指定运营企业、调配车辆等应对措施,保障社会公众出行需求。
Article 20 When an operator is unable to operate due to bankruptcy, dissolution, revocation of the line operation right, force majeure or any other reason within the term of the line operation right, it shall inform the competent department of urban public transport in writing in a timely manner. The competent department of urban public transport shall select a new line operator according to relevant provisions of the state.   第二十条 在线路运营权期限内,运营企业因破产、解散、被撤销线路运营权以及不可抗力等原因不能运营时,应当及时书面告知城市公共交通主管部门。城市公共交通主管部门应当按照国家相关规定重新选择线路运营企业。
Where an operator is subject to business combination or division within the term of the line operation right, the operator shall apply to the competent department of urban public transport for terminating its original line operation right. If the operator after business combination or division meets the conditions prescribed in Article 15 of these Provisions, the competent department of urban public transport may sign a new licensed line operation agreement on the operator's original line operation right with the operator. If the operator fails to satisfy relevant requirements, the competent department of urban public transport shall select a new line operator according to relevant provisions of the state. 在线路运营权期限内,运营企业合并、分立的,应当向城市公共交通主管部门申请终止其原有线路运营权。合并、分立后的运营企业符合本规定第十五条规定条件的,城市公共交通主管部门可以与其就运营企业原有的线路运营权重新签订线路特许经营协议;不符合相关要求的,城市公共交通主管部门应当按照国家相关规定重新选择线路运营企业。
Article 21 A competent department of urban public transport shall cooperate with relevant departments in effectively determining and adjusting the ticket system and ticket price in accordance with the law, and according to ticket cost and under the principle of encouraging the public to give priority to urban public transport, determine the ticket system and ticket price by making overall planning and considering the public's tolerance, the government's fiscal conditions, travel distance, and other factors.   第二十一条 城市公共交通主管部门应当配合有关部门依法做好票制票价的制定和调整,依据成本票价,并按照鼓励社会公众优先选择城市公共交通出行的原则,统筹考虑社会公众承受能力、政府财政状况和出行距离等因素,确定票制票价。
An operator shall implement the ticket system and ticket price for urban buses determined by the people's government of a city. 运营企业应当执行城市人民政府确定的城市公共汽电车票制票价。
Article 22 An operator shall, according to the accounting standards for business enterprises and other relevant provisions, strengthen financial management, regulate accounting, and as required, report operation information, statistical statements, annual accounting reports and other information to the competent department of urban public transport. An annual accounting report shall cover the part where the operator's actual ticket price is lower than the operation cost, the income reduced due to the implementation of the preferential passage policy taken by the government, and the expenditure occurred from the implementation of tasks commanded by the government, such as rescue and relief, among others.

   第二十二条 运营企业应当按照企业会计准则等有关规定,加强财务管理,规范会计核算,并按规定向城市公共交通主管部门报送运营信息、统计报表和年度会计报告等信息。年度会计报告内容应当包括运营企业实际执行票价低于运营成本的部分,执行政府乘车优惠政策减少的收入,以及执行抢险救灾等政府指令性任务发生的支出等。
