| Chapter I General Provisions | | 第一章 总则 |
| |
|
| Article 1 For purposes of regulating the vessel management business operations, maintaining the market order of vessel management, ensuring the transport safety of waterway and promoting the sound development of waterway transport industry, these Provisions are formulated in accordance with relevant laws and administrative regulations. | | 第一条 为规范船舶管理业经营活动，维护船舶管理市场秩序，保障水路运输安全，促进水路运输业健康发展，根据有关法律、行政法规，制定本规定。 |

| Article 2 The domestic vessel management business operations and supervision and administration thereof within the territory of the People's Republic of China shall be governed by these Provisions. | | 第二条 本规定适用于在中华人民共和国境内的国内船舶管理业务经营和监督管理活动。 |
The term “vessel management business” as mentioned in these Provisions means that the vessel management business operators provide the following vessel management services to the owners, lessees, business operators of vessels under the contractual stipulations: | |
本规定所称船舶管理业，是指船舶管理经营人根据约定，为船舶所有人或者船舶承租人、船舶经营人提供下列船舶管理服务： |

| 1. management of mechanical affairs of vessels; | | （一）船舶机务管理； |
| |
|
| 2. management of maritime affairs of vessels; | | （二）船舶海务管理； |
| |
|
| 3. inspection, repair and maintenance of vessels; | | （三）船舶检修、保养； |
| |
|
| 4. buying, selling, leasing, operation and asset management of vessels; and | | （四）船舶买卖、租赁、营运及资产管理； |
| |
|
| 5. other vessel management services. | | （五）其他船舶管理服务。 |
| |
|
| Article 3 The principle of lawful business operation and fair competition shall be followed in the vessel management business operations. | | 第三条 从事船舶管理业经营活动，应当遵守合法经营、公平竞争的原则。 |
| |
|
| Article 4 The transport administrative department of the people's government at and above the county level shall, under these Provisions and other provisions of the state, administer the vessel management business and may authorize their shipping administrative divisions to take charge of the concrete administration of the vessel management business. | | 第四条 县级以上人民政府交通运输主管部门根据本规定和国家其他规定对船舶管理业实施管理，并可委托其设置的航运管理机构负责船舶管理业的具体管理工作。 |

| Chapter II Business Operation Qualifications | | 第二章 经营资质 |
| |
|
| Article 5 A vessel management business operator shall meet the following requirements: | | 第五条 经营船舶管理业，应当具备下列条件： |
| |
|
| 1. having the registered capital which conforms to the provisions of the state; | | （一）有符合国家规定的注册资本； |
| |
|
| 2. having full time managers who conform to these Provisions; | | （二）有符合本规定的专职管理人员； |
| |
|
| 3. having equipment and facilities which are compatible with its business operations; | | （三）有与经营业务相适应的设备、设施； |
| |
|
| 4. having the vessel safety and pollution prevention management systems as required by the state; and | | （四）有符合国家规定的船舶安全与防污染管理体系； |
| |
|
| 5. other requirements as prescribed by laws and administrative regulations. | | （五）法律、行政法规规定的其他条件。 |
| |
|
| Article 6 An enterprise engaging in the domestic vessel management business shall, in light of the number of vessels with which it provides services of management of maritime and mechanical affairs, have enough number of full time managers of maritime and mechanical affairs under the following requirements: | | 第六条 从事国内船舶管理业务的企业应当根据其提供海务管理、机务管理服务的船舶艘数，配备满足下列数量要求的海务、机务专职管理人员： |
| |
|
| 1. If it manages 1 up to 10 coastal general cargo vessels, at least 1 for each function; 11 up to 20 vessels, at least 2 for each function; 21 up to 30 vessels, at least 3 for each function; more than 30 vessels, at least 4 for each function; | | （一）管理沿海普通货船1至10艘的，至少分别配备1人；11至20艘的，至少分别配备2人；21至30艘的，至少分别配备3人；30艘以上的，至少分别配备4人； |
| |
|
| 2. If it manages 1 up to 10 inland waters ordinary cargo vessels, at least 1 for each function; 11 up to 50 vessels, at least 2 for each function; 51 up to 100 vessels, at least 3 for each function; more than 100, at least 4 for each function; | | （二）管理内河普通货船1至10艘的，至少分别配备1人；11至50艘的，至少分别配备2人；51至100艘的，至少分别配备3人；100艘以上的，至少分别配备4人； |

|
| 3. if it manages 1 up to 5 coastal vessels carrying bulk liquid hazardous goods or coastal passenger vessels, at least 1 for each function; 6 up to 10 vessels, at least 2 for each function; 11 up to 20 vessels, at least 3 for each function; more than 20 vessels, at least 4 for each function; and | | （三）管理沿海散装液体危险品船或者客船1至5艘的，至少分别配备1人；6至10艘的，至少分别配备2人；11至20艘的，至少分别配备3人；20艘以上的，至少分别配备4人； |
| |
|
| 4. if it manages 1 up to 10 inland waters vessels carrying bulk liquid hazardous goods or inland waters passenger vessels, at least 1 for each function; 11 up to 20 vessels, at least 2 for each function; 21 up to 30 vessels, at least 3 for each function; more than 30 vessels, at least 4 for each function. | | （四）管理内河散装液体危险品船或者客船1至10艘的，至少分别配备1人；11至20艘的，至少分别配备2人；21至30艘的，至少分别配备3人；30艘以上的，至少分别配备4人。 |
A full-time manager of maritime or mechanical affairs as required in the preceding paragraph shall have the background and qualifications of captain or chief engineer corresponding to the type of the vessel under management and to the navigation area; moreover, he shall sign a full time employment contract with a term of 1 year or more with the vessel management enterprise and shall not concurrently assume any other post on board or in any other enterprise within the contractual term. | |
前款要求的海务、机务专职管理人员应当具有与其所管理船舶种类和航区相对应的船长、轮机长任职的从业资历；并与该船舶管理企业签订一年以上全日制用工的劳动合同，在合同期限内不得在船上或者其他企业兼职。 |

| Article 7 To apply for engaging in the domestic vessel management business, an applicant shall submit the following materials to the transport administrative department of the local people's government: | | 第七条 申请经营国内船舶管理业务，应当向其所在地人民政府交通运输主管部门提交下列材料： |
| |
|
| 1. an application; | | （一）申请书； |
| |
|
| 2. its Enterprise Legal Person Business License (in the case of preparatory establishment, Notice on Pre-approval of Enterprise Name) and a photocopy thereof; | | （二）《企业法人营业执照》（筹建的提供《企业名称预先核准通知书》）及其复印件； |
| |
|
3. the documents certifying the basic information about the shareholders of the enterprise and about the investments made by the shareholders, the Enterprise Legal Person Business License provided by the legal person shareholders and photocopies thereof, the identity certificates of the natural person shareholders and photocopies thereof;
