| The Decision on Amending the Civil Procedure Law of the People's Republic of China, as deliberated and adopted at the 28th Session of the Standing Committee of the Eleventh National People's Congress on August 31, 2012, has been implemented on January 1, 2013. In order to correctly apply the amended Civil Procedure Law, you are hereby notified of the relevant issues as follows: | | 2012年8月31日第十一届全国人民代表大会常务委员会第二十八次会议审议通过的《关于修改＜中华人民共和国民事诉讼法＞的决定》，已于2013年1月1日起施行。为正确适用修改后民事诉讼法，现就有关问题通知如下： |
| I. The people's procuratorates shall, prior to March 31, 2013, complete the examination of cases that are accepted before December 31, 2012 but the examination of which has not been completed. | | 一、人民检察院对于2012年12月31日前受理但尚未审查终结的案件，应当在2013年3月31日前审查终结。 |
II. Where a party files an application for supervision with a people's procuratorate after January 1, 2013, the people's procuratorate shall examine the application in accordance with Articles 208 and 209 of the amended Civil Procedure Law and accept the application where it meets the aforesaid provisions. Where a party fails to file an application for retrial with a people's court but directly files an application for supervision with a people's procuratorate, the people's procuratorate shall not accept the application in accordance with paragraph 1 of Article 209 of the amended Civil Procedure Law.
．．．．．． | | 二、当事人在2013年1月1日后向人民检察院申请监督的，人民检察院应当依照修改后民事诉讼法第二百零八条、第二百零九条的规定进行审查，符合上述规定的，应当受理。当事人未向人民法院申请再审，直接向人民检察院申请监督的，人民检察院应当依照第二百零九条第一款的规定不予受理。
